Abstract

Gigi merupakan satu diantara bagian fisik manusia yang dianggap mempengaruhi penampilan. Perawatan gigi dilakukan untuk menambah kepercayaan diri, termasuk gigi estetik. Namun, pelayanan kedokteran gigi estetik yang dilakukan oleh dokter seringkali tidak memuaskan pasien. Jenis penelitian yangi digunakani di dalam penelitian ini adalah yuridis normatif dengan pendekatan perundangi-iundangan (statute approach) dan pendekatan konsep (conceptual approach). Sedangkan analisis bersifat yuridis kualitatif. Penelitian menunjukkan hasil: (1) Pasien yang tidak puas sering mencari penyelesaian melalui proses hukum. Pentingnya penyelesaian yang adil dan transparan melalui mediasi atau regulasi hukum yang efektif. (2) Diperlukan langkah-langkah yang mempertimbangkan hak-hak pasien dan menjaga integritas profesi. Idealnya pengaturan hukum terhadap pelayanan kedokteran gigi estetik yang dilakukan oleh dokter harus mendukung kepercayaan dan menghormati hak-hak pasien yang memberikan kepastian pelayanan kedokteran gigi estetik memberikan hasil yang berkualitas.

Abstract

Light crimes have been regulated in a limited manner in Indonesia in the Criminal Code (KUHP). The category includes violations that carry a maximum penalty of imprisonment of three months or a fine. However, minor crimes related to wealth are experiencing problems, along with the implementation of restorative justice. Therefore, there are 2 problems in this article, namely: (1) What is the deliberation model at the Sector Police Headquarters in resolving minor crimes related to assets based on restorative justice? (2) How do Sector Police members supervise the implementation of the parties' agreement to encourage the achievement of the goals of restorative justice? This legal research method is empirical with a criminological juridical approach. Research results: (1) The deliberation model at the Sector Police Headquarters in resolving minor crimes related to wealth is based on restorative justice using a deliberation model between the perpetrator and the victim with the principle of kinship. (2) How members of the Sector Police carry out supervision over the implementation of the agreement between the parties in order to encourage the achievement of the goals of equitable restorative justice. Investigators carry out investigations and act as mediators in the context of monitoring and implementing agreements between the parties that encourage the achievement of restorative justice. Abstract

Penelitian ini bertujuan untuk mengkaji secara yuridis dan etik pelimpahan wewenang antar profesi kesehatan di fasilitas pelayanan kesehatan di Indonesia. Metode yang digunakan adalah yuridis normatif dengan teknik pengumpulan data melalui studi kepustakaan dan telaah dokumen hukum yang relevan. Analisis data dilakukan secara kualitatif melalui tahapan reduksi data, penyajian data, dan penarikan kesimpulan guna memperoleh pemahaman mendalam mengenai kesesuaian praktik pelimpahan wewenang dengan norma hukum dan prinsip etik profesi kesehatan. Hasil penelitian menunjukkan bahwa praktik pelimpahan wewenang antar profesi kesehatan di lapangan masih mengalami ketidaksesuaian signifikan dengan ketentuan hukum yang berlaku dan prinsip etik profesi. Pelimpahan sering kali dilakukan tanpa kepastian tertulis, pengawasan yang kurang optimal, serta penerima pelimpahan yang belum sepenuhnya memenuhi kompetensi yang dipersyaratkan. Ketidakjelasan pembagian tanggung jawab hukum menimbulkan dilema etis dan risiko hukum bagi tenaga kesehatan, sementara kurangnya pedoman teknis yang rinci memperbesar potensi pelanggaran etik dan hukum. Pelanggaran yang muncul meliputi pelimpahan kewenangan yang tidak tepat, overdelegation, penyalahgunaan kewenangan, serta komunikasi dan koordinasi yang buruk antarprofesi, yang secara keseluruhan dapat mengancam keselamatan pasien dan mutu pelayanan kesehatan.

Abstract

The advancement of digital technology has transformed medical record systems from conventional formats to Electronic Medical Records (EMRs). While EMRs enhance healthcare service efficiency, they also introduce challenges concerning the protection of patients’ personal data. Privacy issues have become increasingly critical and require examination from a human rights perspective, particularly the right to privacy and personal data protection. This study employs a normative qualitative method focusing on legal frameworks, human rights principles, and relevant regulations. Data were collected through literature reviews of national laws, international human rights conventions, academic journals, and official documents. A descriptive-qualitative analysis was used to construct a systematic and logical scientific argument. Findings show that patient data protection in EMRs is regulated under the Personal Data Protection Law and Ministry of Health regulations, emphasizing confidentiality, data integrity, and security in accordance with human rights standards. However, practical implementation faces several challenges, including inadequate technological infrastructure, low awareness among healthcare personnel, and weak oversight and law enforcement. These gaps result in a high risk of data breaches, driven by technical vulnerabilities, human error, misuse of access by internal staff, and the absence of effective monitoring systems. Although patients' rights to access and correct their data are legally acknowledged, consistent implementation across healthcare facilities remains limited.

