Abstract

The scope of land disputes that became the competence of the State Administrative Judicature according to the judicial principle adopted in Indonesia, the implementation of the Decision of the State Administrative Court in the settlement of land disputes.This research is conducted through normative legal approach (juridical normative), that is how law is utilized as an instrument to realize the application of land dispute resolution mechanism through authority to try State Administration Court. This research uses normative legal research type to identify and analyze legal factor which is an obstacle in the application of legislation, where this study refers to the laws and regulations on land and State Administration Judicature Law, court decisions and other legal materials.That the State Administration Dispute in the field of land arises because of a written stipulation issued by the State Administration or Administrative Officer containing State Administration law action which in accordance with the prevailing laws and regulations has been concrete, individual and final in the form of land certificate of ownership the right to land issued by the Government. Implementation of the Decision of State Administration which has been decided and has the force of law in practice raises a polemic in the community where the State Administration officials are not willing to carry out the decision of the Administrative Court of the State. This condition is caused because the State Administrative Court is not the executor (executor of the decision) but only as supervisor of the implementation of the decision, for all government actions in order not to violate the law and the role of legal protection for the community.

Abstract

This paper aims to analyze the management of village funds from corruption. The problem focuses on how the concept of saving village funds from corruption? This research is in the form of normative legal research with approach of legal norm and legal principles. The result of the research shows that the concept of fund grant from villages from corruption bundles, namely, First, MoU with community with the aim of committing to build village together with village fund monitoring team; Second, establishing an independent team of supervisors to oversee the running of village fund management processes; third, ready to be sworn the village apparatus in the oath by using the scriptures of each religion; four strict sanctions with a view to providing perpetrators of village funds.

Abstract

Money politic, being recognized or not, is a very frightening scourge for democratic process in Indonesia. Politic and money are two different things but cannot be separated each other. It is because by doing politic, people need money, and with money, people can do the politic. The politic, basically, is a very tantalize arena to do various transactions which is well-known as money politic. The money politic is not a new thing for democratic system in Indonesia. From the very first time direct election is carried out, the money politic practices have been done, thus, we must be aware to those practices. We must not involve in money politic practices, because it is clearly harm the democratic process of this nation. Besides, the money politic not only underestimates the electors and the politicians, but also the democratic institution of this nation. Therefore, it causes some continuously conflicts which basically damages the national stability. The conflicts caused by money politic are unstable politic climate and situation, reducing the opportunity for the qualified district heads, influencing the people’s politic participation in both district head and general elections and harming the democratic as well as people.

Abstract

Regulations in the area of regional autonomy is as a policy instrument in the regional administration of the widest. The formation of local regulations in accordance with the public interest its implementation should be based on the principles of local autonomy and substance of local regulations must not conflict with the public interest and the law is higher. Abstrak Peraturan di bidang otonomi daerah adalah sebagai instrumen kebijakan dalam pemerintahan daerah yang seluas-luasnya. Pembentukan peraturan daerah sesuai dengan kepentingan publik pelaksanaannya harus didasarkan pada prinsip-prinsip otonomi daerah dan substansi peraturan daerah tidak boleh bertentangan dengan kepentingan publik dan hukum lebih tinggi.

Abstract

Purpose To know and analyze the application of the due process of law system in law enforcement against child crime, to find out and analyze what are the factors that influence law enforcement on the implementation of the due process of law system. By using this type of research is Normative research. Normactive research is meant as legal research which studies normative law. The normative approach method is used to examine the aspects of the law according to laws and regulations relating to the implementation of the Due Process Of Law system in Criminal law, especially against child crimes. The results of the research show that law was born to humanize humans, so law enforcement or law enforcement must provide benefits or benefits to society. The quality of development and law enforcement is demanded by society at this time not only for formal quality, but also for material / substantial quality. Substantively. the implementation of child protection must be in accordance with relevant professional ethics, to prevent deviant behavior in the exercise of authority, power and strength in the implementation of child protection. The concept of due process is like prioritizing the rule of law, law enforcement officers must recognize, respect, protect and guarantee the rights of suspects. Law and justice is an integrity between normative idealism and human action. If the three of them are no longer combined and become judicial cohesion, then what will generally occur is a lameness whose mode and packaging is destructive and dysmunctional, which then makes it easy for someone and the public to draw conclusions or create estimates, there has been a play and a dramatization project that is still under the guise of carrying out their duties. , what is meant in it is to impose a legal decision.

