Abstract

The KPU as the respondent in the Supreme Court decision, as previously explained, was ordered to amend Article 8 paragraph (2) of PKPU 10/2023, this was not followed up by the KPU. Instead of revising the regulations, the KPU decided to make an official letter containing a request to Political Parties to comply with the Supreme Court decision, the implications of this Article make the list of permanent candidates for female DPRD members of Bandung Regency many less than 30% in each electoral district, The method used by researchers in this study is the Empirical Normative Legal Method which uses a normative or binding and regulatory rule or law which is combined with factual empirical data. The results of the study show that the KPU did not comply with the Supreme Court decision to revise Article 8 paragraph 2, The implications of rounding the decimal down caused 33 electoral districts on the list of permanent candidates for DPRD members from 18 contesting parties to be less than 30% female representation. From the perspective of the industrial policy, there is no prohibition regarding women in politics or becoming a leader, especially if what a woman is fighting for are good things and things that are beneficial for everyone.

Abstract

 The enhancement of halal product assurance for Micro, Small, and Medium Enterprises (MSMEs) has become one of the strategic national agendas in realizing consumer protection for Muslims, as stipulated in Law Number 33 of 2014 concerning Halal Product Assurance. This study aims to analyze the role of the Halal Inspection Agency (LPH) of UIN Sunan Gunung Djati Bandung in facilitating halal certification for MSMEs in Cileunyi Subdistrict, as well as to examine its implementation from the perspective of Siyasah Dusturiyah. This research employs a juridical-empirical approach using a descriptive-analytical method, supported by primary data obtained through observation and interviews, and secondary data from literature studies and official documents. The results of the study show that the LPH plays an active role in providing education, technical assistance, and conducting halal audits, which have a positive impact on increasing the number of certified MSMEs, enhancing the sharia awareness of business actors, and improving product competitiveness. The challenges encountered include low halal literacy and a limited number of auditors. From the Siyasah Dusturiyah perspective, the implementation of halal inspections reflects the state's role in ensuring public welfare through synergy between religious institutions, the government, and society. This activity also serves as a concrete form of integration of the functions of Islamic higher education in socio-economic development based on sharia values.

Abstract

The Constitutional Court Decision Number 176/PUU-XXII/2024 is a judicial response to the normative vacuum regarding the right of elected legislative candidates to resign, as previously unregulated in Law Number 7 of 2017 concerning General Elections. The right to resign, which was previously not strictly limited, has created a loophole for abuse of power that negatively impacts the integrity of elections and the sovereignty of the people. This study aims to analyze the limitation of this right through three main approaches: constitutional-legal analysis, legal implications, and the perspective of siyasah dusturiyah. The research method used is a normative and conceptual legal approach, strengthened by analysis of Constitutional Court decisions, scholarly articles, and Qur'anic interpretation. The findings indicate that restricting the right to resign aligns not only with the principles of constitutional democracy and legal justice but also with the principles of trust (amanah) and justice in Islamic political jurisprudence. The verse QS Al-Ahzab [33]:72 provides a normative basis affirming the importance of exercising entrusted power with justice. Therefore, the state is obligated to formulate technical regulations as an implementation of the decision to ensure the protection of the people's votes and to prevent the manipulation of legislative power by political actors.

Abstract

The purpose of this research is to find out: 1) political rights of citizens in elections, 2) legal responsibility in a democracy, 3) Legal guarantee of constitutional rights, This research method is a form of normative juridical research, with a qualitative approach, while legal information is obtained from statutory regulations concerning the political rights of citizens, in this study it was found that political rights are constitutive rights established by law, but related to legal responsibility based on morals and ethics for the sustainability of democracy, and constitutionally every citizen has legal guarantees in fulfilling his political rightsTujuan Penelitian ini adalah untuk mengetahui; 1)  hak politik warga negara  dalam pemilu,  2) tanggung jawab   hukum  dalam demokrasi, 3) Jaminan hukum terhadap hak konstitusional, metode penelitian ini  merupakan bentuk penelitian yuridis normatif, dengan pendekatan kualitatif, sedangkan informasi hukum didapatkan dari peraturan perundang-undangan tentang  hak-hak politik warga negara,   dalam penelitian ini ditemukan bahwasanya hak politik adalah hak konstitutif yang ditetapkan oleh undang-undang, akan tetapi  berkaitan dengan tanggung jawab hukum yang berdasarkan pada moral dan etik terhadap keberlangsungan demokrasi, dan secara konstitusional setiap warga negara mendapat jamianan hukum dalam memenuhi hak politiknya.