Abstract

This study aims to identify the factors that cause parents to refuse Diphtheria Tetanus immunization for children's health at the Talang Bakung Health Center, Jambi City, and analyze the legal strategies implemented by the Jambi City Regional Government in overcoming these rejections. The research method used is empirical legal research with a qualitative approach. Data was collected through interviews, observations, and documentation of related parties such as health workers, parents, and local government officials. Data analysis was carried out in a descriptive analytical manner by relating relevant field findings and legal theories. The results of the study showed that immunization refusal by parents was caused by several factors, including concerns about Post-Immunization Adverse Events (AEFIs), lack of understanding of vaccine benefits, the influence of misinformation on social media, and low trust in health workers. Social, cultural, and religious factors also contribute to strengthening resistance to immunization programs. The Jambi City Regional Government implements a persuasive and educational legal strategy by emphasizing increasing public health literacy through integrated socialization, the involvement of religious and community leaders, and the affirmation of legal policies based on Law Number 17 of 2023 concerning Health and Government Regulation Number 28 of 2024. In addition, the Regional Government strengthens legal protection for health workers and regulates the mechanism for handling AEFIs in a transparent manner to foster public trust. This legal strategy has proven effective in reducing immunization refusal rates and increasing community participation, although ongoing efforts are still needed to strengthen legal awareness and overall public health.

Abstract

The presidential threshold in Indonesia, requiring political parties or coalitions to secure at least 20% of parliamentary seats or 25% of valid votes to nominate presidential candidates, has long sparked debate over the constitution. Critics contend that this requirement operates as a structural barrier that limits citizens' political rights and consolidates oligarchic dominance. This study examines the abolition of the presidential threshold following the Constitutional Court's Decision No. 62/PUU-XXII/2024, which annulled Article 222 of the 2017 Election Law. Employing a normative juridical and comparative approach, the research analyzes constitutional principles, judicial reasoning, and electoral practices in selected democracies, including France and the United States. The analysis demonstrates that removing the presidential threshold broadens political participation, enhances inclusivity, and fosters fairer democratic competition by reducing the dominance of major parties. Although the absence of a threshold may increase the number of candidates and the likelihood of run-off elections, such consequences can be mitigated through appropriate institutional design. Normatively, this study concludes that abolishing the presidential threshold is constitutionally justified and necessary to fully realize citizens' political rights and democratic sovereignty in Indonesia.

Abstract

Background The transformation of medical-legal relationships from a paternalistic to a contractual model in Indonesia has triggered complex disputes that conventional, legalistic mechanisms often fail to resolve fairly. While Law No. 17 of 2023 mandates non-litigation resolution, the current mediation framework remains trapped in a state-centric paradigm that marginalizes professional ethics and social norms. Research Gap A critical research gap exists in the prevailing legal monism approach, which creates a "justice gap" by failing to synchronize the disciplinary reviews of Article 308 with criminal judicial processes, thereby leaving healthcare workers vulnerable to criminalization and patients without substantive restoration. Method This study employs a normative-prescriptive research method with a qualitative-synthetic conceptual development design to reconstruct the mediation function. Findings The findings introduce a "Hybrid Mediator Panel" and a "Multi-Layered Screening" mechanism as a functional reconfiguration of Article 310 of Law No. 17 of 2023. This model integrates state law, professional ethics (deontological), and living law (deliberation) into a single convergent system to ensure that settlement agreements are not only legally enforceable but also sociologically valid. Contribution This study provides a strategic blueprint for the Indonesian government to implement restorative justice in health law, ensuring legal certainty for medical professionals while simultaneously achieving holistic justice and therapeutic recovery for patients.

Abstract

The transformation of medical dispute resolution in Indonesia reveals a critical paradox: while Law No. 17 of 2023 on Health mandates non-litigation mechanisms, the existing framework remains entrapped within a state-centric legal paradigm that systematically marginalizes customary institutions which have long served as accessible, socially legitimate, and restoratively-oriented dispute forums across diverse Indonesian communities. A fundamental research gap persists in the prevailing legal monism approach, which creates a normative vacuum by failing to recognize customary institutions operationally within health law, thereby forcing communities to choose between legally certain but inaccessible formal mechanisms and socially accepted but legally uncertain customary processes — a justice gap that disproportionately burdens economically vulnerable populations. This study employs a normative-prescriptive legal methodology integrating legislative, conceptual, and comparative approaches to reconstruct the positional framework of customary institutions within medical dispute resolution. The findings reveal that customary institutions hold strong constitutional legitimacy under Article 18B(2) of the 1945 Constitution yet operate within a normative vacuum in the medical domain, and introduce a Two-Tier Integrative Model positioning customary institutions as relational mediation forums at the first tier and MKDKI as technical verifier at the second tier, connected through a court homologation mechanism. This study provides a strategic normative blueprint recommending explicit revision of Law No. 17 of 2023 to accommodate customary institutions within the national medical dispute resolution system.

Abstract

Adverse events pose a serious threat to patient safety in hospitals. Data from RSUD Dr. Soeroto Ngawi reveal fluctuations in medical incident cases over 2021–2024 (n=354), with procedural and medication errors dominating patient safety reports. A critical research gap persists regarding inconsistent SOP implementation and a blame culture that suppresses transparent incident reporting — gaps unaddressed through an integrated legal-empirical lens. This study aims to analyze forms of nursing negligence, construct a legal accountability framework, and identify barriers and resolution efforts at a regional public hospital. An empirical legal approach was employed, combining case-based and statutory analysis. Data were collected through in-depth interviews with eight key informants, observation, and document review, then analyzed using descriptive qualitative methods with legal triangulation. Results indicate that nursing negligence primarily occurs in patient identification and clinical communication during handover. Nurses' accountability is manifested through immediate clinical responses, IKP system reporting, and root-cause investigations under Law No. 17 of 2023 on Health. Accountability nonetheless remains hindered by psychological barriers and structural workload imbalances. The scientific contribution of this study is the Dual-Layer Accountability Model, which proportionately assigns legal liability between individual professional conduct and institutional systemic failures — a framework absent from prior Indonesian health law scholarship. It is recommended that hospital management adopt a non-punitive just culture, digitize incident reporting, and strengthen clinical risk management training to ensure legal certainty for nurses while advancing patient safety.
