Abstract

Transformasi digital telah membawa dampak signifikan terhadap dunia hukum, khususnya dalam konteks etika profesi. Digitalisasi menuntut profesi hukum untuk tidak hanya menguasai teknologi, tetapi juga menafsirkan ulang nilai-nilai dasar etika seperti integritas, tanggung jawab, dan independensi. Penelitian ini bertujuan untuk menganalisis dinamika etika profesi hukum dalam menghadapi tantangan era digital dengan fokus pada tiga pilar utama tersebut. Metode yang digunakan adalah studi pustaka dengan pendekatan kualitatif, yang menganalisis sepuluh artikel ilmiah dan berbagai dokumen hukum yang relevan. Hasil penelitian menunjukkan bahwa digitalisasi menimbulkan berbagai tantangan etis baru, termasuk pelanggaran privasi data, bias algoritmik, dan penyalahgunaan media sosial oleh praktisi hukum. Temuan ini menunjukkan bahwa pembaruan kode etik, peningkatan literasi digital, dan reformasi pengawasan etik sangat diperlukan. Penelitian ini merekomendasikan integrasi nilai-nilai etis ke dalam praktik hukum berbasis teknologi guna menjaga profesionalisme dan legitimasi hukum di era digital

Abstract

Child care after divorce is an important aspect in the context of Islamic family law. This article examines various aspects of parenting after divorce, with a focus on the Islamic legal framework. Through an analysis of the perspective of Islamic family law, this article discusses the rights and obligations of parents towards children, the role of the court in determining parenting, as well as the principles that guide the process of parenting children after divorce. This research aims to provide an in-depth understanding of Islamic family law concepts related to child care, as well as their implications for children's welfare in divorce situations. The conclusion of this article provides insight into how Islamic family law regulates child care after divorce by paying attention to legal, ethical aspects and the best interests of the child.

Abstract

This study examines how the childfree principle of the decision not to have children can be accepted or rejected from the perspective of the interpretation of the Qur'an through the thoughts of Asma Barlas. As a Muslim feminist, Barlas interprets the Qur'an by emphasizing gender equality and individual rights, and criticizes the patriarchal bias in traditional Islamic interpretation. Using a qualitative descriptive-analytical approach, this study discusses the interaction between the childfree principle and Islamic teachings on procreation and family. Through an analysis of relevant verses and Barlas's ideas, this study shows that the childfree decision can be seen as a legitimate personal choice as long as it considers social and ethical responsibilities. This study also assesses the implications of the childfree decision for spiritual and social values in Islam, and emphasizes the contribution of Barlas's thought in expanding the understanding of freedom and gender justice within the framework of the Qur'anic teachings. The significance of this research lies in its effort to enrich contemporary exegetical discourse with a contextual feminist perspective, opening a space for dialogue between modern individual values ​​and Islamic moral principles, and providing a theoretical basis for reinterpreting the role of women and the family in modern Muslim society.