Abstract

This study aims to analyze the nature of political party recall rights to the membership of the House of Representatives; recall rights of members of the People's Legislative Assembly by political parties whether they are in accordance with the principles of a democratic state based on law; Juridical consequences of recall rights if they remain in the hands of political parties. This type of research is normative law research. The results of the study indicate that the nature of the right of Recall by political parties to the membership of the People's Legislative Assembly is that political party members who sit in parliamentary seats remain supervised by political parties as political organizations that carry on the democratic stage in order to be submissive and obedient to party policies even if they are against the spirit struggle of the people's representatives. The right of a political party's recall is not in accordance with the principles of a democratic state, if the reason for recalling the membership of the House of Representatives is only limited to members of the House of Representatives who violate the Articles of Association and Household Budget. Penelitian ini bertujuan untuk menganalisis Hakikat hak recall partai politik terhadap keanggotaan Dewan Perwakilan Rakyat; hak recall terhadap anggota Dewan Perwakilan Rakyat oleh partai politik apakah telah sesuai dengan prinsip-prinsip negara demokrasi yang berdasarkan hukum; konsekuensi yuridis hak recall apabila tetap berada di tangan partai politik. Tipe penelitian ini adalah penelitian hukum normatf. Hasil penelitian menunjukkan bahwa hakikat Hak Recall oleh partai politik terhadap keanggotaan Dewan Perwakilan Rakyat adalah agar anggota partai politik yang duduk di kursi parlemen tetap diawasi oleh partai politik sebagai organisasi politik yang mengusung dalam pentas demokrasi agar tunduk dan patuh terhadap kebijakan partai sekalipun bertentangan dengan semangat perjuangan wakil rakyat. Hak Recall Partai Politik tidak sesuai dengan prinsip-prinsip negara demokrasi, apabila alasan merecall keanggotaan Dewan Perwakilan Rakyat hanyalah sebatas anggota Dewan Perwakilan Rakyat melakukan pelanggaran terhadap Anggaran Dasar dan Anggaran Rumah Tangga Partai politik.

Abstract

Sumber pendapatan daerah adalah pajak daerah. Menurut Undang – Undang No. 34 tahun 2000 tentang Pajak Daerah dan Retribusi Daerah menyebutkan, Pajak Daerah adalah iuran wajib pajak yang dilakukan oleh pribadi / badan kepada daerah tanpa imbalan langsung yang seimbang yang dapat dipaksakan berdasarkan peraturan perundang–undangan yang berlaku, yang digunakan untuk membiayai penyelenggaraan pemerintah daerah dan pembangunan daerah. Salah satu instansi daerah yang mengelola pajak daerah adalah Dinas Pendapatan Daerah yang disingkat dengan Dispenda adalah unsur pelaksana Pemerintah Daerah di bidang pendapatan daerah. Fungsi pengawasan merupakan tugas dan tanggung jawab seorang kepala pemerintahan, seperti di lingkup pemerintah provinsi merupakan tugas dan tanggung jawab gubernur sedangkan di pemerintah kabupaten dan kota merupakan tugas dan tanggung jawab bupati dan walikota. Namun karena katerbatasan kemampuan seseorang, mengikuti prinsip-prinsip organisasi, maka tugas dan tanggung jawab pimpinan tersebut diserahkan kepada pembantunya.

Abstract

Selama ini korban kejahatan khususnya perkosaan tidak mendapat perhatian yang sepantasnya dalam hukum pidana. Korban perkosaan, sebagai pihak yang dirugikan dalam terjadinya tindak pidana seharusnya mendapat perhatian dan perlindungan hukum . Hal ini karena negara berkewajiban memelihara keselamatan dan meningkatkan kesejahteraan warga negaranya. Perlindungan korban perkosaan dalam proses penyelesaian perkara pidana sangat penting bagi korban, keluarganya dan penanggulangan kejahatan serta bagi pelaku kejahatan itu sendiri. Prospek perlindungan korban perkosaan dalam hukum pidana dimasa yang akan datang, yaitu dalam Rancangan UU KUHP diberikan dengan dimasukkannya sanksi pidana ganti kerugian ke dalam sanksi pidana tambahan. Dalam hal ini hakim dapat menjatuhkannya bersamaan dengan pidana pokok atau secara mandiri apabila delik yang bersangkutan diancam dengan pidana denda secara tunggal.

Abstract

Dalam penyelenggaraan pemerintahan daerah pun seringkali terjadi permasalahan yang sangat kompleks yang diantaranya sangat memprihatinkan dan menjadi bahan perbincangan dikalangan para pemerhati penyelenggaraan pemerintahan daerah adalah masalah korupsi di lingkungan pemerintah daerah Agar kiranya Tindak Pidana Korupsi Di Lingkungan Pemerintah Daerah harus di minimalisir di karenakan korupsi ini juga kalau tidak segera di antisipasi sejak dini sudah barang tentu akan membudaya dan akan merusak serta merongrong sendi-sendi perikehidupan berbangsa dan bernegara melalui tangan – tangan oknum yang tidak bertanggungjawab dengan memanfaatkan peluang untuk kepentingan pribadi dan golongan melalui Pengawasan Internal dan Eksternal, Kontroling dan evaluasi serta Koordinasi. Upaya-upaya yang ditempuh dalam rangka Meminimalisir Tindak Pidana Korupsi Di Lingkungan Pemerintah Daerah melalui transparansi, regulasi, independensi, sanksi, akuntabel, kerja ihklas, kerja cerdas, kerja keras, tertibu, teratur, imtak.

Abstract

Nawacita ke – 3 Presiden Jokowi dan JK “Membangun Indonesia dari pinggiran dengan memperkuat daerah-daerah dan desa dalam kerangka negara kesatuan” Adapun plus minus dari pembangunan melalui Nawacita ke – 3 dari presiden terpilih yang tertuang dalam program dana desa ini di khawatirkan juga akan terjadi penyelewengan dana yang berdampak pada perbuatan Korupsi karena desa belum siap dengan sumber Daya manusia yang selama ini keberadaan dari Aparatur di Pemerintahan Desa masih rendah. Berdasarkan hal tersebut di atas penulis menyimpulkan bahwa Agar kiranya upaya Menghindarkan Penggunaan Dana Desa Dari Perbuatan Korupsi adalah sebagai berikut : MoU dengan masyarakat, TIM pengawasan dana desa, Siap di Sumpah , Sanksi yang tegas.
