Abstract

Notaris memainkan peran penting dalam sistem hukum perusahaan di Indonesia, terutama dalam pendirian dan pengelolaan Perseroan Terbatas (PT). Sebagai pejabat umum yang berwenang, notaris bertanggung jawab untuk membuat akta autentik yang menjadi dasar hukum bagi pendirian perusahaan. Dengan diberlakukannya Undang-Undang Cipta Kerja, terdapat perubahan signifikan dalam prosedur pendirian PT, termasuk kemudahan bagi usaha mikro dan kecil untuk mendirikan PT secara perorangan. Meskipun hal ini meningkatkan aksesibilitas bagi pengusaha, tantangan muncul terkait kepatuhan terhadap regulasi baru dan perlunya pengetahuan mendalam dari notaris mengenai berbagai peraturan yang berlaku. Selain itu, notaris juga dituntut untuk menjaga kepastian hukum dan melindungi kepentingan semua pihak yang terlibat dalam proses pendirian perusahaan. Dalam konteks ini, tantangan yang dihadapi notaris mencakup risiko hukum akibat kesalahan dalam pembuatan akta serta kebutuhan untuk terus memperbarui pengetahuan tentang perubahan regulasi. Artikel ini bertujuan untuk menganalisis peran strategis notaris dalam sistem hukum perusahaan di Indonesia serta tantangan yang harus dihadapi untuk memastikan bahwa mereka dapat menjalankan tugasnya dengan efektif di tengah kompleksitas hukum yang ada.

Abstract

Dengan penekanan pada peran redistribusi tanah dalam menurunkan kesenjangan ekonomi, meningkatkan produktivitas, dan memberdayakan masyarakat pedesaan, penelitian ini berupaya untuk mengkaji bagaimana reforma agraria berdampak terhadap pembangunan ekonomi lokal di Indonesia. Di Indonesia, reforma agraria dipandang sebagai langkah yang diperhitungkan untuk mengatasi masalah ketimpangan kepemilikan lahan yang sudah berlangsung lama, khususnya di daerah pedesaan di mana mayoritas masyarakatnya bergantung pada pertanian sebagai sumber pendapatan utama mereka. Dengan redistribusi tanah yang lebih adil, Pemerintah ingin membuat masyarakat kecil menjadi lebih baik dan membuka peluang bisnis baru yang dapat meningkatkan perekonomian lokal. Namun, sejumlah permasalahan sering menghambat efektivitas program ini, termasuk kurangnya pengetahuan penerima manfaat tentang cara mengelola lahan secara berkelanjutan dan produktif, terbatasnya akses mereka terhadap sumber daya modal, dan tidak adanya infrastruktur pendukung.

Abstract

Termination of Employment (PHK) is the ending of the working relationship between employees/laborers and employers due to certain circumstances, resulting in the cessation of rights and obligations between both parties. In Indonesia, PHK is regulated under Law No. 13 of 2003 on Manpower and Law No. 11 of 2020 on Job Creation, along with its implementing regulations. Normatively, there are two types of PHK: voluntary PHK and involuntary PHK. PHK is a critical issue in Indonesian labor law because it directly impacts workers' fundamental rights and the stability of industries. A PHK process that is not in compliance with legal procedures can lead to significant social and economic consequences, both for workers who lose their jobs and for employers who must reduce their workforce. Additionally, PHK that is not carried out in accordance with regulations can erode public trust in the labor market and damage relationships between employers and workers. Workers affected by PHK are entitled to various rights, including compensation in the form of severance pay, long-service bonuses, and other rights as stipulated by regulations. These rights are designed to protect workers during the transition period after losing their jobs and ensure they are not financially harmed due to an unfair PHK process. Therefore, it is crucial for all parties involved to understand and adhere to the applicable legal provisions in every PHK process to ensure fairness, protect workers' rights, and maintain labor stability in Indonesia.

Abstract

Pro bono legal assistance has become an interesting focus amidst the challenges of a legal system that is often considered far from the reach of the general public. This article examines the strategic role of free legal assistance by advocates in building a bridge of public trust in a legal system that is often seen as elitist and expensive. With an empirical approach, this study explores how pro bono services not only provide access to justice for vulnerable groups, but also create a domino effect: improving the image of the law in the eyes of the public. Data collected through interviews with legal practitioners and analysis of real cases, show that this assistance is able to erode negative stigma and prove that the law can side with the weak. This article offers a fresh perspective that pro bono is not just charity, but a social investment for a more humane and trustworthy legal system.
