Abstract

Abstract

ABSTRACT In a franchise business, in general, it requires an agreement where the existing agreement is a standard agreement that has been made in advance by the franchisor. The franchisee when agreeing to the offered franchise business must be subject to the existing agreement. This should also apply to franchise businesses offered online. A written agreement is one aspect of legal protection to the parties from harming other parties, this is because the agreement can be a strong legal basis for enforcing legal protection for the parties involved in the franchise system, if one party violates the contents of the agreement, then the other party may sue the infringing party in accordance with applicable law

Abstract

The treatment of children in conflict with the law is a critical component of efforts to achieve restorative justice, as mandated by Law No. 11 of 2012 on the Juvenile Criminal Justice System (SPPA). The Special Child Development Institution (Lembaga Pembinaan Khusus Anak, LPKA) Class II Pangkalpinang holds a strategic role in carrying out rehabilitation programs aimed at protecting children’s rights and preparing them for reintegration into society. This study employs an empirical juridical method with a qualitative approach, incorporating document analysis, interviews, and direct observation of the rehabilitation programs implemented at LPKA Class II Pangkalpinang. The findings reveal that although rehabilitation programs, such as formal education, skills training, and personality development, are conducted in line with the principles of restorative justice, their effectiveness is hindered by limitations in human resources and supporting facilities. These constraints significantly affect the psychosocial development of the juvenile inmates. This study concludes that the rehabilitation programs at LPKA Class II Pangkalpinang have made positive contributions to fulfilling the rights of children in conflict with the law. However, achieving optimal outcomes necessitates improving staff competencies, providing adequate facilities, and strengthening cross-sectoral cooperation to fully realize the goals of the rehabilitation programs. The findings contribute to the existing body of knowledge on juvenile justice systems by offering an in-depth analysis of the practical challenges faced in implementing restorative justice principles within institutional settings. Additionally, this study provides actionable insights for policymakers and practitioners to enhance the effectiveness of rehabilitation programs, emphasizing the need for systemic and multi-sectoral collaboration to support the reintegration process.

Abstract

This article aims to examine how the extension of the term of office of village heads in Law Number 3 of 2024 raises debates related to democracy and constitutionalism. This policy extends the term of office from six to eight years with a maximum of two terms, potentially inhibiting leadership regeneration and community political participation. From the perspective of constitutionalism, this policy can weaken checks and balances and increase the risk of abuse of authority. This research uses a normative juridical method by analyzing related regulations and a historical approach to trace the evolution of regulations. Data is obtained through document studies with descriptive-analytical analysis to assess the alignment of this policy with democratic principles. The results show that extending the term of office of the village head can reduce the accountability and transparency of the village government. A strict monitoring mechanism is needed so that this policy does not open a gap for abuse of power, as well as harmonization of regulations to ensure that village governance remains democratic and accountable.

Abstract

The Correctional Service has established various policies and regulations to regulate the running of the correctional system that focuses more on fostering and social reintegration, especially for children who are facing the law. The purpose of this study is to analyze the implementation of social reintegration in LPKA Class II Pangkalpinang, based on Law Number 22 of 2022, with a focus on the factors that affect the success and challenges faced in the social reintegration process for children facing the law. This research method uses a qualitative approach with the type of case study research. The results of this study show that the implementation of social reintegration in LPKA Class II Pangkalpinang still faces various challenges that affect its success. One of the main factors found is the limited facilities that support the development of children who are facing the law. Based on the data, only 30% of children get full access to adequate practical skills training and psychological coaching. In addition, the shortage of trained educators and supervisors has also worsened the effectiveness of the reintegration program. Only 40% of respondents stated that the supervisors at LPKA have enough skills to provide comprehensive assistance, both in educational and psychological aspects. Without any improvement in this regard, the social reintegration of newly freed children will remain limited. In addition, external factors such as social stigma and lack of support from the community and family are also significant obstacles. Based on a survey of the community around LPKA, only 20% of the community showed an open attitude and supported the social reintegration of children after they were released

Abstract

Abstract

This community service activity aims to improve product packaging quality and enhance understanding of food safety among MSME actors and vocational high school students in Tukak Village, South Bangka Regency. The main problems faced by local MSMEs include the use of simple packaging that does not meet food safety standards and the limited understanding of hygienic production practices. The activity was carried out through lectures, interactive discussions, and hands-on practice involving 50 participants. The pre-test and post-test evaluations showed a significant increase in participants’ knowledge, rising from an average of 45% to 85%. In addition, technical skills such as selecting food-grade packaging materials, sealing techniques, sanitation and hygiene practices, and designing product labels also improved substantially. The attendance rate, participation, and enthusiasm of the participants demonstrated that the training methods implemented were effective and relevant to the needs of the MSMEs. This program contributed significantly to enhancing the competitiveness of local businesses while preparing vocational students as competent young entrepreneurs. The recommendations include the need for ongoing mentoring, improved access to quality packaging materials, and advanced training related to food product licensing.
