Abstract

This article examines the relationship between societal development and law in the context of social change influenced by globalization and technological progress. Using classical theories such as Auguste Comte's "Law of Three Stages" and Karl Marx's historical materialism, as well as the legal positivism approach of Jeremy Bentham and Hans Kelsen, this article analyzes how law adapts to contemporary social challenges. Case studies in Indonesia, mass violence in Pati and Bekasi and violence against children in Tangerang. This research uses a normative juridical approach with literature study techniques and qualitative analysis to provide an understanding of the role of law in dealing with social change. The research results show that mass violence, which is often driven by distrust of the formal legal system, can be explained through Durkheim's theory of solidarity and anomie, as well as Marx's perspective on inequality.

Abstract

This study analyzes the methods of Islamic legal reasoning in addressing modern social dynamics, focusing specifically on the application of qiyas, istihsan, maslahah mursalah, and al-urf. The research aims to identify and evaluate the relevance and effectiveness of these methods in providing solutions to contemporary issues. Employing a qualitative approach with descriptive analysis, the study examines various literature and primary sources related to Islamic legal methodology and its application in modern contexts. The findings reveal that these four methods remain highly relevant and can be harmoniously integrated to address modern challenges. Qiyas serves as the primary method closely aligned with the texts, istihsan provides flexibility in specific circumstances, maslahah mursalah considers the common good, and al-urf acknowledges the socio-cultural context of society. The study concludes that the successful implementation of these Islamic legal methods depends on balancing the steadfast principles of sharia with the flexibility needed to navigate social changes.

Abstract

Global developments have impacted the work patterns of State Civil Apparatus (ASN) in Indonesia, thus creating a need for legal protection of ASN rights through labor dispute resolution mechanisms. This study aims to examine the role and authority of the State Administrative Court (PTUN) in resolving labor disputes. Using a normative legal approach and qualitative research methods, this study shows that the PTUN functions as a judicial institution that provides legal protection for special, individual, and final state administrative decisions. However, there are still several practical obstacles, such as overlapping authority with other state administrative institutions, limited understanding of ASN regarding legal procedures, and low compliance with PTUN decisions. To increase the effectiveness of the PTUN in providing justice for ASN, regulatory harmonization, strengthening institutional capacity, and progressive legal interpretation are needed.

Abstract

Islam is a rapidly growing religion in Southeast Asia, spreading through trade, proselytization, marriage, and cultural assimilation. This study aims to examine the history of Islam’s arrival in the region, its development across various ASEAN countries, and the differing conditions faced by Muslims in each nation. Using a qualitative approach through literature review, it was found that Islam first entered Southeast Asia in the 7th century CE via Arab, Persian, and Indian traders. Indonesia, as the initial center for the spread of Islam, became the country with the largest Muslim population in the region, followed by Malaysia and Brunei Darussalam. However, the development of Islam in countries like Thailand, the Philippines, and Myanmar has faced significant challenges due to political conflicts, cultural differences, and discrimination against Muslim minorities. In addition to trade and marriage, methods of proselytization such as education, art, and Sufism also played a crucial role in the process of Islamization. This study highlights the differing social and political dynamics influencing the application of Islamic law and the lives of Muslims in each Southeast Asian country. Consequently, this research provides an in-depth understanding of the history and development of Islam and its role in shaping the region's identity.
