Abstract

This study aims to analyze the regulation and implementation of marital agreements under the Indonesian Marriage Law and to examine the legal considerations of the Supreme Court in Decision Number 1362 K/Pdt/2024. This research employs a normative juridical method. The findings indicate that in Decision Number 1362 K/Pdt/2024, the Supreme Court affirmed that a prenuptial agreement containing an imbalanced clause where all marital assets become the wife’s property while all obligations are imposed upon the husband contradicts the principle of balance (the principle of equality). This decision emphasizes that freedom of contract in marital agreements is not absolute, but must be limited by the principles of substantive justice and the protection of the weaker party.

Abstract

Penelitian ini mengkaji perlindungan hukum yang tersedia bagi mereka yang mengalami kekerasan dalam rumah tangga (KDRT), dilihat melalui lensa hukum pidana Indonesia, dengan fokus pada periode setelah implementasi Undang-Undang Nomor 23 Tahun 2004 yang membahas pemberantasan kekerasan dalam rumah tangga (UU PKDRT). Tujuan penelitian ini adalah untuk menilai bagaimana hukum pidana menawarkan perlindungan kepada individu yang terdampak kekerasan dalam rumah tangga, untuk mengevaluasi efektivitas penegakan hukum di dunia nyata, dan untuk mengeksplorasi tantangan yang dihadapi dalam memastikan perlindungan hukum. Metodologi penelitian yuridis normatif, yang mencakup kerangka legislatif yang relevan, wawasan dari para ahli, dan putusan pengadilan, digunakan. Temuan penelitian menunjukkan bahwa meskipun UU PKDRT telah menetapkan struktur hukum yang lebih baik dan lebih menyeluruh, berbagai elemen seringkali menghambat perlindungan korban, termasuk keberadaan norma sosial patriarki yang signifikan, tantangan dalam penegakan hukum selama fase investigasi dan persidangan, dan kurangnya pemahaman publik tentang hukum. Kesimpulan Meskipun Undang-Undang Kekerasan Dalam Rumah Tangga telah menciptakan kerangka hukum yang komprehensif, perlindungan korban seringkali terhambat oleh beberapa faktor. Temuan menunjukkan peningkatan tindakan katarsis (pemenjaraan pelaku) dibandingkan dengan perlindungan preventif seperti "rumah aman". Tantangan utama meliputi norma sosial patriarki yang kuat yang menyamakan kekerasan dalam rumah tangga, hambatan khusus terhadap investigasi dan persidangan, dan rendahnya pemahaman publik tentang hukum. Penegakan hukum yang efektif tetap terhambat oleh lambatnya kolaborasi kelembagaan dan stigma sosial.

Abstract

The Indonesia-Canada Comprehensive Economic Partnership Agreement (ICA-CEPA) is a comprehensive trade agreement that stands under the framework of the GATT 1994, specifically Article XXIV, which regulates the establishment of free trade areas and customs unions. The purpose of this article is to examine Indonesia's position in the ICA-CEPA negotiations from the perspective of international trade law and assess whether the provisions of the GATT provide sufficient space for Indonesia to protect its national interests. This study uses a normative-critical approach with an analysis of international laws and agreements, as well as a policy review related to the mechanism of revocation and postponement of agreements. The results of the analysis show that the GATT 1994, in particular Article XXIV, only provides a legal basis for the establishment of the ICA-CEPA, but does not clearly regulate the clause for the revocation or postponement of the implementation of the agreement. These provisions are entirely dependent on the text of the ICA-CEPA itself, so Indonesia has limited power to terminate or suspend the agreement if it is proven to have a severe negative impact on the economy and the sovereignty of domestic regulations. This article argues that the absence of a strong legal basis in the 1994 GATT makes the ICA-CEPA potentially serve more as a trade political tool that benefits Canada, while Indonesia is in a less protected position within the structure of the agreement.
