Abstract

This study aimed at describing the background of the birth of the policy on mediation in the Religious of Court and to understand and identify the procedures, barriers and efforts to improve religious court settlement through mediation. The method used is descriptive research method analysis of mediation theory and implementation in the religious court. The study found a number of findings that can give significance to the development of science in the field of procedural law of religious courts, which ishlah theory that can be used as a grand theory to study dispute resolution and mediation triangle theory that can be used as an operational theory (applied theory) in seeing the success of mediation in the judiciary. As for the successful implementation of the policy of mediation can be done with a number of strategies.

Abstract

"Isbat nikah" is the verification of a marriage. Juridically, marriage verification is regulated under the laws such as Law No. 1 of 1974 on Marriage, Law Number 7 of 1989 on Religious Courts, and Law No. 3 of 2006 and Law Number 50 of 2009 on Changes in the Religious Courts Act. The regulations stipulate that marriage verification is allowed for marriage performed before the Law Number 1 of 1974. In practice, marriage verification submitted to the Religious Court is done after the enactment of Law Number 1 of 1974. The acceptance of "marriage verification" by the Religious Court for the marriage taken place after the 1974 Marriage Law was based on the Compilation of Islamic Law (KHI), whereas KHI's legal status is not included in the Indonesian legal order. The essence of marriage verification is a legal determination. This means that a verified marriage remains valid because the marriage that is verified is merely on administrative reason. The position of marriage verification is a part of giving legal protection and legal certainty. The position of the KHI, which regulates in more detail the marriage verification, functions regulatively in the midst of a vacuum of religious judicial law. In addition, the judge may decide whether to grant or deny the application of marriage verification. Thus, it can be concluded that the nature of marriage verification is a part of legal discretion.

Abstract

This study aims to describe the causes of high divorce rates in Muslim families in West Java based on the decisions of the Religious Courts, and this study also aims to formulate a strategy to prevent the increase in divorce rates. This study uses descriptive analysis method with interview techniques, study documents on the decisions of the Religious Courts and literature studies. The results of this study indicate that the highest cause of divorce in the mulism family in West Java is due to economic factors, there is no harmony and no responsibility. Prevention strategies for increasing divorce rates in West Java need to be done systemically from top to bottom, starting from family education before marriage and during conflicts between husband and wife. Thus, it can be concluded that the cause of the high divorce rate in Muslim families in West Java is due to a lack of commitment and knowledge of the essence of marriage, which makes the marital bond in a Muslim family fragile. The strategy to prevent increasing divorce rates is done systemically involving various elements, namely the government, community institutions, and the Religious Courts.

Abstract

The spread of the Corona Virus Disease 2019 (COVID-19) has been declared as a health and economic emergency that has an impact on social life, including Legal Aid Post services at the Indonesian Religious Courts. This study aims to analyze the types, forms, and methods of Legal Aid Post services at the Religious Courts and the level of public access to the Religious Courts during the COVID-19 pandemic. This research uses an empirical juridical method with a qualitative approach. Descriptive and exploratory analysis are carried out to identify Legal Aid Post services at the Religious Courts in providing judicial access to the public. This study also uses purposive sampling before conducting in-depth interviews with several informants. These include Religious Court employees, advocates, and Legal Aid Post officers. The results show that the case registration services at the Legal Aid Post for the Religious Courts have been carried out in various forms, namely online through the E-Court application and manually by visiting the Religious Court. Thus, this study shows that Legal Aid Post services at the Indonesian Religious Courts during the COVID-19 pandemic have been carried out differently in various Religious Courts.   AbstrakPenyebaran COVID-19 telah ditetapkan sebagai darurat kesehatan dan ekonomi yang berdampak pada kehidupan sosial, termasuk pelayanan posko bantuan hukum di Pengadilan Agama. Penelitian ini bertujuan untuk menganalisis jenis, bentuk, dan metode pelayanan Pos Bantuan Hukum di Peradilan Agama serta tingkat akses masyarakat terhadap Peradilan Agama selama periode COVID-19. Penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif. Analisis deskriptif dan eksploratif dilakukan untuk mengidentifikasi layanan Pos Bantuan Hukum di Pengadilan Agama dalam memberikan akses peradilan kepada publik. Penelitian ini juga menggunakan purposive sampling sebelum melakukan wawancara mendalam dengan beberapa informan, termasuk pegawai pengadilan agama, advokat, dan petugas Pos Bantuan Hukum. Hasil penelitian menunjukkan bahwa pelayanan pencatatan perkara di Pos Bantuan Hukum Pengadilan Agama telah dilakukan dalam berbagai bentuk yaitu secara online melalui aplikasi E-Court dan secara manual dengan mengunjungi Pengadilan Agama. Terkait tingkat akses, masyarakat yang mengakses Pengadilan Agama saat pandemi COVID-19 mengalami penurunan. Dengan demikian, penelitian ini menunjukkan bahwa pelayanan Pos Bantuan Hukum di Pengadilan Agama selama periode COVID-19 telah dilakukan secara berbeda di berbagai Pengadilan Agama.

