Abstract

Indonesia is a state governed by law, prioritizing legal principles in all aspects of national life. One effort to uphold this principle is the development of legal frameworks to ensure justice, legal certainty, order, and a law-conscious society. Upholding the rule of law and justice is rooted in Pancasila and the 1945 Constitution of the Republic of Indonesia (hereinafter referred to as UUD 1945), which emphasizes human rights and guarantees equality for all citizens before the law and government without exception. Legal protection for consumers is a fundamental issue in public services, including electricity provision. This study focuses on the recording of kilowatt-hours meters by PT. PLN (Persero) in Kupang City, which often experiences inaccuracies that may disadvantage consumers. This study employs an empirical juridical approach, with primary data obtained through interviews and observations, and secondary data gathered from literature reviews. The findings reveal that (1) inaccuracies in kilowatt-hours meter recording frequently occur due to human errors, device malfunctions, and system weaknesses, causing financial losses to consumers. (2) PT. PLN is responsible for correcting errors, providing compensation, and improving the recording system. Recommendations include enhancing recording accuracy, replacing defective devices, and educating consumers about their rights. Implementing more effective legal protection is expected to increase consumer trust in electricity services.

Abstract

People tend not to be interested in taking economic benefits from communal intellectual property due to lack of knowledge. The lack of awareness about the importance of intellectual work assets has led to rampant cases of violations of communal intellectual property. This is the point of awakening awareness of increasing knowledge of intellectual property rights of communal communities. Starting from the above conditions, this community service aims to explain about increasing knowledge of intellectual property rights for the community of Oelomin Village, Nekamese District, Kupang Regency. The solution offered in this community service is to explain intellectual property rights. The method used is through socialization of material delivery and question and answer discussions directly with the local community. The results of the activity show that the socialization given to the local community can increase the understanding and knowledge of the Oelomin Village community related to communal intellectual property rights, this can be seen from the high enthusiasm of the community during the question and answer discussion. Seeing these conditions, it is necessary to do more socialization to the community in order to further deepen and strengthen the understanding of the community related to communal intellectual property rights.

Abstract

Tulisan ini merupakan intisari dari skripsi yang membahas mengenai Surat Kuasa Membebankan Hak Tanggunggan Ditinjau Dari Undang-Undang Nomor 4 Tahun1996 Tentang Hak Tanggungan dengan masalah pokok 1) Bagaimana tinjauan hukum terhadap Surat Kuasa Membebankan Hak Tanggungan menurut ketentuan Undang-undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan? dan 2) Bagaimana implikasi terhadap implementasi ketentuan Pasal 15 Ayat 1 Undang-undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan? Metode yang digunakan penulis yakni penelitian hukum normatif dengan pendekatan hukum perundang-undangan.  Hasil penelitian menunjukkan bahwa Surat Kuasa Membebankan Hak Tanggungan (SKMHT) diatur dalam ketentuan Pasal 10 ayat (1), (2) dan (3) Undang-Undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan. Ketentuan tersebut melindungi pemberian kredit/perjanjian kredit antara kreditor dengan debitur untuk membuat perjanjian tertulis di hadapan Notaris atau PPAT. Sementara Surat Kuasa Membebankan Hak Tanggungan (SKMHT) menimbulkan implikasi hukum penting terkait jaminan kredit, khususnya dalam konteks pembebanan hak tanggungan atas tanah. SKMHT memberikan kuasa kepada pihak lain, biasanya bank, untuk membebankan hak tanggungan pada objek hak atas tanah, biasanya sertifikat yang masih atas nama pengembang. Namun, penggunaan SKMHT yang tidak diikuti dengan pembuatan Akta Pemberian Hak Tanggungan (APHT) dan pendaftaran hak tanggungan dapat menyebabkan hak tanggungan tidak terbentuk, sehingga bank tidak memiliki hak eksekusi jika debitur wanprestasi. Diharapkan agar para pihak dalam membuat perjanjian kredit perlu mendapatkan perlindungan hukum dari pemerintah agar pemberi hak tanggungan tidak kehilangan haknya.

Abstract

Introduction: Violation of the Standard Operating Procedure (SOP) of Smile, Greet, Say Hello is a form of violation of minor work discipline in Company Regulations or Collective Labor Agreements. Sanctions for this violation are generally in the form of verbal and written reprimands, to a Warning Letter in stages in accordance with the provisions of labor law. Purposes of the Research: This study aims to juridically analyze violations of the Smile, Greeting, and Salutation Standard Operating Procedure (Smile, Greet, Say Hello SOP) in company regulations based on Law Number 13 of 2003 concerning Manpower. The study focuses on the legal position of the Smile, Greet, Say Hello SOP in employment relationships, employees’ obligations to comply with company regulations, the classification of Smile, Greet, Say Hello SOP violations, as well as the mechanisms for dispute resolution and sanction implementation. Methods of the Research: This research employs a normative legal research method using statutory, conceptual, and analytical approaches. The legal materials consist of primary, secondary, and tertiary legal sources collected through library research and analyzed descriptively and qualitatively. Findings of the Research: The results indicate that the Smile, Greet, Say Hello SOP has the status of a valid and binding internal company norm when stipulated in company regulations or collective labor agreements in accordance with labor law provisions. Violations of the Smile, Greet, Say Hello SOP are generally classified as minor disciplinary violations, the settlement of which should prioritize guidance, verbal warnings, and written warning letters applied progressively. The imposition of sanctions must be proportional, objective, and consistent with the principles of worker protection and legal certainty. The mechanism for resolving SOP violations is carried out through internal company procedures, bipartite negotiations, mediation, and the Industrial Relations Court in the event of disputes. Therefore, the implementation of the Smile, Greet, Say Hello SOP not only functions to establish a professional work culture and excellent service but must also ensure a balance of rights and obligations between employees and employers within industrial relations
