Abstract

The purpose of this research is to analyze the role of power as the basis of legal legitimacy in legal philosophy thought, as well as to examine the relationship between power and public acceptance of the law, including the ethical limits of the use of power in upholding legitimate and just laws. This research uses a qualitative approach with a literature review method, analyzing various legal philosophy thoughts from figures such as Thomas Hobbes, Max Weber, John Locke, and Immanuel Kant. The study focuses on how power becomes the main instrument that legitimizes law and ensures obedience and order in society. The results show that legitimate power recognized by society is a key element in legal legitimacy. Hobbes' thought underscores that without power, law has no power to compel compliance, while Locke emphasizes the importance of societal consent to the use of power. Weber added that power based on legality has the highest stability because it is based on rational rules. In terms of ethical limits, legal philosophy emphasizes that power should not be used arbitrarily and should be aligned with the principles of justice, human rights, and transparency. Thus, law can only function effectively and fairly if the power used to enforce it is governed by strong ethical norms and social justice.

Abstract

This study aims to analyze the form of legal politics that underlies the regulation of patient hospitalization in the social security system in Indonesia, as well as the extent to which the regulation reflects the principle of social justice for all citizens. The approach used is normative juridical with descriptive-qualitative research type, which examines legal norms through literature study and analyzed based on the theory of legal politics and social justice. Data were obtained from primary legal sources such as relevant laws and regulations, as well as secondary sources in the form of scientific literature, journals, and policy documents. The results show that the regulation of patient hospitalization in Law Number 40 of 2004 concerning the National Social Security System and its derivative regulations reflects the state's efforts to ensure equal access to health services for the entire population, regardless of economic status. The solidarity-based and non-profit social security system makes hospitalization services the right of every participant, including the poor and vulnerable groups. However, implementation in the field still faces challenges in the form of limited facilities, imbalances in services between regions, and gaps in service quality between treatment classes. The Standard Inpatient Class Scheme (KRIS) that is being developed is a corrective step to realize more equitable services and reduce inequality between participants. The political law in this arrangement shows that the state does not only regulate normatively, but also seeks to realize the principle of social justice substantively through inclusive health service policies

Abstract

The advancement of digital technology has transformed medical record systems from conventional formats to Electronic Medical Records (EMRs). While EMRs enhance healthcare service efficiency, they also introduce challenges concerning the protection of patients’ personal data. Privacy issues have become increasingly critical and require examination from a human rights perspective, particularly the right to privacy and personal data protection. This study employs a normative qualitative method focusing on legal frameworks, human rights principles, and relevant regulations. Data were collected through literature reviews of national laws, international human rights conventions, academic journals, and official documents. A descriptive-qualitative analysis was used to construct a systematic and logical scientific argument. Findings show that patient data protection in EMRs is regulated under the Personal Data Protection Law and Ministry of Health regulations, emphasizing confidentiality, data integrity, and security in accordance with human rights standards. However, practical implementation faces several challenges, including inadequate technological infrastructure, low awareness among healthcare personnel, and weak oversight and law enforcement. These gaps result in a high risk of data breaches, driven by technical vulnerabilities, human error, misuse of access by internal staff, and the absence of effective monitoring systems. Although patients' rights to access and correct their data are legally acknowledged, consistent implementation across healthcare facilities remains limited.

Abstract

This study aims to analyze the implementation of food waste management at EMC Alam Sutera Hospital, assess its impact on the environment and hospital operations, and identify strategies for utilizing it to increase economic value. The approach used is qualitative with descriptive research type. Data were collected through interviews, observations, and documentation, then analyzed using data reduction, data presentation, and conclusion drawing. The results showed that food waste management at EMC Alam Sutera Hospital is carried out through sorting organic waste, processing it into compost, and distributing the processed products for use in the hospital area or for sale to the surrounding community. This strategy has a positive impact on the environment by reducing the volume of waste disposed to landfills and increasing operational efficiency through reduced waste disposal costs. In addition, the utilization of food waste as compost provides economic opportunities for the hospital by making it an additional source of income while supporting the circular economy principle.

Abstract

This research aims to develop an online medical dispute resolution model in hospitals to create fairness for patients and medical personnel. The method used is a qualitative study with a descriptive analysis approach, collecting data through observation, interviews, and literature studies on the mechanism of medical dispute resolution and the application of digital technology in the process. The focus of the research is focused on how online systems can provide transparent, efficient, and easily accessible access for all relevant parties. The results of the study show that the use of an online medical dispute resolution model is able to increase the effectiveness and efficiency in handling dispute problems in hospitals. This technology-based process not only speeds up communication and decision-making, but also reduces administrative burdens and reduces the potential for prolonged conflicts. The model allows for neater and more transparent documentation, helping to maintain accountability and integrity of the settlement process. In addition, the implementation of the online system can increase patient and medical satisfaction because case resolution becomes faster and communication is more open, creating a greater sense of justice in health services.
