Abstract

Public service is a form of service that is principally the responsibility of and implemented by Government Agencies. One form of public service carried out by the government is related to investment licensing, namely through Online Single Submission (OSS). Online Single Submission (OSS) is a Business License issued for and on behalf of the minister, head of institution, governor, or regent/mayor to Business Actors through an integrated electronic system. However, the concern is whether Online Single Submission (OSS) will facilitate investment licenses or instead make it difficult in public services and whether Online Single Submission (OSS) is sufficiently safe, reliable and protected by law.This research is a normative juridical research, which is a legal research method carried out by examining library materials or secondary materials such as laws and regulations, books, legal rules and literature related to the formulation of this research problem. The data used is secondary data, which is obtained from primary legal materials, secondary legal materials and tertiary legal materials. The data collection method used in this research is library research by tracing, reading, studying or analyzing materials, theories and concepts. The making and issuance of investment license decree is a legal action of the government. As a legal action, there must be authority granted by legislation or it must be based on the principle of legality. The matter of investment license is regulated in Law No. 23 Year 2014 on Local Government, Law No. 25 Year 2007 on Investment is obtained. Online Single Submission has been categorized as providing improvements in public services but still must receive attention from the government.

Abstract

Notaris berperan sebagai pembuat akta otentik berdasarkan Undang-Undang Jabatan Notaris. Dalam kapasitasnya tersebut, notaris harus memahami ketentuan yang diatur dalam undang-undang agar masyarakat dapat memahami dengan benar, tidak melakukan hal yang bertentangan dengan hukum, serta memberikan kepastian hukum, ketertiban, dan perlindungan hukum bagi masyarakat. Dalam proses pendaftaran HAKI berupa merek, masyarakat boleh saja melalui notaris, tetapi hanya dalam membantu penyusunan dokumen atau memberikan nasihat hukum terkait merek. Namun, untuk bertindak sebagai kuasa pendaftaran merek, legalitas kewenangan notaris harus berizin dan terdaftar sebagai konsultan HKI di Direktorat Jenderal Kekayaan Intelektual (DJKI) Kementerian Hukum dan HAM Republik Indonesia. Pendaftaran merek dilakukan secara resmi melalui DJKI Kementerian Hukum dan HAM Republik Indonesia. Tujuan penulisan ini adalah untuk mengetahui dan mengkaji pengaturan hukum mengenai pendaftaran merek dan legalitas kewenangan notaris sebagai kuasa dalam pendaftaran merek. Metode penelitian yang digunakan dalam tulisan ini adalah penelitian hukum normatif yang bersumber dari data sekunder berupa bahan-bahan hukum. Hasil dalam tulisan ini adalah 1) Pengaturan pendaftaran merek di Indonesia diatur oleh Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 67 Tahun 2016 tentang Pendaftaran Merek.; 2) Secara legal, notaris tidak berwenang menjadi kuasa dalam pendaftaran merek kecuali notaris tersebut sudah terdaftar sebagai Konsultan KI di DJKI. Bertindak sebagai kuasa tanpa izin Konsultan KI dapat dianggap melanggar hukum yang berlaku.

Abstract

The presence of motorbike gangs in Indonesia is one of the disturbing forms of juvenile delinquency. Circumstances such as those previously explained have provided a strong impetus to discuss and look for the best alternative solution in overcoming the problems perpetrated by motorcycle gangs. Therefore, it is very important to respond to the problem of methods and actions to deliver a young generation that is responsible and participates in providing real assistance to the nation and state.