Abstract

This article aims to describe the paradigm of Islamic family law reform against the dynamics of the imposition of divorce through WhatsApp  media, one of the problems often faced in various divorce cases. This paper is classified as a qualitative type, with the approach used being library research. Data analysis was carried out using descriptive-analytical techniques. The results of this article indicate that the adoption of divorce via WhatsApp according to most legal scholars is valid with the qiyas approach as the delivery of divorce through writing in the form of a letter. Meanwhile, in the paradigm of reforming Islamic family law in Indonesia, the imposition of divorce via WhatsApp  is considered invalid, considering that the validity of the divorce is only recognized when it is sworn in before the court. This paradigm is based on various efforts to achieve the benefit, especially to avoid arbitrary actions by the husband against his wife unilaterally in terms of imposing divorce and obtaining legal legality.

Abstract

The integrated marriage isbat is a series of activity which is jointly conducted and coordinated withinparticular time and place between the Religious Court/Court of Law, the Regional Office of CitizenshipService in a city or a district, the sub-district Office of Religious Affairs with its mobile service for givingthe marriage legalization. The integrated marriage isbat is conducted based on the rules of the SupremeCourt, Number 1 in 2015. Even though the legal basis of such integrated marriage isbat is under therules of the Supreme Court, yet the function remains the same that is the regulatory function orregelende functie for the continuity of judicature implementation. The background of the issue of theSupreme Court Rules Number 1 in 2015 is that there are so many numbers of marriages which are notregistered because of the society’s lacking access to the courts. The aim of the integrated marriage isbatis to improve the access toward legal service and to help people, especially those who haves not, inobtaining the rights of marriage certificate, the excerpt of marriage certificate, and the birth certificate assimple, fast, and cheap as possible. Principally, the implementation of the integrated marriage isbat issimilar to the regular one conducted in the court; what make it different are that the place is outside thecourt, free of charge, single judge, and collective vacation. Therefore it can be concluded then that theimplementation of the integrated marriage isbat is to fulfill the rights in obtaining law identity for thosewho haves not as the solution for the law assurance.

Abstract

Sharia economics has two legal basis of sharia economic systems, namely the Qur'an and the Sunnah of the Prophet, the laws taken from the two basic foundations in concept and principle are fixed (cannot change anytime and anywhere). The Purpose of sharia economic law counseling towards residents of Cibiru Wetan Village, Cileunyi District, Bandung Regency are: a) Providing knowledge and insight to extension participants, the residents of Cibiru Wetan Village, Cileunyi District, Bandung Regency related to sharia economic law material and b) Providing knowledge and insight and the skills of the counseling participants about the advantages of sharia economic law.To solve the problems that have been identified and formulated above, the counseling can run as an alternative problem solving is as follows: counseling is done with individual and classical approaches. The classical approach is carried out when giving a theory about sharia economic law and an individual approach is carried out during training. The results of community service, sharia economic law counseling in the community of Cibiru Wetan Village, Cileunyi District, Bandung Regency; 1) The extension of Islamic economic law in the community of Cibiru Wetan Village, Cileunyi District, Bandung Regency has benefited the community. This is evident from the enthusiasm of the community in question and answer and motivated to develop their business creativity. So that this activity needs to be carried out continuously and 2) The forms of activities carried out are intensive counseling with the following stages: Lecture on introducing the importance of sharia economic law; Lecture on sharia economic law theories; Lecture on the development of sharia economic law; Demonstration of the steps to develop and develop sharia economic law; Simulation training on the application of sharia economic law; and evaluation of results

