Abstract

Indonesian Ulema Council (MUI) in 2009 declared that smoking is ḥarām for women, and children, or when held in public places. However, these practices still happen now. It triggers researchers to explore; how the wider social environment regulates the process of internalization and normalization of smoking among Muslim women and the uninvited norms that are religious and social; how religion, gender, and socio-cultural relations shape the attitudes and behavior of Muslim women smoking, and; how social jurisprudence views those problems. This study uses a qualitative approach, which includes observation, interviews, and a literature review with descriptive analysis that considers the principles of social jurisprudence in socio-religious relations. Conducted with an interpretive qualitative paradigm and from a phenomenological epistemology, the study employs the habitus theory by Pierre Bourdieu as well as agency, piety, and embodiment by Eva F. Nisa to explore the intersectionality of faith, culture, and individual agency. Five Muslim women interviewed from five different provinces of Indonesia show how religious ideals clash with gender norms and modernity. The study indicates that familial factors, peers, and media socialization overshadow religious prohibitions against smoking. People adjust religious teachings to specific situations in the way they want since they do not wish the fatwa to control their lives. The café bar is a counter space where women perform defiance and assert ethnic otherness while adhering to patriarchal and religious expectations. Tobacco advertising, in particular, relates views of smoking to economic factors that also contribute to the associated stereotypes of modernity and freedom.

Abstract

A hidden defective product in an online buying and selling transaction is selling a product whose condition is not in accordance with the original purpose of making the product. The product does not meet the proper product standards and has decreased function due to damage caused by the negligence of business actors, whether intentional or not. The most widely used platform in online buying and selling is personal media or social media, where there are only two parties to the trade agreement, namely business actors and consumers, so legal protection for consumers in this phenomenon is absolute and very much needed. The existence of a form of consumer loss from the case of hidden defective products certainly violates what is the provision of muamalah in sharia. Therefore, this research aims to analyze the application of Islamic business ethics to hidden defective products in online trade transactions and legal protection efforts that can be provided to consumers who suffer losses due to hidden defective products. This research uses the normative juridical analysis method to see the extent of legal protection efforts against consumers and how Islamic business ethics view the phenomenon. This study concludes that business actors who deliberately sell hidden products in online buying and selling clearly violate Islamic business ethics which prohibit hiding defective goods, unlike business actors who do not know the defects in the product, but business actors still have an absolute obligation to be responsible to consumers. The form of legal protection efforts for consumers of hidden defective products has been regulated in such a way in Law Number 8 of 1999 concerning Consumer Protection and the Civil Code.   [Produk cacat tersembunyi dalam transaksi jual beli online adalah menjual produk yang kondisinya tidak sesuai dengan tujuan awal pembuatan produk. Produk tersebut tidak memenuhi standar produk yang semestinya dan mengalami penurunan fungsi akibat kerusakan yang disebabkan oleh kelalaian pelaku usaha, baik disengaja maupun tidak. Platform yang paling banyak digunakan dalam jual beli online adalah media personal atau sosial media, yang mana hanya terdapat dua pihak yang melakukan perjanjian perdagangan yaitu pelaku usaha dan konsumen, maka perlindungan hukum terhadap konsumen dalam fenomena ini bersifat mutlak dan sangat dibutuhkan. Adanya bentuk kerugian konsumen dari kasus produk cacat tersembunyi tentu saja melanggar apa yang menjadi ketentuan bermuamalah dalam syariat. Oleh karena itu, penelitian ini bertujuan untuk melakukan analisis terhadap penerapan etika bisnis Islam terhadap produk cacat tersembunyi dalam transaksi perdagangan secara online dan upaya perlindungan hukum yang dapat diberikan kepada konsumen yang mengalami kerugian akibat produk cacat tersembunyi. Penelitian ini menggunakan metode analisis yuridis normatif untuk melihat sejauh mana upaya perlindungan hukum terhadap konsumen dan bagaimana pandangan etika bisnis Islam terhadap fenomena tersebut. Penelitian ini menyimpulkan bahwa pelaku usaha yang sengaja menjual produk tersembunyi dalam jual beli online jelas melanggar etika bisnis Islam yang melarang untuk menyembunyikan barang cacat, berbeda halnya dengan pelaku usaha yang tidak mengetahui adanya cacat pada produk tersebut, namun pelaku usaha tetap memikul kewajiban mutlak untuk bertanggungjawab kepada konsumen. Abstract

There is one important component that raises doubts for capital owners who will invest in Islamic mutual funds, namely the use of conventional banks as custodian banks. The purpose of this study is to find out how sharia economic law reviews conventional banks as custodian banks. This study uses a qualitative method with a literature study approach. Data is obtained from interviewing several potential investors, various regulations related to Islamic mutual funds and custodian banks, as well as literature that reviews the principles of muamalah. It was found that conventional banks that become custodian banks must obtain an application from the Financial Services Authority. To ensure the sharia of this business activity, a cleaning process is set up to remove non-halal elements in the form of interest and other non-sharia risks that may come from the activities of related companies. The reluctance to become an investor is caused by the lack of knowledge about the mechanism of Islamic mutual funds for which literacy is needed. However, there are some potential investors who consistently want the bank used is an Islamic bank. Regulations are needed that require the use of Islamic banks as the only custodian bank, but it must be done carefully and gradually according to the readiness of the Islamic bank in question.

