Abstract

The development of Artificial Intelligence (AI) has had a significant influence on various sectors of life, especially investment, which is marked by the rapid growth of Financial Technology (FinTech). Therefore, the regulatory sandbox program was born as an answer to the high rate of FinTech as a mechanism for testing products before they are marketed. In Indonesia itself, the institutions authorized to regulate regulatory sandboxes are Otoritas Jasa Keuangan (OJK) and Bank Indonesia. By using normative juridical methods, researchers conducted an analysis of statutory regulations, namely regulations of OJK and Bank Indonesia (BI) to obtain study results by looking at the effectiveness of regulations regarding regulatory sandboxes in Indonesia. Researchers attempt to provide a juridical comparison between the two institutional regulations. The data collection method was carried out using the library study method and reviewing various library sources. The results of this research show that the use of regulatory sandboxes is very important in investing in Indonesia. Apart from catching up with other countries, the use of a regulatory sandbox also guarantees the protection of consumer rights so that it can attract interest in investing. Researchers provide recommendations in the form of improving coordination between OJK and companies as well as providing adequate resources to facilitate the optimization of regulatory sandboxes in Indonesia. Apart from that, providing regular outreach to the public is very important to increase their understanding of the regulatory sandbox. The research results note that there are still several shortcomings in the use of regulatory sandboxes, such as the lack of accuracy of test results. With this research, it is hoped that several challenges and obstacles from the previous use of regulatory sandboxes can be evaluated by the authorized institutions.

Abstract

Indonesia merupakan negara yang memiliki keberagaman budaya dan entitas kemasyarakatan, salah satunya adalah masyarakat hukum adat penganut kepercayaan (selanjutnya disebut MHPAK). Seringkali hak beragama dan hak pilih para penganut MHPAK yang meyakininya tidak terjamin dan terpenuhi secara optimal, khususnya dalam praktik pemilihan umum. Penelitian ini bertujuan untuk mengetahui tentang hubungan antara hak berkeyakinan dan hak pilih dalam konteks “Demokrasi Pancasila” di Indonesia. Untuk mengetahui hal tersebut, makalah ini menggunakan kasus pengalaman yang dialami oleh Masyarakat Adat Penganut Kepercayaan yang kemudian disebut MHAPK. Kasus MHAPK dipilih dengan mempertimbangkan situasi khusus berupa “kekerasan struktural” akibat tidak adanya pengakuan hukum terhadap keberadaan mereka yang menganut kepercayaan setempat. Bahwa terdapat perubahan yang signifikan antara sesudah dan sebelum putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 tentang pemenuhan hak berkeyakinan. Dengan demikian, penelitian ini dilakukan dengan mengkaji administrasi kependudukan sebelum dan sesudah putusan Mahkamah Konstitusi serta dampaknya terhadap pemenuhan hak pilih. Lebih jauh, pembelajaran dari kasus MHAPK juga turut andil dalam memikirkan kembali makna klaim demokrasi Pancasila. Penelitian ini dilakukan dengan mengolah sumber pustaka. Selain itu, wawancara juga dilakukan terutama kepada penyelenggara pemilu. Hasil kajian yang dilakukan menunjukkan adanya keterkaitan antara hak berkeyakinan dan hak memilih. Temuan lainnya adalah adanya perbedaan makna Demokrasi Pancasila.

Abstract

The constitutional rights of citizens are the main rights that should be protected and guaranteed by the state. However, in practice, there are still several violations of the constitutional rights of citizens in Indonesia, for example in the process of making legal products, namely laws and regulations, which do not include participation from citizens and the increasingly narrowing of citizens' right to freedom in expressing their suggestions and input in public. . Seeing the problems above, researchers try to provide recommendations by internalizing adjudicating Constitutional Question and Constitutional Complaint cases as one of the powers of the Constitutional Court. This research is very important as a basis for state officials in guaranteeing the constitutional rights of citizens in the future. This research uses normative legal methods and a statutory approach. The data collection method was carried out using library research. The results of the research found legal facts that the concepts of Constitutional Question and Constitutional Complaint had not yet been adopted as part of the authority of the Constitutional Court and found several dynamics of violations of citizens' constitutional rights. In practice, the Constitutional Court only has the authority to hear and decide cases where the applicant feels disadvantaged by the existence of the law, not by state officials. Researchers recommend synergies in increasing the accessibility of public services for handling Constitutional Court cases online as well as the implementation of adjudicating Constitutional Question and Constitutional Complaint cases in Indonesia.

