Abstract

Online romance fraud is a form of cybercrime that exploits emotional manipulation to obtain financial gain or personal information. This phenomenon has become increasingly prevalent with the rise of internet usage in Indonesia. This study aims to evaluate Indonesia’s legal policies, such as the Electronic Information and Transactions Law (UU ITE) and the Criminal Code (KUHP), in addressing this issue, as well as to identify regulatory gaps and existing challenges. The findings are expected to provide recommendations for updating legal policies to be more adaptive to technological advancements, ensuring better protection for the public against online romance fraud. This research employs a qualitative approach, utilizing a normative juridical method that focuses on analyzing relevant laws and assessing their applicability in cases of online romance fraud. Secondary data from various legal literatures, case reports, and national surveys are used to evaluate the effectiveness of current regulations. The study finds that Indonesia’s legal policies on online romance fraud still have limitations, as the UU ITE and Article 378 of the KUHP do not specifically regulate crimes based on emotional manipulation in online relationships. Regulatory updates are needed to include clearer definitions, stricter sanctions, and effective reporting mechanisms, supported by digital literacy initiatives and international cooperation. Collaboration with digital platforms to enhance AI-based security measures and strengthen law enforcement capacity is crucial in creating a safer digital space.

Abstract

Pesantren Cijawura Margasari Kota Bandung, yang didirikan pada tahun 1930, merupakan salah satu lembaga pendidikan Islam tertua di kota tersebut dan memiliki peranan penting dalam membentuk karakter dan kepribadian santri melalui pembelajaran kitab kuning, yang mengandung nilai-nilai etika, moral, dan spiritual. Namun, dalam pelaksanaannya, pembelajaran kitab kuning sering menghadapi berbagai tantangan, seperti kurangnya sumber daya pengajar yang kompeten, metode pengajaran yang monoton, dan pengorganisasian waktu yang tidak efektif, yang dapat berdampak negatif terhadap kualitas pendidikan dan pembinaan karakter santri. Oleh karena itu, penerapan manajemen yang lebih baik, seperti pendekatan POAC (Planning, Organizing, Actuating, and Controlling), sangat penting untuk meningkatkan efektivitas pembelajaran kitab kuning di pesantren. Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis manajemen pembelajaran kitab kuning dalam rangka membina karakter santri di Pesantren Cijawura Margasari Kota Bandung. Tujuan ini meliputi menganalisis perencanaan, pengorganisasian, pelaksanaan, dan evaluasi pembelajaran kitab kuning di pesantren. Dengan demikian, penelitian ini diharapkan dapat memberikan kontribusi pada pengembangan khazanah keilmuan berkenaan dengan manajemen pembelajaran kitab kuning di pesantren. Selain itu, hasil penelitian ini juga diharapkan dapat digunakan bagi mudir, asatidz, dan santri dalam meningkatkan kualitas pembelajaran kitab kuning dan membina karakter santri, sehingga dapat memenuhi tujuan pendidikan yang esensial.

Abstract

Toleransi adalah salah satu nilai yang sangat penting dalam konteks pendidikan menurut Al-Quran, bukan hanya sekedar penerimaan terhadap perbedaan tetapi juga sebagai sikap proaktif dalam menjalin komunikasi dan kesepahaman dengan individu memiliki pandangan dan keyakinan yang berbeda. Pendekatan ini dapat membangun dialog antar budaya dan agama, menciptakan ruang bagi kerjasama dan sinergi positif di antara masyarakat yang berciri plural. Guru dan pendidik bertanggung jawab dalam mengintegrasikan nilai-nilai toleransi ke dalam proses pembelajaran, tidak hanya tentang pengajaran materi tetapi juga mendidik hati dan pikiran siswa untuk memahami dan menghargai perbedaan. Dengan menggunakan tafsir maudhu'i, artikel ini menganalisis sejumlah ayat yang mencontohkan pentingnya toleransi dalam konteks pendidikan. Toleransi tidak hanya diartikan sebagai penerimaan terhadap perbedaan, tetapi juga sebagai sikap proaktif dalam menjalin komunikasi dan kesepahaman dengan individu yang memiliki pandangan dan keyakinan yang berbeda. Melalui pendekatan ini, penulis menggambarkan bagaimana pendidikan dalam Islam dapat menjadi platform untuk membangun dialog antar budaya dan agama, sehingga menciptakan ruang bagi kerjasama dan sinergi positif di antara masyarakat yang berciri plural. Dengan menekankan prinsip toleransi yang berasal dari ajaran Islam, diharapkan generasi mendatang lebih mampu menghadapi tantangan globalisasi dan pluralisme tanpa kehilangan identitas dan nilai-nilai moral.

Abstract

Indonesia grapples with a pressing waste management crisis, generating 26.2 million tons of waste in 2023, of which 41.4% is organic, worsened by overlapping regulations and inconsistent enforcement of Law No. 18/2008 on Waste Management. This study seeks to evaluate the urgency of legislative reactivation through an Omnibus Law approach to streamline organic waste management policies and foster active participation from communities and the private sector. Using a normative juridical method, the research analyzes primary legal materials, including national laws and regulations, alongside secondary sources such as legal journals and policy reports. Findings highlight that fragmented regulations, inadequate waste processing infrastructure, and limited public awareness significantly impede effective organic waste management. The proposed Omnibus Law aims to unify disparate regulations, enhance law enforcement, and incentivize sustainable practices like composting and waste-to-energy initiatives. By addressing these challenges, the Omnibus Law can reduce environmental pollution, mitigate health risks, and support Indonesia’s sustainability goals, creating a more coordinated and efficient waste management framework.

