Abstract

The participation of first-time voters in Indonesia's 2024 General Election presents new challenges in the digital era, particularly regarding digital literacy to counter misinformation and hoaxes. This study aims to identify the digital literacy skills of students from the Faculty of Social and Political Sciences (FISIP), University of Bengkulu, in addressing political misinformation. Utilizing a digital ethnographic method with a qualitative approach, data were collected through in-depth interviews, observations, and document analysis involving eight first-time voters aged 17–19 years. The findings reveal that social media platforms such as Instagram, TikTok, and Twitter are the primary sources of political information, despite their vulnerability to hoaxes. Respondents demonstrated basic skills in identifying false information, such as fact-checking through applications and engaging in group discussions. However, they were also exposed to algorithmic echo chambers that amplify information biases. The study concludes that strong digital literacy skills can enhance responsible political participation. Strengthening digital literacy programs is essential to support the integrity of democracy.

Abstract

Jual beli merupakan salah satu cara bagi manusia untuk memperoleh karunia dari Allah SWT, di mana transaksi ini harus dilakukan sesuai dengan ketentuan syariat agar sah dan bebas dari unsur yang dilarang. Penelitian ini mengkaji transaksi jual beli ayam aduan di Kelurahan Malendeng, Kecamatan Paal II, Kota Manado, dalam perspektif hukum ekonomi syariah. Tujuan penelitian adalah untuk menganalisis apakah praktik jual beli ayam aduan sesuai dengan kaidah-kaidah syariah, terutama yang berkaitan dengan perjudian dan kemudharatan. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan jenis penelitian lapangan, dengan teknik pengumpulan data melalui observasi, wawancara, dan dokumentasi. Data primer diperoleh melalui wawancara dengan penjual, pembeli, dan pihak terkait lainnya, sementara data sekunder berupa literatur fiqh muamalah dan hukum ekonomi syariah. Hasil penelitian menunjukkan bahwa meskipun transaksi jual beli ayam aduan dilakukan dengan akad yang sah melalui tawar-menawar antara penjual dan pembeli, praktik ini tetap bertentangan dengan hukum syariah. Hal ini disebabkan oleh adanya unsur perjudian yang terkandung dalam adu ayam, yang dilarang dalam Islam. Meskipun transaksi dilaksanakan secara sah menurut syariah dalam hal akad, hukum ekonomi syariah mengharamkan transaksi ini karena mengandung kemudharatan dan merusak moralitas. Kesimpulannya, transaksi jual beli ayam aduan tidak sesuai dengan prinsip syariah, karena mengandung unsur perjudian yang merugikan moral dan sosial masyarakat.

Abstract

This research investigates marriage laws in Islam, aiming to explore the scientific knowledge of Islamic family law related to the local Sambas culture in marriage practices. The people of Sambas deeply intertwine their regional loyalties with local customary culture, particularly in the context of Muslim weddings. This study addresses whether Islamic marriage laws conflict with local cultural traditions, especially within Indonesia's framework of Islamic family law. The focus of this research examines how the implementation of Islamic marriage laws interacts with or conflicts with the local Sambas culture. The research employs a qualitative methodology that combines fieldwork and literature review. The empirical normative approach is designed to describe data related to contemporary Islamic family law legislation in the context of the local cultural axiology of Sambas, West Kalimantan. This approach systematically examines and explains the facts and characteristics of the subject in detail and depth. The researcher closely ties the research methods to the procedures, techniques, tools, and designs used throughout the study. The primary finding of this research underscores that culture is fundamentally a product of human intellect, comprising patterns, ways of thinking, emotions, and reactions shaped by and expressed through symbols created collectively by the Sambas community. The study identifies significant issues in the current legislative framework, where policymakers often prioritize intellectual subjectivity over human objectivity. As a result, emerging policies fail to address societal needs adequately. In response, the researcher catalogs various forms of local wisdom within Islamic communities in Sambas, proposing these as relevant methodologies for establishing laws that align with local culture.

Abstract

This research examines the implementation of Copyright Law for street musicians in Indonesia, focusing on the intersection between legal protection and cultural practices. The phenomenon of street musicians performing cover songs creates tension between the formal legal framework and the tradition of sharing art in Indonesian culture, as seen in the cases of Tri Suaka and Zinidin Zidan. The research aims to analyze the effectiveness of Law Number 28 of 2014 in addressing copyright infringement while considering cultural practices, and to identify socio-cultural factors that influence legal compliance among street musicians. Using a qualitative approach with socio-legal research design, this study integrates legal analysis and cultural studies through systematic document review and case studies. The findings indicate that the effectiveness of copyright protection is heavily influenced by the complex interrelation between legal requirements and cultural traditions, where current implementation faces challenges in balancing formal compliance with the cultural significance of street performances. This research implies the need for developing a more adaptive legal framework, including special licensing systems and strengthening the role of Collective Management Organizations in supporting legal compliance while preserving culture.
