Abstract

Penelitian ini mengkaji perlindungan hukum bagi perempuan korban perdagangan orang di Indonesia dari perspektif hak asasi manusia dengan menggunakan pendekatan yuridis normatif. Isu hukum yang diangkat mencakup kerangka hukum yang ada, termasuk UU No. 39 Tahun 1999 tentang Hak Asasi Manusia dan UU No. 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Perlindungan hukum bagi perempuan korban perdagangan orang di Indonesia menjadi isu hukum yang signifikan mengingat meningkatnya kasus eksploitasi fisik, seksual, dan kerja paksa. Tujuan penelitian adalah untuk mengevaluasi efektivitas perlindungan hukum yang ada dan mengidentifikasi hambatan dalam penegakan hukum. Metode yang digunakan meliputi analisis terhadap peraturan perundang-undangan, serta evaluasi terhadap praktik penegakan hukum dan layanan pemulihan korban. Hasil penelitian menunjukkan bahwa meskipun kerangka hukum sudah memadai, pelaksanaannya terkendala oleh masalah ekonomi, geografis, birokrasi, serta penegakan hukum yang lemah dan korupsi. Untuk meningkatkan perlindungan, diperlukan perbaikan dalam sistem peradilan, penguatan layanan bantuan hukum, serta peningkatan kesadaran dan edukasi masyarakat, di samping kerja sama yang lebih intensif dengan organisasi internasional dan masyarakat sipil.

Abstract

Waste management remains a challenge in various regions, including urban areas such as Rawa Makmur Permai Village, Bengkulu City. Low public awareness of waste sorting at home is one of the reasons why community-based waste management is less than optimal. To address this issue, this community service activity aimed to increase community understanding and participation through outreach on the waste bank initiative in RW 03. The implementation method included preparation, implementation, and evaluation. The activity was conducted in a participatory and educational manner, featuring speakers from the Environmental Agency and local waste bank managers. Evaluation was conducted through a questionnaire with participants to gauge understanding and interest in the program. Results showed that 90% of participants understood the material presented and expressed a willingness to participate in waste management in their neighborhood. These findings demonstrate that an appropriate outreach approach can be an effective first step in building environmental awareness and encouraging the establishment of community-based waste banks at the RW level.

Abstract

The application of differentiated criminal liability by investigators in handling collective assault cases represents the implementation of justice and individualization principles in Indonesia’s criminal law system. This principle requires that each offender be held accountable according to their level of culpability, intent, and contribution to the offense. Juridically, the legal basis for applying this differentiation lies in Articles 55 and 56 of the Indonesian Criminal Code (KUHP) concerning participation, Article 170 KUHP concerning group assault, and Articles 1(2) and 7(1)(a) of the Criminal Procedure Code (KUHAP), which authorize investigators to assess and determine the role of each participant. Additionally, this principle is grounded in the constitutional guarantee of justice under Article 28D(1) of the 1945 Constitution of the Republic of Indonesia and the principle of proportionality as stipulated in National Police Regulation No. 6 of 2019 on Criminal Investigation. Through the implementation of differentiated criminal liability, investigators are expected to uphold law enforcement that is fair, professional, and proportional thus preventing over-criminalization and ensuring substantive justice for all individuals involved in joint assault crimes.

Abstract

This study analyzes the trafficking of Indonesian Migrant Workers (TKI) and Female Migrant Workers (TKW) abroad as a social pathology and the effectiveness of legal protection. Despite regulations such as Law No. 21 of 2007 and Law No. 18 of 2017, illegal agents, non-procedural departures, exploitation, and limited victim access to legal protection remain. This normative study uses literature and legal document analysis to identify gaps between regulation and implementation in the socio-economic context of migrant workers. Findings show TKI atau TKW trafficking is a systemic social issue influenced by poverty, low education, and limited employment alternatives. Effective legal protection requires strengthened regulations, agent supervision, public education, capacity building, international intervention, and socio-economic rehabilitation for victims. The study provides policy recommendations to enhance migrant worker protection and sustainably prevent human trafficking.
