Abstract

Permasalahan tindak pidana kekerasan seksual (TPKS) terjadi hampir di seluruh wilayah Indonesia termasuk di wilayah Kota Kupang, Provinsi Nusa Tenggara Timur (NTT). Korban dan pelaku dalam TPKSpun tidak memandang usia, tidak hanya terjadi pada orang dewasa, melainkan terjadi juga pada anak-anak. UU Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) telah diundangkan sejak Tahun 2022. Namun tidak semua orang dapat memahami dan menyadari dengan baik mengenai pengaturan dalam UU TPKS. Terdapat permasalahan mendasar yang diselesaikan dalam pengabdian ini, yakni: permasalahan maraknya kekerasan seksual yang pelaku ataupun korbannya berasal dari kalangan pelajar dan permasalahan masih banyak siswa-siswi SMK Negeri 6 Kota Kupang yang belum paham dan mempunyai kesadaran hukum tentang UU TPKS. Untuk mengatasi persoalan tersebut maka dilakukan sosialisasi tentang UU TPKS kepada siswa-ssiwi dan guru SMK Negeri 6 Kota Kupang. Tujuan dari kegiatan PKM ini adalah untuk meningkatkan kesadaran hukum dan pemahaman siswa-siswi dan para guru SMK Negeri 6 Kota Kupang terkait pencegahan dan penanganan TPKS yang telah diatur dalam UU TPKS. Kegiatan ini dibagi kedalam 3 sesi, pada sesi pertama terdapat pemaparan materi dari narasumber yakni dosen dari Fakultas Hukum Universitas Katolik Widya Mandira. Materi yang disampaikan yaitu tentang substansi pengaturannya, jenis-jenis TPKS, upaya pencegahan, penanganan, perlindungan, dan pemulihan korban TPKS, akibat hukum/sanksi pidananya, serta peran lembaga pendidikan dalam mendukung pencegahan TPKS. Pada sesi kedua dilaksanakan diskusi dan tanya jawab. Pada sesi ketiga, tim PKM secara khusus bertemu dan memberikan pendampingan kepada para guru khususnya kepada kepala sekolah, wakil kepala sekolah, dan guru BK untuk dapat membentuk Tim Pencegahan dan Penanganan Kekerasan (TPPK) di lingkungan sekolah. Melalui kegiatan ini dapat meningkatkan pemahaman dan kesadaran hukum siswa-siswi SMK Negeri 6 Kota Kupang tentang UU TPKS, serta dapat bermanfaat pula dalam mencegah dan melindungi diri dari terjadinya TPKS di lingkungan sekolah.

Abstract

Village Regulations play an important role in regulating the lives of village communities so that they are more directed, fair, and in accordance with local needs. However, many village governments still experience obstacles in its preparation, especially in terms of legal procedures and community participation. This community service activity was carried out in Sunsea Village with the aim of providing training and technical assistance to village officials, BPD, and community leaders regarding methods of drafting Village Regulations in accordance with laws and regulations. Activities were carried out through a participatory approach with lecture methods, group discussions, and simulations of drafting Perdes. The results of the activity showed an increase in participants' understanding of the formal and technical procedures for drafting Perdes. This activity is expected to improve the quality of village legal products in Sunsea Village.

Abstract

This study aims to discover legal characteristics, namely behavioral norms in pata dela, particularly those related to sustainable forest development and food security. The method used in this study is empirical legal research conducted in Rakalaba Village, West Golewa District, Ngada Regency, East Nusa Tenggara Province. The approaches used in this study are legal sociology, philosophy, legal history, and conceptual approaches. The data used in this study are primary and secondary data.  The data were processed and then analyzed using descriptive qualitative methods. The novelty of this study focuses on the character of legal norms, namely the commands and prohibitions contained in the local wisdom of pata dela. These legal norms serve as guidelines for realizing sustainable forestry development that has an impact on food security. The results of the study show that the Ngadhu bhaga customary law community has an oral tradition called pata dela or ancestral teachings. Pata dela contains primary legal norms, namely commands marked with the word bodha, which means mandatory. In addition, pata dela also contains prohibitions marked with the word ma'e, which means forbidden. Pata dela plays a role in sustainable forest development based on customary law. For example, in the command “Bodha sepe ne'e de kenge, latu ne'e de kabu” and the prohibition “Ma'e rawu dhapi kabu, ma'e sa'a dhapi tara”. Through this oral tradition, the community can ensure that plants continue to grow. Pata dela also has implications for realizing food security for the Ngadhu Bhaga community. It contains commands and prohibitions that reflect an ecological understanding that food crops must be sustained so that they remain available over time. Food security is not only a matter of the availability of food at present, but also a guarantee that future generations will continue to have access to quality food sources. Conclusion of this study is that Pata dela contains primary legal norms that include commands and prohibitions. Pata dela is still alive and is still used as a guideline in sustainable forest development to achieve food security.
