Abstract

This study analyzes the methods of Islamic legal reasoning in addressing modern social dynamics, focusing specifically on the application of qiyas, istihsan, maslahah mursalah, and al-urf. The research aims to identify and evaluate the relevance and effectiveness of these methods in providing solutions to contemporary issues. Employing a qualitative approach with descriptive analysis, the study examines various literature and primary sources related to Islamic legal methodology and its application in modern contexts. The findings reveal that these four methods remain highly relevant and can be harmoniously integrated to address modern challenges. Qiyas serves as the primary method closely aligned with the texts, istihsan provides flexibility in specific circumstances, maslahah mursalah considers the common good, and al-urf acknowledges the socio-cultural context of society. The study concludes that the successful implementation of these Islamic legal methods depends on balancing the steadfast principles of sharia with the flexibility needed to navigate social changes. Penelitian ini menganalisis metode penemuan hukum Islam dalam menghadapi dinamika sosial modern, dengan fokus khusus pada penerapan metode qiyas, istihsan, maslahah mursalah, dan al-urf. Tujuan penelitian ini adalah untuk mengidentifikasi dan menganalisis relevansi serta efektivitas metode-metode tersebut dalam memberikan solusi terhadap problematika kontemporer. Penelitian ini menggunakan pendekatan kualitatif dengan metode analisis deskriptif, mengkaji berbagai literatur dan sumber primer terkait metodologi hukum Islam serta aplikasinya dalam konteks modern. Hasil penelitian menunjukkan bahwa keempat metode tersebut masih sangat relevan dan dapat diintegrasikan secara harmonis dalam merespons tantangan modernitas. Qiyas berperan sebagai metode prioritas yang lebih dekat dengan nash, istihsan memberikan fleksibilitas dalam kondisi khusus, maslahah mursalah mempertimbangkan kemaslahatan umum, serta al-urf memperhatikan konteks sosial budaya masyarakat. Penelitian ini menyimpulkan bahwa keberhasilan implementasi metode-metode penemuan hukum Islam bergantung pada kemampuan untuk menyeimbangkan antara keteguhan prinsip syariah dengan fleksibilitas yang dibutuhkan dalam menghadapi perubahan sosial.

Abstract

This research is motivated by the fact that Islam recognizes the existence of four most prominent schools of thought, namely Hanafi, Maliki, Shafi'i, and Hambali. The scholars and Imams of the madhhab essentially discuss Islamic law. The discussion includes various concepts, including opinions, beliefs, ideologies, doctrines, teachings, understandings, and legal frameworks. Imam Hanafi is one of them, who has a rational style of fiqh and ushul fiqh thinking. This research aims to analyze how the biography and social and intellectual conditions at the time of Imam Abu Hanifah and how the pattern of ijtihad and examples of Imam Abu Hanifah's opinions in Islamic Law. This research uses a normative juridical approach and descriptive analysis method. Data was collected using literature study techniques, and using qualitative data analysis techniques. The results showed that Imam Abu Hanifah was a jurist who lived during the Umayyad and Abbasid dynasties, which were characterized by rapid social and intellectual development. He created the Hanafi school, known as flexible and moderate, which emphasizes the use of reason and ijtihad in determining Islamic law. In addition, the istihsan and urf methods that Imam Abu Hanifah introduced in fiqh allowed for the application of laws that were more in line with local social and cultural contexts. This shows that Imam Abu Hanifah valued and balanced customs and Islamic values.

Abstract

Konflik bersenjata internasional yang terjadi di dunia telah memanfaatkan dan berdampak buruk pada anak. Bukan hanya menjadi korban, tetapi anak juga dimanfaatkan dalam angkatan bersenjata, yang tentu saja melanggar hak asasi manusia. Tujuan dari penelitian ini yakni untuk mengkaji bagaimana perlindungan hukum terhadap anak dalam konflik bersenjata internasional. Metode penelitian dikaji secara yuridis normatif di mana penelitian dilakukan dengan cara meneliti bahan pustaka atau data sekunder yang bersifat hukum. Teknik pengumpulan data yang dilakukan yakni menggunakan teknik studi kepustakaan yang dilakukan dengan cara mengkaji dan menelaah berbagai literatur. Hasil penelitian menemukan bahwa hukum internasional telah menetapkan perlindungan hukum atas anak di tengah konflik bersenjata internasional di antaranya diatur dalam Konvensi Jenewa 1949, Protokol Tambahan I Konvensi Jenewa 1949 tahun 1977, dan Konvensi Hak Anak 1989. Anak yang merupakan bagian dari penduduk sipil harus dilindungi, tidak dilibatkan dan tidak dijadikan sasaran dalam konflik bersenjata internasional. Namun, dalam pelaksanaannya banyak anak yang terlibat serta menjadi korban dalam konflik bersenjata internasional. Hal ini disebabkan karena tidak diperhatikannya prinsip pembedaan antara warga sipil dan kombatan yang dapat menjadi objek sasaran perang. Simpulan dalam penelitian ini yakni Perlindungan hukum terhadap anak merupakan suatu usaha untuk dilaksanakannya hak dan kewajiban anak secara manusiawi. Perlindungan sipil termasuk anak-anak menjelaskan bahwa anak tidak dapat mengambil bagian dalam permusuhan. Anak-anak memiliki hak untuk diberlakukan selayaknya anak serta mendapat perlindungan atas hak-hak nya dalam kondisi konflik bersenjata sekalipun.

Abstract

The treatment of prisoners often still deviates from human rights standards. In fact, prisoners are entitled to the same protection before the law as the general public. The purpose of this study is to examine how Article 7 of the Universal Declaration of Human Rights affects the protection of human rights of prisoners in Correctional Institutions. This study applies a normative juridical approach and a descriptive method of analysis. Data were collected using literature study techniques, as well as using qualitative data analysis techniques. The results of the study show that there are still problems related to the fulfillment of prisoners' rights to equality before the law and non-discriminatory treatment in correctional institutions, making Article 7 of the Universal Declaration of Human Rights relevant to be implemented. Several regulations in Indonesia show that there is a strong legal basis to support the implementation of Article 7 of the declaration. The findings of this study imply the need for optimal enforcement and supervision in fulfilling human rights for prisoners
