Abstract

Berdasarkan Undang-Undang Nomor 3 tahun 2020 Tentang Pertambangan Mineral Dan Batubara sudah mencakup segala peraturan mengenai pertambangan, namun permasalahan mengenai tindak pidana pertambangan emas ilegal masih saja kerap kali terjadi di Kabupaten Nagan Raya dan ini sudah sangat meresahkan karena dapat menimbulkan dampak negatif bagi masyarakat. Penelitian ini bertujuan untuk mengetahui bagaimana proses penegakan hukum terhadap tindak pidana pertambangan emas ilegal di wilayah hukum Polres Nagan Raya dan untuk mengetahui faktor apa saja yang menghambat kepolisian dalam proses penegakan hukum terhadap tindak pidana pertambangan emas ilegal di wilayah hukum Polres Nagan Raya. Metode penelitian dalam penelitian ini adalah metode penelitian empiris atau penelitian ini adalah penelitian lapangan (Field Research). Pengumpulan data dilakukan dengan melakukan wawancara, observasi dan dokumentasi. Lokasi penelitian di Polres Nagan Raya, dengan menggunakan bahan hukum primer yang diperoleh melalui wawancara, bahan hukum sekunder yang dikumpulkan melalui studi kepustakaan. Hasil Penelitian menunjukkan bahwa penegakan hukum yang dilakukan kepolisian Polres Nagan Raya melalui upaya preventif yaitu dengan melakukan sosialisasi dan pemasangan spanduk sebagai peringatan kepada masyarakat mengenai aturan, sanksi dan dampak dari melakukan pertambangan emas ilegal serta dengan melakukan pengawasan dan patroli, upaya represif yaitu dengan melakukan penangkapan dan penahanan terhadap pelaku dan penutupan aktivitas pertambangan. Faktor yang menghambat kepolisian dalam proses penegakan hukum terhadap tindak pidana pertambangan emas ilegal yaitu, Kurangnya kepedulian dan kesadaran hukum masyarakat mengenai aturan izin pertambangan serta sanksi melakukan aktivitas pertambangan emas ilegal, sulitnya akses menuju lokasi pertambangan, faktor lain yang mempengaruhi yaitu faktor ekonomi dan Faktor anggapan masyarakat tentang melakukan usaha sendiri. Saran kepada pihak Kepolisian Polres Nagan Raya perlu melakukan sosialisasi yang lebih intensif kepada masyarakat mengenai Undang-Undang Nomor 3 Tahun 2020 Tentang Mineral dan Batubara serta meningkatkan kinerja dalam melakukan pengawasan dan patroli serta penutupan aktivitas pertambangan hal ini penting untuk menciptakan efek jera dan memastikan bahwa peraturan tersebut dihormati oleh seluruh masyarakat. Kepada masyarakat yang melakukan pertambangan emas ilegal agar dapat menghentikan aktivitas pertambangan guna menghindari terjadinya kerusakan lingkungan yang dapat merugikan masyarakat itu sendiri, serta kesadaran hukum mengenai aturan izin pertambangan dan sanksinya. Based on Law Number 3 of 2020 on Mineral and Coal Mining, all regulations concerning mining are already covered. However, issues regarding illegal gold mining crimes still frequently occur in Nagan Raya Regency, and this has become very concerning because it can cause negative impacts on the community. This research aims to understand how law enforcement processes illegal gold mining crimes within the jurisdiction of the Nagan Raya Police Department and to identify the factors that hinder the police in enforcing the law against illegal gold mining crimes in the Nagan Raya jurisdiction. The research method used in this study is empirical research or field research. Data collection was conducted through interviews, observations, and documentation. The research location is at the Nagan Raya Police Department, using primary legal materials obtained through interviews, and secondary legal materials collected through literature studies. The results of the study show that law enforcement by the Nagan Raya Police Department involves preventive efforts, such as conducting socialization and installing banners as warnings to the public regarding the rules, sanctions, and impacts of engaging in illegal gold mining, as well as conducting supervision and patrols. Repressive efforts include arrests, detentions of perpetrators, and the closure of mining activities. The factors that hinder the police in the process of law enforcement against illegal gold mining crimes include the lack of public awareness and concern about the regulations on mining permits and the sanctions for conducting illegal gold mining activities, the difficulty of accessing the mining sites, and economic factors, as well as the community’s perception of self-employment. Recommendations to the Nagan Raya Police Department include conducting more intensive socialization to the public about Law Number 3 of 2020 on Mineral and Coal Mining, and improving efforts in supervision, patrolling, and closing mining activities. This is crucial to create a deterrent effect and to ensure that the regulations are respected by the community. For those involved in illegal gold mining, it is advised to stop such activities to avoid environmental damage, which could ultimately harm the community itself. Legal awareness regarding mining permits and the corresponding sanctions is also essential.