Abstract

asal 34 UUD 1945 secara tegas mengamanatkan negara untuk memelihara anak terlantar, namun realitas di lapangan sering kali menunjukkan kesenjangan antara regulasi dan implementasi. Penelitian ini bertujuan untuk menganalisis bentuk dan efektivitas pertanggungjawaban negara terhadap anak terlantar di Kabupaten Garut, serta meninjaunya dari perspektif Siyasah Maliyah (Hukum Keuangan Publik Islam). Penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif. Data dikumpulkan melalui observasi dan wawancara mendalam dengan pihak Dinas Sosial Kabupaten Garut. Hasil penelitian menunjukkan bahwa secara normatif, Pemerintah Kabupaten Garut telah menerbitkan Peraturan Daerah Nomor 11 Tahun 2023 dan menjalankan prosedur rehabilitasi sosial dasar. Namun, implementasi kebijakan tersebut terhambat oleh ketiadaan rumah singgah (shelter), kurangnya kendaraan operasional, dan keterbatasan anggaran. Dalam tinjauan Siyasah Maliyah, kondisi ini mengindikasikan bahwa kebijakan anggaran daerah (APBD) belum sepenuhnya menerapkan prinsip prioritas (Fiqh al-Awlawiyat) yang menempatkan keselamatan jiwa anak sebagai kebutuhan mendesak (dharuriyat). Kesimpulannya, pertanggungjawaban negara di Garut baru berjalan optimal pada tataran administratif, namun masih lemah dalam dukungan infrastruktur dan keberpihakan anggaran bagi kaum rentan.

Abstract

Tujuan dari penelitian ini adalah untuk melihat kebijakan hukum hakim dalam Putusan Mahkamah Konstitusi Nomor 150/PUU-XXII/2024 yang membatalkan larangan dosen Pegawai Negeri Sipil (PNS) berprofesi sebagai advokat; implikasi hukum dari putusan ini terhadap profesi dosen advokat, serta hubungannya dengan politik dusturiyah. Penelitian ini menggunakan yuridis normatif dengan pendekatan deskriptif-analitis. Bahan hukum sekunder, termasuk peraturan perundang-undangan, putusan pengadilan, dan doktrin hukum, dipelajari. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi menerapkan penafsiran konstitusional bersyarat, atau penafsiran konstitusional berdasarkan kondisi, dengan menegaskan bahwa larangan dosen PNS menjadi advokat bertentangan dengan prinsip persamaan di hadapan hukum, kebebasan akademik, dan hak untuk mengembangkan diri yang dijamin dalam Pasal 27 ayat (1), Pasal 28C ayat (1), dan Pasal 28D ayat (1) UUD 1945. Dengan keputusan ini, dosen PNS dapat berpraktik sebagai advokat secara terbatas dalam kerangka pengabdian masyarakat melalui layanan bantuan hukum pro bono, sambil mempertahankan netralitas ASN dan akuntabilitas kelembagaan. Menurut perspektif siyasah dusturiyah, keputusan tersebut sejalan dengan prinsip keadilan (al-‘adalah), kemaslahatan umum (maslahah "ammah), dan amanah kekuasaan. Ini menunjukkan keselarasan antara nilai-nilai politik Islam dan konstitusi kontemporer. Namun demikian, pengaturan turunan yang komprehensif diperlukan untuk memastikan kepastian hukum dan menghindari konflik kepentingan selama pelaksanaannya.