Abstract

Di tengah persaingan seperti sekarang ini, eksistensi pasar tradisional seolah “hidup segan mati pun tak mau”. Stigma negatif, tempatnya becek, kumuh, kotor, semrawut, banyak copet, minim fasilitas hingga ke karakter pedagangnya yang tidak jujur, mengurangi timbangan dan sebagainya. Oleh karena itu tidak sedikit masyarakat tidak peduli dengan keberadaan pasar tradisional ini, hingga banyak dari konsumen beralih ke pasar modern, yang ramah, bersih, aman, nyaman dan seabreg keunggulan lain. Padahal sejatinya pasar tradisional ini adalah urat nadi perekonomian nyata di negeri yang mayoritas Muslim ini. Visi Kabupaten Cianjur, “Cianjur Lebih Maju dan Agamis”. aksentuasi pada gerakan Cianjur Agamis yang terimplementasikan dalam aktiftas perdagangan yaitu direalisasikan pendirian pasar tradisional syariah di Kecamatan Campaka yang disingkat Pasar Syariah Campaka (PSC). Tujuan pengabdian ini: pertama, mendampingi penyusunan naskah akademik mengenai konsep pasar syariah yang langsung diimple¬mentasikan di Pasar Tradisional Syari’ah di Kecamatan Campaka; Kedua, mendampingi para calon pengelola dan pedagang Pasar Rakyat Syari’ah Campaka hingga memahami hak dan kewajibannya sebagai pedagang di PSC. Ketiga Mendampingi Pemerintah Daerah cq. Dinas Koperasi UKM, Perdagangan dan Perindustrian Kabupaten Cianjur dalam mewujudkan Pasar Syariah Campaka sebagai destinasi wisata ekonomi syariah di Kabupaten Cianjur untuk menunjang  wisata ungulan Cianjur situs megalitikum Gunung padang; Metode pengabdian dilakukan dengan metode bimbingan, asistensi, pengarahan, pelatihan  dan kegiatan sejenis lainnya kepada stake holders pasar syari’ah Campaka guna meningkatkan kemampuan dan kepedulian mereka dalam memberikan layanan dan pengelolaan serta pembiasaan sesuai dengan etika bisnis, prinsip-prinsip dan karakteristik  pasar syari’ah yang dikehendaki.Hasil kajian dan pengabdian memperlihatkan, bahwa subjek-subjek yang mesti ada dalam Pasar Syariah Campaka  adalah, 1). Pengelola Pasar, 2) Pedagang; 3). Pembeli; 4) Distributor; 5) Dewan Pengawas Pasar Syari’ah Campaka (DPPSC); 6) Lembaga Keuangan Syari’ah Pendukung Pasar Syar’ah Campaka (LKS-PPSC); 7) Lembaga Penyelesaian Perselisihan Pelaku Pasar Syari’ah Campaka (LPPPPSC/LP4SC). Dengan kriteria-kriteria pasar adalah: Akad-akad (transaksi)  mesti akad syari’ah dengan rukun dan syarat yang terpenuhi, Permodalan Pedagang mesti dari Lembaga keuangan berbasis syari’ah; Jenis dan Barang yang diperdagangkan harus halal; Alat Ukur / Timbangan tidak boleh dikurangi/curang dan harus akuntable; Harga di Pasar Syari’ah Campaka tidak mahal namun berkeadilan; Lingkungan yang bersih, aman dan nyaman (asri suasana islami); serta adanya reward & Funnisment bagi para pedagang di PS Campaka.

Abstract

This study aims to describe the implementation and various obstacles of laboratory activities in junior high schools. The study employed the descriptive quantitative method. The subjects of the study were science teachers in 41 junior high schools representing 4 areas of the Natural Sciences Teachers' Consultative Assembly (MGMP IPA) in Jawa Barat Province. The instrument employed was a questionnaire. The technical analysis of the data was conducted by calculating the average percentage of each answer choice of each statement. This research reveals that 1) the students’ motivation for conducting laboratory activities is high; 2) the implementation of laboratory activities is conducted separately by employing theoretical classroom learning; 3) the source of guidance for laboratory activities is a model of cookbook laboratory; and 4) some obstacles in laboratory activities include insufficient laboratory spaces, less standardized and insufficient number of most equipment, the availability of manuals for laboratory activities, insufficient instructions to use laboratory equipment, and teachers’ difficulties in designing, implementing, and evaluating laboratory activities. It is concluded that in general teachers and students are very enthusiastic about conducting laboratory activities in science learning, but they still have several constraints, especially in the available infrastructures.