Abstract

This study aims to examine the criminal liability of intermediaries in cases of vehicle loss in car rental businesses based on the perspective of Indonesian criminal law. The study uses a normative legal method with a statute approach and an analytical approach. The data used comes from primary legal materials in the form of laws and regulations, secondary legal materials in the form of books, journals, and scientific articles, and tertiary legal materials such as legal dictionaries and encyclopedias. The data collection technique is carried out through literature studies, while data analysis uses a descriptive-analytical method. The results of the study indicate that the criminal liability of intermediaries can be classified as a crime of embezzlement (Article 372 of the Criminal Code), fraud (Article 378 of the Criminal Code), or theft (Article 362 of the Criminal Code), depending on the modus operandi used. Factors determining liability include the role and function of the intermediary, the element of intent, and the causal relationship between the act and the consequence. In judicial practice, proving subjective and objective elements is often an obstacle. This study concludes that the criminal liability of intermediaries is significantly influenced by their level of involvement and the fulfillment of the elements of the crime charged. The study recommends the need for more comprehensive regulations, improved identity verification, and strengthened coordination between law enforcement and rental businesses to prevent and combat crime in this sector. [Penelitian ini bertujuan untuk mengkaji pertanggungjawaban pidana pihak perantara dalam kasus hilangnya kendaraan pada usaha rental mobil berdasarkan perspektif hukum pidana Indonesia. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan (statute approach) dan analisis (analytical approach). Data yang digunakan berasal dari bahan hukum primer berupa peraturan perundang-undangan, bahan hukum sekunder berupa buku, jurnal, dan artikel ilmiah, serta bahan hukum tersier seperti kamus hukum dan ensiklopedia. Teknik pengumpulan data dilakukan melalui studi kepustakaan, sedangkan analisis data menggunakan metode deskriptif-analitis. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana pihak perantara dapat dikualifikasikan sebagai tindak pidana penggelapan (Pasal 372 KUHP), penipuan (Pasal 378 KUHP), atau pencurian (Pasal 362 KUHP), tergantung pada modus operandi yang dilakukan. Faktor penentu pertanggungjawaban meliputi peran dan fungsi perantara, unsur kesengajaan, serta hubungan kausalitas antara perbuatan dan akibat. Dalam praktik peradilan, pembuktian unsur subjektif dan objektif sering menjadi kendala. Penelitian ini menyimpulkan bahwa pertanggungjawaban pidana perantara sangat dipengaruhi oleh tingkat keterlibatan dan terpenuhinya unsur-unsur tindak pidana yang didakwakan. Saran penelitian adalah perlunya regulasi yang lebih komprehensif, peningkatan verifikasi identitas, serta penguatan koordinasi antara aparat penegak hukum dan pelaku usaha rental untuk mencegah dan menanggulangi tindak pidana di sektor ini.]

Abstract

Undang-Undang Nomor 11 Tahun 2008 tentang Informasi danTransaksi Elektronik Pasal 45 ayat (3) Jo Pasal 27ayat(3) Jo Pasal 55 ayat (1) ke-1 Kitab Undang-Undang Hukum Pidana mengatur penghinaan melalui media elektronik baik penghinaan, pencemaran nama baik diancam dengan hukuman paling lama empat tahun penjara atau denda palingbanyakRp.750.000.000,00. Meskipun telah ada regulasi, masih ada masyarakat yang melakukan penghinaan melalui media elektronik secara bersama-sama, seperti terjadi di Kota Banda Aceh. Pengadilan Negeri Banda Aceh memvonis lima belas hari penjara terhadap MI bin MN dan TIH bin TL yang terbukti melakukan penghinaan via media elektronik secara bersama-sama. Tujuan penelitian agar memberikan sumbangsih terhadap perlindungan hukum serta sanksi dalam kasus pidana penghinaan secara bersama-sama melalui media elektronik, dan berdampak pada penyempurnaan sistem hukum nasional, khususnya hukum pidana dalam penerapan sanksi kasus penghinaan secara bersama-sama melalui media elektronik. Kajian ini menggunakan penelitian yuridis empiris Sumber data primer adalah MI bin MN dan TIH bin TL dan unsur penegak hukum di Kota Banda Aceh, yang diperoleh dari penelitian lapangan(field research). Sedangkan data skunder hasil telaah bahan pustaka. Hasil penelitian menggambarkan penghinaan bersama-sama faktor ketidaksengajaan,ketidaktahuan, dan kebebasan menggunakan media internet dalam kehidupan sehari-hari. Penerapan sanksi terhadap pelaku tindak pidana tersebut sangat ringan, yaitu lima belas hari penjara.

