Abstract

Civil Society Organization (CSO) is an organization founded and formed by the community voluntarily based on the similarity of aspirations, wills, needs, interests and objectives to participate in development in order to achieve the objectives of the Unitary State of the Republic of Indonesia (NKRI). But many established organizations are not based on the common vision and mission required by the government. The emergence of a number of radical organizations that perform anarchist actions make people feel uneasy about the actions of mass organizations that commit acts of violence by using the pretext of religion as a justification reason. The Government in this case has considerable authority in Law No. 17 of 2013 on Civil Society Organizations where the ultimate estuary is the revocation of registered certificate which affects the dissolution of problematic community organizations. With the authority granted to the government, it is suggested that the government should be able to crack down on mass organizations which generate problematic causes and break public orders. Abstract

Menurut Pasal 24C ayat (1) UUD 1945, Mahkamah Konstitusi memiliki wewenang salah satunya menguji konstitusionalitas undang-undang atau judicial review. Akan tetapi, buruknya kualitas legislasi dan intensitas perkara judicial review yang tinggi tidak diimbangi dengan kewenangan Mahkamah Konstitusi yang memadai. Dalam kapasitasnya sebagai negative legislator, Mahkamah Konstitusi Republik Indonesia tidak diperlengkapi dengan wewenang untuk menguji konstitusionalitas rancangan undang-undang atau judicial preview sebagaimana yang ada dalam negara Perancis, Jerman, Austria, Hungaria, dan lain-lain. Diadopsinya kewenangan judicial preview dalam Mahkamah Konstitusi Republik Indonesia merupakan upaya preventif kelemahan-kelemahan dari judicial review. Eksistensinya dapat meminimalisir undang-undang yang berkualitas buruk, meningkatkan perlindungan hak-hak konstitusional warga negara, mengantisipasi undang-undang berumur pendek, mencegah ketidakpastian hukum, meminimalisir penundaan perkara di Mahkamah Agung untuk peraturan perundang-undangan di bawah undang-undang yang memiliki relevansi dengan undang-undang yang sedang diujikan ke Mahkamah Konstitusi, mengantisipasi pembangkangan (constitutional disobedience) Dewan Perwakilan Rakyat sebagai lembaga adressat putusan Mahkamah Konstitusi, serta mengakomodir partisipasi publik. Hasil penelitian menunjukkan urgensi amandemen kelima Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 khususnya Pasal 24C ayat (1), serta perubahan keempat Undang-Undang Mahkamah Konstitusi dan Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan jo Undang-Undang Nomor 15 Tahun 2019 tentang Perubahan Atas Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan.Kata Kunci: Judicial Preview; Constitutional Disobedience; Pengujian Undang-Undang. According to Article 24C paragraph (1) of the 1945 Constitution, the Constitutional Court has the authority of one of them to test the constitutionality of the law or judicial review. However, the poor quality of legislation and the high intensity of judicial review cases are not balanced with adequate constitutional court authority. In its capacity as a negative legislator, the Constitutional Court of the Republic of Indonesia is not equipped with the authority to test the constitutionality of the draft law or judicial preview as it exists in France, Germany, Austria, Hungary, and others. The adoption of judicial preview authority in the Constitutional Court of the Republic of Indonesia is an effort to prevent the weaknesses of judicial review. Its existence can minimize poor quality laws, improve the protection of citizens' constitutional rights, anticipate short-lived laws, prevent legal uncertainty, minimize delays in cases in the Supreme Court for laws that have relevance to the law being tested to the Constitutional Court, anticipating constitutional disobedience the House of Representatives as an institution adressat the decision of the Constitutional Court, as well as accommodating public participation. The results of the study showed the urgency of the fifth amendment of the Constitution of the Republic of Indonesia year 1945 specially for Article 24C paragraph (1), as well as the fourth amendment of the Constitutional Court Law and Law No. 12 of 2011 on the Establishment of Legislation jo Law No. 15 of 2019 on Amendments to Law No. 12 of 2011 on the Establishment of Laws and Regulations jo Law No. 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Establishment of Laws and Regulations.Keywords: Judicial Preview; Constitutional Disobedience; Law Testing.