Abstract

The Indonesian legal system is still confronted with the antinomy between the values of legal certainty and justice. This can be seen from the numerous laws that have been annulled by the Constitutional Court (MK) due to their inconsistency with the constitution. This research aims to analyze the urgency of implementing the concept of Judicial Preview in Indonesia as a solution to the antinomy between the values of legal certainty and justice in the formation of legislation. This research uses a normative legal method and is conducted through conceptual and legal approaches. Through a legal approach, it is intended to analyze the problem of the high number of annulled laws by the Constitutional Court. This research also utilizes secondary data, such as laws. The data collection method is carried out through a literature study process that examines literature materials, such as scientific journals, books, and online websites. The research results indicate that Judicial Preview, as a mechanism for testing laws before enactment, can be a solution to prevent laws that are inconsistent with the constitution. Judicial Preview can provide legal certainty to the public that enacted laws will not violate their constitutional rights. Additionally, Judicial Preview can also help realize legal justice. The implementation of the Judicial Preview concept in Indonesia can be an effective solution to address the antinomy between the values of legal certainty and justice in the formation of legislation. By implementing Judicial Preview, it is hoped that higher quality laws, in line with constitutional values, can be created, providing legal certainty and justice for society.

Abstract

Human Rights regulation has been implemented in several positive laws of international countries, including Indonesia. All citizens are entitled to equal rights and status through human rights, and the state, including indigenous peoples, must guarantee their fulfillment. The guarantee of protection for the rights of indigenous peoples has been regulated by law. However, its implementation has not been fully realized. This statement is evidenced by findings of field conflict records and instances of judicial harassment between indigenous communities and environmental management companies. The government subsequently introduced the Anti-SLAPP policy to allow vulnerable groups to present proposals, criticisms, and ideas in their fight for social justice and fulfilling their environmental rights. Addressing these issues, this research aims to analyze the relationship between the fulfillment of indigenous peoples' rights to the environment and instances of judicial harassment, evaluate the conceptualization of Anti-SLAPP principles within Indonesia's positive legal framework, and examine the implementation of Anti-SLAPP principles in various international countries. This normative juridical study is conducted using legislative, conceptual, and comparative approaches, and it utilizes secondary data from primary and secondary legal materials to analyze legal issues related to anti-SLAPP. Through various legal approaches and theories, the findings of this research reveal several weaknesses in Indonesia's Anti-SLAPP policy. The researcher provides recommendations, including a comprehensive study on the need for a specific Anti-SLAPP law and the necessity for law enforcement officers to prioritize persuasive and non-repressive efforts, ensuring transparency in the environmental management permitting process.

Abstract

Indonesia as a maritime country faces serious challenges in the problem of overexploitation and declining fish stocks in the management of marine resources in 11 Fisheries Management Areas (WPP). The quota-based Measured Fishing (PIT) policy has not been effective due to conflicts with local fishermen and weak supervision by the Ministry of Marine Affairs and Fisheries (KKP), as evidenced by violations of fishing zones by large and foreign vessels. This normative legal research uses a statutory, conceptual, and comparative approach. The results of the study show challenges in supervision and law enforcement. Several countries have used sophisticated technology and quota systems to manage fishing zones, but Indonesia faces obstacles in supervision. Researchers recommend the implementation of a satellite monitoring system, additional criminal sanctions, strengthening inter-agency coordination, and a customary-based sea closure system to restore fish stocks.

Abstract

Fenomena brain drain di Indonesia semakin meningkat seiring dengan tren migrasi tenaga kerja dan profesional ke luar negeri. Salah satu penyebab utama adalah keterbatasan kebijakan kewarganegaraan yang hanya mengakui kewarganegaraan tunggal, sehingga banyak diaspora Indonesia harus memilih untuk melepas status WNI mereka demi memperoleh peluang yang lebih baik di luar negeri. Penelitian ini bertujuan untuk menganalisis urgensi penerapan kebijakan dwi kewarganegaraan bagi diaspora Indonesia sebagai upaya mitigasi brain drain dan optimalisasi peran mereka dalam pembangunan nasional. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, historis, dan perbandingan. Data diperoleh melalui studi kepustakaan dengan bahan hukum primer berupa peraturan perundang-undangan terkait kewarganegaraan, serta bahan hukum sekunder berupa jurnal, buku, dan artikel ilmiah. Teknik analisis data dilakukan secara deskriptif-analitis dengan menelaah kesenjangan hukum serta membandingkan kebijakan kewarganegaraan di berbagai negara. Hasil penelitian menunjukkan bahwa banyak negara, seperti India dan Inggris, telah menerapkan kebijakan dwi kewarganegaraan untuk mempertahankan hubungan dengan diaspora mereka, yang berdampak positif pada ekonomi dan pembangunan nasional. Penelitian ini mengusulkan model dwi kewarganegaraan terbatas melalui skema Kartu Diaspora Indonesia (KDI) yang memungkinkan diaspora tetap memiliki keterikatan hukum dan ekonomi tanpa kehilangan status WNI mereka. Melalui reformasi kebijakan di dalam penelitian ini diharapkan dapat mengurangi brain drain serta mengoptimalkan potensi diaspora sebagai aset strategis bangsa.

