Abstract

Putusan Mahkamah Konstitusi Nomor 100/PUU-XIII/2015 menjadi payung hukum penyelenggaraan pilkada dengan satu pasangan calon. Landasan hukum tersebut merupakan jalan keluar atas kebuntuan hukum, namun masih menyisakan berbagai persoalan. Tujuan penelitian ini adalah untuk mengkaji alasan hukum yang mendasari legalitas pilkada dengan satu pasangan calon, implikasi politik, dan factor-faktor penyebab maraknya penyelenggaraan pilkada dengan satu pasangan calon. Desain penelitian ini yuridis-normatif dengan pendekatan kualitatif. Peneliti mengkaji data berupa Putusan MK, UU Pilkada, PKPU Pencalonan, artikel jurnal, dan buku-buku relevan, serta data empiris dari Komisioner KPU Kabupaten Kediri. Hasil penelitian ini menunjukkan bahwa Pertama, alasan hukum yang mendasari Putusan Mahkamah Konstitusi Nomor 100/PUU-XIII/2015 adalah untuk menjamin hak politik warga negara untuk bisa memilih dan dipilih dalam suatu pemilihan. Kedua, implikasi politik yang terjadi adalah: a) jumlah daerah penyelenggara pilkada dengan satu pasangan calon kecenderungan meningkat dari waktu ke waktu; dan b) penyelenggara pilkada tidak dapat memberikan perlakuan secara adil dan setara terhadap pasangan calon dan kotak kosong. Ketiga, ada beberapa factor penyebab lahirnya pilkada dengan satu pasangan calon, yaitu: a) adanya indikasi kegagalan partai politik dalam menjalankan fungsi kaderisasi dan rekrutmen politik; b) adanya kecenderungan partai politik lebih mengedepankan pragmatisme politik atau politik transaksional; c) adanya oligarki DPP partai politik dalam menentukan pasangan calon melalui surat rekomendasi; d) syarat dukungan pengajuan pasangan calon terlalu tinggi; dan e) tingginya biaya operasional untuk bisa menjadi pasangan calon.

Abstract

This study aims to analyze the paradigm shift and the direction of the hadith study objectives at Ma'had Aly HasyimAs-sari Jombang used the perspective of Muhammad Abid Al-Jabiriy's Arabic reasoning. This study used a descriptive curative approach. Technical Data Analysis Using Miles and Huberman Theory with three steps: data collection, data reduction, third data presentation, verification, and data conclusions. Primary and secondary data were used in this study. Secondary data were obtained from secondary sources, such as tabloids, magazines, bulletins, and online opinions, while primary data were obtained from primary sources, such as interviews and observations. This study found that first, the Islamic Boarding School, especially Ma'had Aly Hasyim Asaraiy, in essence has long used irfani and bayani reasoning in the form of hadith studies as a counter to the extreme burhani reasoning of Western civilization as a counterweight. However, lately, Islamic boarding school education with its Ma'had Aly begin to be carried away by the strandarization of such education. Second, Ma'had Aly education has a purpose as a response to global changes in the world of education which requires formality as an authority for recognizing the knowledge of its graduates, but has a big consequence that one day the boarding school will lose its irfanical reasoning characteristics by sinking into extreme burhani reasoning in the national education system implemented by the government.

Abstract

This article aims to examine the transformation of fatwas of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) regarding brokerage services in the perspective of living fatwa. The main issue raised is the weak binding power of religious fatwas in the realm of positive law, which often causes fatwas to be ignored in the public policy-making process. However, DSN-MUI fatwas related to brokerage services have proven to make a significant contribution in inspiring the formation of legal norms contained in legislation in the banking sector and financial transactions in Indonesia. Therefore, the focus of this article is directed at the study of fatwas on brokerage services as a representation of normative-religious norms in banking practices and financial transactions. Thus, it complements other studies on living fatwas. This article examines how fatwas on brokerage services have been transformed into a living norm in the Indonesian regulatory context, and identifies the main characteristics underlying this transformation. This research is a literature review with a living fatwa approach. The results show that the transformation of Islamic norms in the form of fatwas on brokerage services has a strategic role in influencing the birth of regulations that integrate sharia principles into the national legal system, especially in the field of transactions and finance. The laws and regulations governing brokerage services in Indonesia can be understood as a form of “institutionalization” of the norms previously formulated through the DSN-MUI fatwa. This article argues that these fatwas perform two main functions: first, as a reinforcement of state policy for the public good (ta'yidi); and second, as a normative source in the formulation and making of public policy (insya'i). Furthermore, DSN-MUI fatwas that have undergone transformation into the national legal system in a living perspective display characteristics that are implementative, visionary, scientific, and responsive to social dynamics (dynamic movement).