Abstract

Rumitnya mekanisme dan prosedur dalam pembuatan Surat Izin Mengemudi dimanfaatkan oleh oknum-oknum tidak bertanggung jawab untuk menciptakan profesi “calo”. Aparat yang bertanggung jawab juga turut mendukung praktik ini, mengingat administrasi dalam pembuatan Surat Izin Mengemudi termasuk salah satu Pemasukan Negara Bukan Pajak yang dikejar targetnya. Oleh karna itu, legalitas pengemudi tidak dapat diukur dengan adanya lisensi tersebut jika praktik ini terus berlanjut. Penelitian ini menggunakan metode yuridis normatif, dimana menggunakan pendekatan perundang-undangan dan pendekatakan kasus. Terdapat solusi yang diberikan pemerintah untuk mengatasi adanya praktik calo ini. Salah satu upaya yang dilakukan adalah dengan adanya Satgas Saber Pungli. Namun hal ini masih belum mereduksi secara masif terkait praktik calo dalam pembuatan Surat Izin Mengemudi

Abstract

The constitutional rights of citizens are the main rights that should be protected and guaranteed by the state. However, in practice, there are still several violations of the constitutional rights of citizens in Indonesia, for example in the process of making legal products, namely laws and regulations, which do not include participation from citizens and the increasingly narrowing of citizens' right to freedom in expressing their suggestions and input in public. . Seeing the problems above, researchers try to provide recommendations by internalizing adjudicating Constitutional Question and Constitutional Complaint cases as one of the powers of the Constitutional Court. This research is very important as a basis for state officials in guaranteeing the constitutional rights of citizens in the future. This research uses normative legal methods and a statutory approach. The data collection method was carried out using library research. The results of the research found legal facts that the concepts of Constitutional Question and Constitutional Complaint had not yet been adopted as part of the authority of the Constitutional Court and found several dynamics of violations of citizens' constitutional rights. In practice, the Constitutional Court only has the authority to hear and decide cases where the applicant feels disadvantaged by the existence of the law, not by state officials. Researchers recommend synergies in increasing the accessibility of public services for handling Constitutional Court cases online as well as the implementation of adjudicating Constitutional Question and Constitutional Complaint cases in Indonesia.

Abstract

Indonesia as a state of law in reality often encounters discrepancies between laws and regulations and facts in everyday life, especially related to the guarantee of a decent livelihood. The constitution stipulates that every citizen has been given the right to get a decent job and life solely for respect for human rights. If we look further at the poor, and abandoned children are basically the responsibility of the state to get attention and protection. But the reality is that vagrants and beggars get criminal penalties stipulated in Article 504 and Article 505 of the Criminal Code. This research uses the Normative Juridical research method, which uses a statutory approach and a conceptual approach. This study aims to provide a view related to the fulfillment of the rights of the poor, especially beggars and vagrants. There are several things behind the punishment of beggars and vagrants, one of which is considered to interfere with public interest. This is certainly not in accordance with the conception of the purpose of protecting all and all bloodshed as stated in Article 34 paragraph 1 of the Constitution of the Republic of Indonesia Year 1945, "The poor and abandoned children are cared for by the state". There are regulations issued by the government related to assistance and social security programs, but are not in line with established regulations, such as uneven and inaccurate aid programs distributed to the community.