Abstract

Diskriminasi terhadap siswa dari kelompok minoritas sosial, seperti yang terjadi di SMA Swasta Markus Medan, merupakan tantangan serius dalam menciptakan lingkungan pendidikan inklusif dan adil. Ketimpangan perlakuan berdasarkan latar belakang sosial, budaya, atau kemampuan siswa menghambat perkembangan akademis, psikologis, dan hubungan sosial yang sehat. Pendidikan inklusif yang menghargai keberagaman dan memberikan dukungan yang adil sangat diperlukan untuk memastikan setiap siswa berkembang dalam lingkungan aman, nyaman, dan mendukung. Kegiatan pengabdian masyarakat menggunakan metode observasi, presentasi PowerPoint, video edukasi, serta sesi diskusi untuk meningkatkan kesadaran siswa terhadap anti-diskriminasi. Sekolah memiliki tanggung jawab menciptakan lingkungan inklusif di mana keberagaman dihargai dan setiap siswa diperlakukan secara setara. Dengan melibatkan siswa, orang tua, dan masyarakat, pendidikan dapat berperan dalam membangun budaya toleransi dan keadilan sosial. Saran untuk mengatasi isu diskriminasi mencakup penguatan kebijakan inklusif, integrasi pendidikan anti-diskriminasi dalam kurikulum, serta pelatihan rutin bagi guru dan staf sekolah. Dengan langkah-langkah ini, diharapkan diskriminasi dapat ditekan, sehingga semua siswa berkembang secara setara tanpa memandang latar belakang sosial atau budaya mereka.

Abstract

The development of information technology has driven a fundamental shift in the practice of civil agreements through the use of electronic agreements mediated by digital platforms. These changes not only affect the form of the agreement, but also the structure of legal relations, the bargaining position of the parties, and the pattern of accountability for achievement violations. The phenomenon of default in electronic agreements shows a higher complexity than conventional agreements due to the involvement of technological systems and the dominance of digital platforms in controlling the transaction process. This study aims to analyze the juridical construction of electronic agreements and defaults, examine the legal position and scope of responsibility of digital platforms, and examine the implementation of these liability arrangements in positive Indonesian law. The research method used is normative juridical with a legislative, conceptual, and analytical approach, through the review of Law Number 11 of 2008 concerning Electronic Information and Transactions as amended by Law Number 1 of 2024, Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions, and Government Regulation Number 80 of 2019 concerning Trade Through Electronic Systems. The results of the study show that digital platforms cannot be positioned as neutral intermediaries because they have significant control over the transaction ecosystem. Existing arrangements have not established an integrated liability regime, thus opening up space for legal uncertainty and inequality of protection for users. This research emphasizes the urgency of the normative reconstruction of the legal responsibility of digital platforms oriented towards contractual fairness and proportionate risk distribution

Abstract

In a global era marked by the climate crisis, social pressures, and demands for corporate transparency, the principles of Environmental, Social, and Governance (ESG) have evolved into strategic instruments in the capital market legal system. ESG no longer just reflects ethical preferences, but has become an objective parameter that is juridically recognized by regulators and investors in assessing a company's performance holistically. This study aims to examine the position and normative implications of ESG in the context of Law Number 8 of 1995 concerning the Capital Market, as well as its implementing regulations. The method used is normative juridical, with a legislative, conceptual, and limited comparative approach. The results of the study show that although ESG has not been explicitly regulated in the Capital Market Law, the principles of information disclosure and investor protection provide a basis for legitimacy for the implementation of ESG, which is strengthened by regulations such as POJK No. 51/POJK.03/2017. ESG also reflects the embodiment of the principles of Good Corporate Governance, as well as acting as a non-financial risk mitigation mechanism. Within a dynamic legal framework, ESG serves as an evolutionary form of capital market principles, which combine administrative and substantial compliance. Therefore, strengthening ESG regulations is a normative urgency in building an integrity, competitive, and sustainable Indonesian capital market.

Abstract

Increasing global awareness of the climate crisis has driven a paradigm shift in development towards a sustainability-oriented green economy. Indonesia, as a party to the Paris Agreement and an implementer of the Sustainable Development Goals, is obliged to integrate sustainability principles into its investment policies. Legal certainty is a key pillar to create a stable and predictable investment climate, especially in long-term sectors such as renewable energy, sustainable natural resource management, and environmentally friendly infrastructure. This research uses normative juridical methods with legislative, conceptual, and comparative approaches, examining Law No. 25 of 2007, Law No. 32 of 2009, as well as international best practices such as the EU Taxonomy and Singapore's Green Finance Action Plan. The results of the study show that even though Indonesia already has a Green Taxonomy, its implementation is still limited, hampered by regulatory disharmony, weak institutional capacity, and the risk of greenwashing. The recommendations included the establishment of a nationally binding green taxonomy, coordination of central-regional policies, competitive legal and fiscal incentives, and firm law enforcement. This effort is expected to strengthen the competitiveness of Indonesia's green investment at the global level while ensuring a balance between economic growth, environmental protection, and social welfare