Abstract

This study explores the legal liability of livestock owners for traffic accidents caused by wandering animals on public roads in Aceh Jaya Regency. The background of the study is the increasing number of road accidents involving livestock, which not only endanger road users but also reflect weak implementation of local regulations. Although Qanun No. 11 of 2021 on Livestock Control has been enacted as a legal instrument to regulate and enforce animal ownership responsibilities, its implementation is still far from optimal. The problem lies in the legal gap between the formal norms stated in the qanun and the customary legal practices that dominate in the community. This research uses an empirical juridical method by combining normative analysis with field data through interviews with livestock owners, accident victims, law enforcement officers, and local government officials. The findings reveal that legal responsibility is often resolved through informal channels such as family deliberation or customary sanctions, which are not recorded as formal legal processes. The lack of public legal awareness, weak law enforcement, absence of livestock identification systems, and limited infrastructure have hindered the enforcement of the qanun. Meanwhile, the local government has made several efforts, including socialization, animal impoundment, auctions, and applying administrative and criminal sanctions. However, these efforts still face structural and cultural challenges. Therefore, to optimize livestock control and reduce accidents, this study recommends a more integrated approach involving the synchronization of formal and customary laws, digital registration of livestock, development of collective livestock shelters, and strengthening public legal education. This research contributes to the discourse on legal accountability in decentralized governance areas and emphasizes the need for regulatory reform that is sensitive to local socio-cultural contexts. A collaborative model involving local governments, traditional leaders, and civil society is essential for creating an effective and sustainable legal framework to protect public safety on roads

Abstract

Article 9 letter j of Law Number 22 of 2022 on Corrections stipulates that every inmate is entitled to occupational safety assurance, wages, or work?performance premiums. This provision has not been fully implemented at the Class III Lhoknga Correctional Facility, particularly regarding work protection and fair remuneration for inmates participating in vocational activities. This study aims to explain the mechanism for fulfilling inmates’ rights to occupational safety assurance and the provision of wages or work premiums, identify the obstacles encountered in its implementation, and analyze the efforts undertaken to address these challenges. The research employs an empirical juridical approach through field observations and interviews to assess the effectiveness of statutory implementation within correctional practice. The findings indicate that the fulfillment of inmates’ rights to occupational safety and the distribution of wages or work premiums has not been optimal. Several work activities are not supported by adequate safety standards, and the remuneration provided does not yet meet the principles of fairness mandated by the relevant regulations. [Pasal 9 huruf j Undang-Undang Nomor 22 Tahun 2022 tentang Pemasyarakatan menetapkan bahwa setiap narapidana berhak memperoleh jaminan keselamatan kerja, upah, atau premi hasil kerja. Ketentuan ini belum sepenuhnya terimplementasi di Lembaga Pemasyarakatan Kelas III Lhoknga, khususnya terkait perlindungan kerja dan imbalan yang layak bagi narapidana yang mengikuti program pembinaan kerja. Penelitian ini bertujuan menjelaskan mekanisme pemenuhan hak atas jaminan keselamatan kerja serta pemberian upah atau premi, mengidentifikasi kendala yang dihadapi dalam pelaksanaannya, dan menganalisis upaya yang ditempuh untuk mengatasi hambatan tersebut. Penelitian menggunakan pendekatan yuridis empiris melalui observasi dan wawancara untuk menilai efektivitas penerapan regulasi dalam praktik pemasyarakatan. Temuan penelitian menunjukkan bahwa pemenuhan hak narapidana terkait jaminan keselamatan kerja dan pemberian upah atau premi belum berjalan optimal. Beberapa kegiatan kerja belum disertai standar keselamatan yang memadai, sementara pemberian upah atau premi belum memenuhi prinsip kelayakan sebagaimana diamanatkan oleh peraturan perundang-undangan.]