Abstract

Pancasila menjadi sumber dari segala sumber hukum yang menjadi penuntun hukum. Posisi Pancasila sebagai dasar dan ideologi negara, serta dasar filosofis negara Republik menegaskan bahwa setiap materi muatan peraturan perundang-undangan tidak boleh bertentangan dengan nilai-nilai yang terkandung dalam Pancasila. Berdasarkan Undang-Undang Nomor 12 Tahun 2011 dan Undang-Undang Nomor 15 Tahun 2019 Tentang Perubahan Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-undangan, menentukan bahwa Peraturan Gubernur juga merupakan peraturan perundang-undangan. Peraturan Gubernur Jawa Timur Nomor 4 Tahun 2018 Tentang Perubahan Atas Peraturan Gubernur Jawa Timur Nomor 88 Tahun 2017 Tentang Pedoman Umum Pengelolaan Dana Bergulir Provinsi Jawa Timur adalah kebijakan yang dikeluarkan sebagai dasar pelaksanaan penggunaan anggaran pendapatan dan belanja daerah (APBD) untuk memberikan modal kerja dan investasi kepada masyarakat Jawa Timur agar dapat memenuhi prinsip-prinsip pengelolaan keuangan sesuai ketentuan dan norma yang berlaku. Dana bergulir modal kerja dan investasi Pemerintah Provinsi Jawa Timur disebutkan menjadi penggerak roda perekonomian Jawa Timur. Kebijakan dibidang ekonomi yang diwujudkan dalam bentuk Peraturan Gubernur tidak cukup hanya dinilai atau digunakan sebagai dasar hukum atau legitimasi yang dapat dipertanggungjawabkan terkait pengalokasian penggunaan APBD, namun juga harus dianalisis norma atau substansi Peraturan Gubernur tersebut apakah telah sesuai dengan nilai-nilai Pancasila dan juga asas-asas pembentukan peraturan perundang-undangan sebagimana yang diatur dalam Undang-Undang Nomor 12 Tahun 2011 dan Undang-Undang Nomor 15 Tahun 2019 Tentang Perubahan Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-undangan.

Abstract

Kebebasan berpendapat merupakan hak yang dimiliki oleh setiap manusia sejak dari lahir. Proses mengemukakan pendapat adalah hal yang sangat penting di dalam negara hukum demokratis. Dengan adanya hal tersebut tentunya membuka peluang terjadinya konflik ketertiban, sehingga aparat kepolisian memiliki tugas untuk mengamankan suatu proses mengemukakan pendapat dalam demonstrasi salah satunya yaitu dengan menggunakan gas air mata untuk menangani proses demonstrasi yang anarkis. Namun dengan adanya penggunaan gas air tersebut terjadi proses pengamanan oleh kepolisian yang cenderung berlebihan. Desain kebijakan untuk pengamanan proses mengemukakan pendapat diatur dengan penggunaan kekuatan kepolisian yang terukur, preventif dan layak. Laporan oleh lembaga kredibel seperti Amnesty Internasional dan Tempo menemukan penggunaan kekuatan berlebihan oleh polisi dalam tendensi hingga secara khusus dalam pengamanan proses mengemukakan pendapat. Perancis dan Selandia Baru merupakan dua negara yang memiliki penanganan demonstrasi yang lebih baik. Penelitian ini menggunakan metodologi yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan negara. Dalam penelitian ini ditemukan bahwa Eksistensi Peraturan Kapolri No. 1 Tahun 2009 telah berkesesuaian dengan teori perlindungan hukum yang memiliki visi pengamanan kepolisian yang humanis namun nyawa pengamanan yang humanis tersebut tidak didampingi dengan keterlibatan aktif oleh kelembagaan kepolisian. Penelitian ini juga menemukan bahwa hadirnya mekanisme peradilan dan kode etik profesi polisi untuk anggota kepolisian menyimpang dari prinsip penggunaan kekuatan kepolisian. Peneliti menawarkan beberapa rekomendasi bahwa Perwira polisi harus lebih ketat dalam memberikan persetujuan penggunaan kekuatan kepolisian hingga proses pelaksanaannya. Proses penindakan oknum aparatur polisi sejatinya telah tersedia secara komprehensif. Permasalahan terletak pada ketegasan antar kelembagaan yang bertanggung jawab dalam sistem terkait.
