Abstract

The purpose of this research is to determine the effectiveness implementation regulation of the chief of Indonesian national police 11 of 2010 regarding the handling of bomb disposal and to find out what factors influenced bomb disposal procedures in Gorontalo Province. The type of research used in this research is empirical normative legal research. The type of research used is empirical normative legal research. Normative law research uses normative legal case studies in the form of legal products, for example reviewing draft laws. The subject of the research is the law which is conceptualized as a norm or rule that applies in society and becomes a reference for everyone. Empirical legal research is research that uses empirical legal case studies in the form of community behavior. The results of the research obtained are that regulation of the chief of Indonesian national police number 11 of 2010 concerning the handling of bomb disposal in Gorontalo Province has not been effective because it was found that there are still several aspects that are not following the provisions in regulation of the chief of Indonesian national police, for example, related to personnel standardization, individual equipment is not adequate, Some of the new unit equipment are complete and some are damaged, then spare parts are not ,available as well as administrative processes that are often ignored and the factors that affect the bomb disposal procedure in Gorontalo province, namely inadequate facilities and infrastructure, incomplete personnel / human resources, insufficient budget and no insurance for each Jibom personnel.

Abstract

Tindak pidana pencucian uang (TPPU) merupakan kejahatan ekonomi yang bersifat kompleks, tertutup, dan sulit dibuktikan melalui mekanisme pembuktian pidana konvensional. Untuk mengatasi hal tersebut, Undang-Undang Nomor 8 Tahun 2010 mengadopsi asas pembuktian terbalik sebagai instrumen khusus. Penelitian ini bertujuan untuk menganalisis pengaturan dan penerapan asas pembuktian terbalik dalam TPPU serta menilai kesesuaiannya dengan prinsip-prinsip dasar hukum pidana. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa pembuktian terbalik dalam TPPU tidak berdiri sebagai sistem pembuktian pidana yang umum, melainkan sebagai instrumen lex specialis yang bersifat terbatas dan berimbang. Terdakwa hanya dibebani kewajiban membuktikan asal-usul harta kekayaan yang diduga terkait tindak pidana, sementara penuntut umum tetap wajib membuktikan unsur delik pokok. Namun, ketiadaan standar yang jelas terkait frasa “alat bukti yang cukup” berpotensi menimbulkan perbedaan penerapan dan ketegangan dengan prinsip praduga tidak bersalah serta non self-incrimination. Penelitian ini menyimpulkan bahwa asas pembuktian terbalik relevan untuk mendukung pemulihan aset, namun memerlukan penguatan pengaturan prosedural agar penerapannya tetap sejalan dengan prinsip fair trial.

Abstract

Premature designation of a suspect in the criminal justice process may cause significant legal, social, and reputational harm because such status can result in restrictions on individual rights and public stigma. This study examines the role of pretrial proceedings in protecting the constitutional rights of suspects and formulates the juridical parameters for determining when a suspect designation can be considered premature. The research employs a normative legal method using statutory, conceptual, and case approaches through library research of legislation, court decisions, and legal doctrines. The findings indicate that pretrial proceedings serve as a judicial control mechanism over investigative actions, particularly following the expansion of pretrial jurisdiction that enables courts to assess the legality of suspect designation. A designation may be deemed premature if it lacks at least two valid pieces of evidence, is not preceded by lawful investigative procedures, or violates the principle of due process of law. However, the effectiveness of pretrial proceedings remains limited because judicial review is largely formal, conducted within a short time frame, and unable to fully restore the suspect’s reputation. Therefore, clearer procedural guidelines, enhanced legal capacity of judges and investigators, and reforms to criminal procedural law are necessary to strengthen constitutional rights protection.

Abstract

This study aims to analyze the effectiveness of law enforcement by the police against perpetrators of motor vehicle theft in the jurisdiction of Kota Timur Police Sector, Gorontalo City, and to identify the factors that influence its implementation. This research applies empirical legal research with a field-based approach. Data were obtained through interviews with investigators at Kota Timur Police Sector and through an examination of motor vehicle theft case data from 2022 to 2025. The results show that law enforcement against motor vehicle theft has been carried out through several stages, including receiving police reports, conducting inquiries and investigations, arresting suspects, preparing case files, and transferring cases to the public prosecutor. The case data indicate that all recorded cases during the research period were resolved. However, the effectiveness of law enforcement has not been fully optimal due to fluctuations in the number of cases and the possibility of repeat offenses. Several factors influence the effectiveness of law enforcement, including legal substance, law enforcement officers, facilities and infrastructure, community participation, and legal culture. The main obstacles include the limited number of investigators, heavy workloads, inadequate supporting facilities, and low public participation in providing information. Therefore, strengthening the capacity of police officers, improving investigative facilities, increasing routine patrols, and enhancing public legal awareness are necessary to improve the effectiveness of law enforcement against motor vehicle theft.