Abstract

Garahan Village, located in Silo District, Jember Regency, is known for its community-based coffee production. However, the local farmers continue to face significant challenges in marketing their coffee products beyond the village level. The lack of knowledge and skills in digital marketing strategies has resulted in limited market access and low product competitiveness. This community service program was designed to address these challenges by enhancing the marketing capabilities of local coffee farmers through the conceptualization and implementation of a digital marketing model. The ultimate goal is to support sustainable food security by strengthening the economic resilience of coffee farmers. The activities in this program involved a series of stages, including preliminary surveys to identify key problems, direct observations, educational outreach on the importance of digital marketing, hands-on training in social media utilization and online marketplace platforms, and continuous monitoring and evaluation of the implementation process. The main partners of this initiative were members of the local coffee farmer group in Garahan Village. The results of the program indicate a significant improvement in the partners’ understanding and application of digital marketing tools. Prior to the intervention, only 10% of participants were familiar with digital marketing; this figure rose to 85% after the training sessions. Moreover, digital-based coffee sales increased by 40% within three months following the intervention. These outcomes demonstrate the effectiveness of the community engagement approach in addressing local agricultural marketing issues. Key outputs of the program include the establishment of social media accounts and online storefronts for coffee products, increased farmer capacity in managing digital promotion, and the production of a simple digital marketing guidebook for sustainable use.

Abstract

The emergence of artificial intelligence has disrupted conventional legal assumptions about identity, subjectivity, and criminal responsibility. This study investigated the normative and systemic inadequacies of Indonesia’s legal system in responding to transhumanistic cybercrime, particularly involving the manipulation of digital identities. Employing a normative juridical method and incorporating statutory, conceptual, and comparative approaches, this study critically analyzes structural, substantive, and cultural inertia within the legal framework. Drawing on Lawrence Friedman’s legal system theory and post-human criminology, this study identifies a deep ontological crisis wherein non-human actors and synthetic identities remain legally unrecognized. A comparative analysis of the European Union, the United States, Estonia, and Japan illustrates the varying degrees of legal adaptation, from algorithmic accountability to digital identity sovereignty. The findings reveal that Indonesia lacks a coherent legal regime to address algorithm-driven harm or recognize digital identity as an autonomous legal subject. The study proposes legal reforms that include establishing a dedicated legal framework for digital identity protection, extending criminal liability to autonomous systems, and integrating post-human perspectives into legal education. In the age of algorithmic governance, law must transcend biological essentialism to remain legitimate, responsive, and just.

Abstract

This study investigates the institutionalization of political exclusion and electoral disenfranchisement in India and Israel, two states that claim adherence to democratic norms while systematically excluding specific populations from political participation. Drawing on a normative legal approach, this paper analyzes how domestic legislation, particularly India's Citizenship Amendment Act (CAA) and National Register of Citizens (NRC), as well as Israel's Nation-State Law, creates legal frameworks that contradict international human rights standards. Using statute, conceptual, and comparative approaches, the research evaluates the extent to which these legal instruments undermine the principles of universal suffrage and non-discrimination as outlined in the ICCPR and UDHR. The findings reveal that both states employ legalistic mechanisms, whether through administrative verification processes or territorial segmentation, to disenfranchise ethnic and religious minorities under the guise of lawful governance. This practice not only erodes the integrity of electoral democracy but also highlights a legitimacy gap between national legal systems and international normative expectations. The study emphasizes the urgency of confronting “authoritarian legalism” in democratic regimes, which often escape international accountability. Although limited by its reliance on secondary data and absence of empirical fieldwork, this paper contributes to the global discourse on electoral justice by exposing how law can be weaponized to suppress political inclusion. Future research should explore the lived impacts of disenfranchisement and assess how international bodies can strengthen enforcement of electoral rights. Ultimately, genuine democracy cannot exist where the right to vote is selectively granted, and legal systems are used to sustain structural exclusion.
