Abstract

Indonesia merupakan negara yang memiliki keberagaman budaya dan entitas kemasyarakatan, salah satunya adalah masyarakat hukum adat penganut kepercayaan (selanjutnya disebut MHPAK). Seringkali hak beragama dan hak pilih para penganut MHPAK yang meyakininya tidak terjamin dan terpenuhi secara optimal, khususnya dalam praktik pemilihan umum. Penelitian ini bertujuan untuk mengetahui tentang hubungan antara hak berkeyakinan dan hak pilih dalam konteks “Demokrasi Pancasila” di Indonesia. Untuk mengetahui hal tersebut, makalah ini menggunakan kasus pengalaman yang dialami oleh Masyarakat Adat Penganut Kepercayaan yang kemudian disebut MHAPK. Kasus MHAPK dipilih dengan mempertimbangkan situasi khusus berupa “kekerasan struktural” akibat tidak adanya pengakuan hukum terhadap keberadaan mereka yang menganut kepercayaan setempat. Bahwa terdapat perubahan yang signifikan antara sesudah dan sebelum putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 tentang pemenuhan hak berkeyakinan. Dengan demikian, penelitian ini dilakukan dengan mengkaji administrasi kependudukan sebelum dan sesudah putusan Mahkamah Konstitusi serta dampaknya terhadap pemenuhan hak pilih. Lebih jauh, pembelajaran dari kasus MHAPK juga turut andil dalam memikirkan kembali makna klaim demokrasi Pancasila. Penelitian ini dilakukan dengan mengolah sumber pustaka. Selain itu, wawancara juga dilakukan terutama kepada penyelenggara pemilu. Hasil kajian yang dilakukan menunjukkan adanya keterkaitan antara hak berkeyakinan dan hak memilih. Temuan lainnya adalah adanya perbedaan makna Demokrasi Pancasila.

Abstract

The constitutional rights of citizens are the main rights that should be protected and guaranteed by the state. However, in practice, there are still several violations of the constitutional rights of citizens in Indonesia, for example in the process of making legal products, namely laws and regulations, which do not include participation from citizens and the increasingly narrowing of citizens' right to freedom in expressing their suggestions and input in public. . Seeing the problems above, researchers try to provide recommendations by internalizing adjudicating Constitutional Question and Constitutional Complaint cases as one of the powers of the Constitutional Court. This research is very important as a basis for state officials in guaranteeing the constitutional rights of citizens in the future. This research uses normative legal methods and a statutory approach. The data collection method was carried out using library research. The results of the research found legal facts that the concepts of Constitutional Question and Constitutional Complaint had not yet been adopted as part of the authority of the Constitutional Court and found several dynamics of violations of citizens' constitutional rights. In practice, the Constitutional Court only has the authority to hear and decide cases where the applicant feels disadvantaged by the existence of the law, not by state officials. Researchers recommend synergies in increasing the accessibility of public services for handling Constitutional Court cases online as well as the implementation of adjudicating Constitutional Question and Constitutional Complaint cases in Indonesia.

Abstract

The Indonesian legal system is still confronted with the antinomy between the values of legal certainty and justice. This can be seen from the numerous laws that have been annulled by the Constitutional Court (MK) due to their inconsistency with the constitution. This research aims to analyze the urgency of implementing the concept of Judicial Preview in Indonesia as a solution to the antinomy between the values of legal certainty and justice in the formation of legislation. This research uses a normative legal method and is conducted through conceptual and legal approaches. Through a legal approach, it is intended to analyze the problem of the high number of annulled laws by the Constitutional Court. This research also utilizes secondary data, such as laws. The data collection method is carried out through a literature study process that examines literature materials, such as scientific journals, books, and online websites. The research results indicate that Judicial Preview, as a mechanism for testing laws before enactment, can be a solution to prevent laws that are inconsistent with the constitution. Judicial Preview can provide legal certainty to the public that enacted laws will not violate their constitutional rights. Additionally, Judicial Preview can also help realize legal justice. The implementation of the Judicial Preview concept in Indonesia can be an effective solution to address the antinomy between the values of legal certainty and justice in the formation of legislation. By implementing Judicial Preview, it is hoped that higher quality laws, in line with constitutional values, can be created, providing legal certainty and justice for society.

Abstract

Indonesia as a maritime country faces serious challenges in the problem of overexploitation and declining fish stocks in the management of marine resources in 11 Fisheries Management Areas (WPP). The quota-based Measured Fishing (PIT) policy has not been effective due to conflicts with local fishermen and weak supervision by the Ministry of Marine Affairs and Fisheries (KKP), as evidenced by violations of fishing zones by large and foreign vessels. This normative legal research uses a statutory, conceptual, and comparative approach. The results of the study show challenges in supervision and law enforcement. Several countries have used sophisticated technology and quota systems to manage fishing zones, but Indonesia faces obstacles in supervision. Researchers recommend the implementation of a satellite monitoring system, additional criminal sanctions, strengthening inter-agency coordination, and a customary-based sea closure system to restore fish stocks.
