Abstract

Based on the interpretation in the Qur'an, relatives (al-qurbá) are interpreted flexibly, according to the context of the conversation, both from the side of the mother's and father's relatives. However, traditional interpretations tend to emphasize the paternal family, reflected in the influence of patrilineal Arabic culture. In the contemporary era, the concept of family in anthropology has varied, including maternal or bilateral models. This study analyzes how the meaning of al-qarábah in the Qur'an with the approach of maudhu'i tafsir, tracing its conformity with the contemporary kinship model? The type of qualitative research and interpretive approach is carried out in order to be answered in depth, data collection through library research, so that the data collected is in the form of secondary data obtained from the books of scholarly interpretation. Content analysis is carried out by collecting verses related to the method of tafsir maudhu'i. As a result, the method of tafsir maudhu'i al-qarābah in Islam is divided into three levels: al-qarābah al-qarībah (very close uterine relationship), al-qarābah al-mutawassiṭah (mahram relatives), and al-qarābah al-baʿidah (non-mahram relatives). In the context of the modern family, kinship is understood through the biological dimensions (nasab/DNA), religion (brothers and sisters), and social (neighborly relationships). Fathers and mothers are considered the nucleus of the family in Islam, with mothers having primary responsibility for the upbringing, education, and inheritance of children in the event of a father's death, affirming protection and harmony in Muslim families.

Abstract

This article aims to examine the legal protection for consumers in the sale and purchase of qurban animals provided by Kutaraja Aqiqah as a business actor to its customers (consumers) according to Islamic law. The research method used is qualitative research, namely solving problems by collecting, compiling, analysing, and interpreting the data that has been obtained. The phenomenon that occurs about consumer protection in Kutaraja Aqiqah demands descriptive analysis and answers. This can be fulfilled by describing the conditions and situations, as well as answers related to the problems in the phenomenon. The results of this study conclude that first, the mechanism of buying and selling transactions in kutaraja aqiqah follows the teachings of Islamic law, several types of livestock buying and selling transactions in kutaraja aqiqah such as cash, salam contracts, down payments, and qurban arisan. Second, the form of protection provided by kutaraja aqiqah according to Islamic law is in accordance with sharia which is also beneficial for business actors in attracting the attention and interest of purchasing power of customers

Abstract

Perselisihan adalah proses pertentangan yang diekspresikan di antara dua pihak atau lebih yang saling tergantung mengenai objek perselisihan, menggunakan pola prilaku dan interaksi perselisihan yang menghasilkan perselisihan. Perselisihan juga merupakan kejadian alami dan fenomena manusia yang tidak bias dihindari. Dalam setiap hubungan antara individu akan selalu muncul perselisihan, tak terkecuali hubungan keluarga. Perselisihan dalam keluarga dapat ditimbulkan oleh ketidakpatuhan atau kesalahpahaman antara suami dan istri dalam menjalankan hak dan kewajibannya. Perselisihan yang terjadi di dalam keluarga harus segera diselesaikan secepat mungkin. Di Gampong Rukoh Kecamatan Syiah Kuala terdapat keluarga yang Masing- masing mempunyai model tersendiri untuk menyelesaikan perselisihan dalam rumah tangga. Hal ini yang menarik bagi penulis untuk melakukan penelitian di Gampong Rukoh Kecamatan Syiah Kuala tersebut mengenai bagaimana model penyelesaian perselisihan dalam keluarga oleh tuha peut gampong Rukoh Kecamatan Syiah Kuala.

Abstract

This research discusses the importance of the application of religious rights protection for children based on the perspective of Islamic Law and legislation in Indonesia. Religious rights are human rights that must be guaranteed and protected, especially for children as a vulnerable group. This study examines the norms of Islamic Law that emphasize the need to protect children's religious rights from an early age. The study also analyzes the relevance between Islamic teachings and national legal provisions related to the protection of children's religious rights. This understanding is directed at efforts to prevent potential violations of religious rights that may occur in the context of everyday life. In addition, this study evaluates the effectiveness of existing legal and regulatory mechanisms in Indonesia in providing guarantees and protection of children's religious rights.The research method used includes analysis of legal literature, normative studies, The results of this study are expected to contribute to an in-depth understanding of the implementation of religious rights protection for children in the context of Islamic law and legislation in Indonesia. The implications of the findings of this research can provide a basis for the development of more effective policies in ensuring children's religious rights in the future.

Abstract

This study examines the validity of employment agreements based on verbal agreements from the perspective of ijarah al- ‘amal, a form of employment contract in Islamic law. In the informal sector, employment relationships are often established verbally, based on trust and community customs, even though this raises legal issues regarding the proof and clarity of the parties’ rights and obligations. This study uses a normative juridical method, with a conceptual approach, drawing on a review of classical and contemporary fiqh literature, the Qur’an, hadith, and labour laws and regulations. The results of the study show that Islam permits verbal employment agreements provided the contract meets the following conditions: the existence of the contracting parties, a clear object of work, a known reward, and the willingness of both parties. However, verbal agreements that contain elements of gharar (uncertainty) or zulm (injustice) may render the contract invalid under both moral and legal principles. The hadith of the Prophet Muhammad SAW, which prohibits sales and purchases that contain gharar, emphasises the importance of clarity in every contract. In the contemporary context, although verbal agreements remain valid under the principle of ijarah al-'amal, written records are highly recommended to prevent disputes and protect workers’ rights. Thus, the concept of ijarah al-'amal provides legal legitimacy to verbal agreements and emphasises the importance of justice, trustworthiness, and transparency in modern employment relationships.

Abstract

The commercialisation of public office—commonly described in Indonesia as jual-beli jabatan—converts bureaucratic appointment, promotion, and transfer into exchangeable political-economic assets. This article develops an interdisciplinary socio-legal account of the practice by integrating anti-corruption law, public-administration scholarship, political patronage, evidentiary doctrine, and Islamic criminal jurisprudence. It argues that office-selling is not adequately understood as an episodic bribery offence. Rather, it is a governance mechanism through which electoral costs, patron-client networks, discretionary personnel authority, and rent extraction become mutually reinforcing. The analysis revisits prominent Indonesian cases at ministerial and local-government levels and identifies three recurrent enforcement problems: symbiotic secrecy between giver and recipient, reliance on intermediaries and informal payments, and the incomplete domestication of the United Nations Convention against Corruption concept of trading in influence. It then reads Qurʾān 4:58 and 2:188 through a maqāṣid-oriented framework, particularly the ideas of public trust, justice, protection of wealth, and institutional welfare. The article concludes that a credible response requires simultaneous criminal-law reform, independent merit-system oversight, digital traceability of senior appointments, stronger whistle-blower protection, and a public-ethics framework that treats appointment power as a fiduciary trust rather than a distributable political reward.