Abstract

Yurisdiksi utama BASYARNAS sebagai lembaga penyelesaian sengketa ekonomi syariah di luar pengadilan adalah menyelesaikan secara adil dan cepat sengketa muamalat/perdata yang timbul di bidang perdagangan, keuangan, hukum, perindustrian, jasa yang diselenggarakan berdasarkan prinsip syariah. Ditegaskan dalam Pasal 60 Undang-Undang nomor 30 tahun 1999 bahwa putusan arbitrase bersifat final dan mempunyai kekuatan hukum tetap serta mengikat para pihak. Dalam kenyataan, para pihak masih merasa tidak puas dengan putusan BASYARNAS yang diharapkan dapat mencapai win-win solution yang selama ini dianggap win-lose solution. Putusan BASYARNAS yang bersifat final dan mengikat pada kenyataanya masih terkesan diabaikan. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi pustaka kemudian dianalisis dengan teori efektivitas hukum. Hasil penelitian menemukan bahwa penyelesaian sengketa ekonomi syariah melalui BASYARNAS masih belum menjadi pilihan yang solutif bagi para pihak. Beberapa putusan lembaga tersebut masih sering diabaikan oleh para pihak dan tidak cepat dieksekusi. Keterbatasan sumber daya manusia yang belum merata juga menjadi kendala penyelesaian sengketa para pihak yang berada di daerah, sehingga menyita banyak waktu dan materi. Kesimpulannya, BASYARNAS dinilai masih belum efektif dalam menjalankan fungsinya sebagai lembaga penyelesaian sengketa ekonomi syariah non-litigasi. BASYARNAS belum dapat memberikan kepuasan dan kepastian hukum yang diharapkan para pihak. Diharapkan terjalin kerjasama yang baik antara pemerintah, pembuat regulasi, dan pihak terkait lainnya untuk mencapai kesempurnaan tujuan Badan Arbitrase Syariah Nasional.

Abstract

Abstract: This study examines the strategic role of mediation in resolving Sharia economic disputes within Indonesia’s Religious Courts, where mediation is normatively recognized as a fast, cost-effective, and Sharia-aligned mechanism, yet remains underutilized in pre-litigation contexts. Using a normative-empirical method, the research analyzes primary legal instruments—such as Law No. 30/1999, PERMA No. 1/2016, PERMA No. 14/2016, and Law No. 3/2006 alongside conceptual frameworks of islah, while empirical data were obtained from the Supreme Court’s 2024 annual report, case statistics from Religious Courts in Yogyakarta, literature reviews, and interviews with certified non-judge mediators. The findings show a significant increase in mediation success rates in litigated Sharia economic cases during 2023–2024, particularly in PA Bantul, demonstrating the growing effectiveness of mediation and the strong philosophical foundation provided by Islamic principles of justice, reconciliation, and maslahah. However, the study also identifies persistent obstacles to the wider adoption of pre-litigation mediation, including the absence of mandatory regulatory requirements, limited contractual mediation clauses, low legal literacy, and misconceptions regarding the enforceability of out-of-court agreements. These results highlight the need for regulatory reform, broader integration of mediation clauses in Sharia economic contracts, and increasing public understanding to optimize mediation as a mechanism for resolving major disputes outside the court that is sharia-compliant, efficient, modern, and restorative justice-oriented. Abstrak: Penelitian ini mengkaji peran strategis mediasi dalam penyelesaian sengketa ekonomi syariah di lingkungan Peradilan Agama di Indonesia, di mana mediasi secara normatif diakui sebagai mekanisme penyelesaian yang cepat, hemat biaya, dan selaras dengan prinsip syariah, namun masih belum dimanfaatkan secara optimal pada tahap pra-litigasi. Dengan menggunakan metode normatif-empiris, penelitian ini menganalisis instrumen hukum primer seperti UU No. 30/1999, PERMA No. 1/2016, PERMA No. 14/2016, dan UU No. 3/2006 serta kerangka konseptual tentang islah, sementara data empiris diperoleh dari Laporan Tahunan Mahkamah Agung 2024, statistik perkara di Pengadilan Agama wilayah Yogyakarta, studi literatur, dan wawancara dengan mediator non-hakim bersertifikat. Temuan penelitian menunjukkan adanya peningkatan signifikan tingkat keberhasilan mediasi litigasi pada perkara ekonomi syariah selama 2023–2024, terutama di PA Bantul, yang menggambarkan meningkatnya efektivitas mediasi dan kuatnya landasan filosofis yang diberikan oleh prinsip keadilan, rekonsiliasi, dan maslahah dalam Islam. Namun demikian, penelitian ini juga mengidentifikasi hambatan yang menghalangi penerapan mediasi pra-litigasi secara lebih luas, termasuk tidak adanya kewajiban regulatif, minimnya pencantuman klausul mediasi dalam kontrak ekonomi syariah, rendahnya literasi hukum, serta kesalahpahaman mengenai kekuatan eksekutorial kesepakatan mediasi di luar pengadilan. Hasil penelitian menegaskan pentingnya reformasi regulasi, integrasi klausul mediasi dalam kontrak ekonomi syariah, serta peningkatan pemahaman publik untuk mengoptimalkan mediasi sebagai mekanisme penyelesaian sengketa utama diluar pengadilan yang sesuai syariah, efisien, modern, dan berorientasi pada keadilan restoratif.