Abstract

Kekerasan seksual yang terjadi di lembaga pendidikan keagamaan tidak hanya melanggar nilai-nilai moral dan keyakinan masyarakat, tetapi juga merupakan pelanggaran serius terhadap hak kesehatan seksual dan korban reproduksi, khususnya anak perempuan. Kasus di Lombok Barat pada tahun 2023 menjadi sorotan nasional ketika seorang pimpinan pondok pesantren yang disegani ditemukan telah melakukan pencabulan terhadap lebih dari dua puluh santri putri sejak tahun 2016. Pelaku memanfaatkan status keagamaannya dan melakukan manipulasi spiritual dengan meyakinkan korban bahwa hubungan seksual tersebut merupakan bagian dari pembersihan spiritual dan akan mendatangkan berkah. Dalam situasi hierarki agama dan budaya patriarki yang kuat, banyak korban tidak berani melapor karena takut, bersalah, dan tertekan secara sosial. Artikel ini menggunakan pendekatan hukum normatif dengan memadukan teori hukum kritis, hukum alam, dan feminisme hukum untuk mengkaji fenomena tersebut dalam kerangka hukum kesehatan. Hasil kajian menunjukkan bahwa sistem hukum dan kebijakan kesehatan di Indonesia belum sepenuhnya mampu menjangkau kompleksitas kekerasan seksual berbasis agama. Oleh karena itu, reformasi kebijakan hukum dan integrasi pendekatan pemulihan kesehatan fisik, mental, dan spiritual diperlukan dalam penanganan kasus tersebut.

Abstract

A conflict involving two or more parties claiming ownership rights to a property is known as a land ownership dispute. Land ownership conflicts, both vertical and horizontal, especially involving Dutch plantation properties, remain unresolved. The purpose of this study is to find out the process of land ownership by the community over the Business Use Rights (HGU) owned by the Goalpara Farm of PT Perkebunan Nusantara VIII, as well as the reasons behind land ownership and efforts to resolve conflicts that may arise. This research was conducted at Taman Goalpara PT Perkebunan Nusantara VIII in Sukaraja, Sukabumi Regency. The normative juridical approach is the methodology used, in which experience produces truth and offers a framework of proof to guarantee the validity of facts. The information used in this study includes, The method used is the Quantitative method, which is to collect data in an organized manner in accordance with the research conducted. Abstract

Crimes against the protection of women and children (Tindak Pidana Perdagangan Anak/TPPA) and human trafficking offences (Tindak Pidana Perdagangan Orang/TPPO) are serious transnational crimes that violate human rights and threaten social order. In Indonesia, TPPA and TPPO cases rose significantly from 2023 to 2024, exposing a persistent gap between legal frameworks and their practical enforcement. This study analyzes the evolution of TPPA and TPPO case handling by reviewing relevant regulations, examining annual case data, and identifying key challenges in the prevention and prosecution of these cases. Adopting a qualitative descriptive approach, this study draws on statistics from the Ministry of Women’s Empowerment and Child Protection and the Indonesian National Police, supplemented by a review of relevant legislation. Findings indicate that while reported cases continue to increase, resolution rates remain low due to the limited availability of specialized personnel, inadequate infrastructure, particularly in remote regions, weak inter-agency coordination, low public awareness, and insufficient victim protection. A notable legal development in 2024 is the creation of a dedicated TPPA and TPPO Directorate within the National Police, aimed at improving investigative procedures, institutional structures, and human resource capacity. The study concludes that stronger regulatory implementation, improved coordination, and comprehensive victim support are essential to address the ongoing enforcement gap.

Abstract

This study explores the challenges and prospects of integrating artificial intelligence (AI) technology into the implementation of Indonesia’s Law No. 17 of 2023 on Health, from both legal and medical practice perspectives. Although the law represents a significant effort to modernize healthcare regulations in line with global developments, it has been criticized for being drafted hastily and for its lack of attention to emerging technologies such as AI. Similarly, Government Regulation (PP) No. 28 of 2024, which serves as an implementing regulation of Law No. 17 of 2023, provides little clarification regarding AI-related provisions. The study identifies several major challenges in AI adoption, including regulatory and legal constraints, technical and infrastructural limitations, and ethical and data privacy concerns. Conversely, the prospects of AI integration within the health sector include potential gains in efficiency and diagnostic accuracy, innovations in HealthCare delivery, and increased support from both governmental and private sectors. Furthermore, insights from legal practitioners and medical professionals are analyzed to present a holistic understanding of AI implementation in Indonesia’s healthcare system. The findings suggest that AI holds substantial potential to transform Indonesia’s healthcare sector; however, its success depends on the establishment of a specific, comprehensive, and adaptive regulatory framework. Accordingly, this study recommends the formulation of supportive policies and regulations, strategies to address existing barriers, and directions for future research on AI in healthcare.

Abstract

The application of the reverse burden of proof in money laundering cases, particularly regarding the proof of predicate crimes, remains a subject of debate among legal scholars. This is due to concerns that it contradicts the presumption of innocence and may potentially violate human rights. This study aims to analyze the regulation of the reverse burden of proof in money laundering crimes under Indonesian law and to explore alternative approaches concerning predicate crimes. The research employs a normative legal method using statutory and comparative approaches, supported by primary, secondary, and tertiary legal materials. The findings reveal that Indonesia’s reverse burden of proof system is adapted from Anglo-Saxon legal systems, but its implementation remains limited. In its countries of origin, the system is more balanced—both the prosecutor and the defendant bear the burden of proof, and civil proceedings are used to recover criminal assets. In contrast, Indonesia has yet to adopt the civil route, and there is no specific procedural law governing this system, reducing its effectiveness. As an alternative, the "balance of probabilities" principle is proposed to better align the protection of individual rights with asset recovery efforts, thereby enhancing the effectiveness of anti-money laundering enforcement.
