Abstract

This study explores Savings and Loan Cooperatives' legal protection in dealing with cooperative member defaults and the legal basis for resolving default issues between cooperatives and their members in compliance with existing law. The research method utilised to analyse these issues is normative legal research utilising statutory and conceptual approaches. Our legal material collection method is a literature study. Analysis of legal materials is deductive. A main premise is needed for deductive reasoning. Next, a small premise. Two premises lead to a conclusion. As a result of the research, the Savings and Loan Cooperative cannot be separated from a binding agreement between the Savings and Loan Cooperative and its members in providing credit.where the preparation of the agreement must be clear and firm including the rights and obligations of both parties in detail, including the terms of loan repayment in the content of the clause of the agreement This is very important to prevent default and protect the interests of the Savings and Loan Cooperative and its members. Where as a basis, Article 1320 of the Civil Code and Article 1338 paragraph 1 of the Civil Code are further explained in 1321 of the Civil Code and Article 1243 of the Civil Code, where basically the Savings and Loan Cooperative uses anticipatory measures to ensure that the agreement between the Savings and Loan Cooperative and its members is made legally and without elements of legal defect in order to minimize the occurrence of default. For repressive measures of the Savings and Loan Cooperative (KSP) in Dealing with Cases of Default of Its Members, it can be explained in Articles 1239 of the Civil Code and 1243 of the Civil Code, which are further explained in Articles 1244, 1246 and 1247 of the Civil Code, the settlement of default disputes between Savings and Loan Cooperatives and their members is regulated in Articles 1234, Article 1313, Article 1238, Article 1236 and Article 1266 of the Civil Code which explain that in essence Savings and Loan Cooperatives have certainty law in.

Abstract

Abstract Transportation plays a crucial and strategic role in supporting national development. Although certain areas may be geographically isolated, an effective and efficient transportation system can overcome these challenges and support societal activities. With advancements in technology, design, and types of transportation, the demand for private vehicles, such as cars and motorcycles, has risen. However, the phenomenon of private cars being used for passenger and/or goods transportation without proper route permits or business licenses creates legal issues. This practice contradicts the provisions of Law No. 22 of 2009 on Traffic and Road Transportation, specifically Article 173, paragraph (1) letter b. This study aims to identify the factors that cause private vehicles to operate as public transport and to evaluate the role and efforts of the Pontianak Transportation Agency in monitoring and regulating private vehicles operating as public transport. A socio-legal approach was employed in this research. The findings indicate that the use of private cars as public transportation between Pontianak and Singkawang is prevalent, driven by factors such as limited job opportunities and economic needs. The Transportation Agency has conducted raids and enforcement, despite facing personnel shortages. Violators face sanctions, including warnings, administrative fines, or revocation of licenses, in accordance with applicable laws and regulations. Abstrak Transportasi sebagai sarana perhubungan memiliki peranan yang sangat penting dan strategis dalam mendukung pembangunan nasional. Meskipun suatu daerah mungkin terisolasi akibat letak geografisnya, sistem transportasi yang efektif dan efisien mampu mengatasi tantangan tersebut dan mendukung aktivitas masyarakat. Seiring dengan kemajuan teknologi, desain, serta jenis dan sarana transportasi, kebutuhan masyarakat akan kendaraan pribadi, seperti mobil dan motor, juga meningkat. Namun, fenomena penggunaan mobil pribadi untuk layanan angkutan penumpang dan/atau barang di luar trayek tanpa izin usaha dan trayek yang sah menimbulkan permasalahan hukum. Fenomena ini bertentangan dengan ketentuan dalam Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan, khususnya Pasal 173 ayat (1) huruf b. Penelitian ini bertujuan untuk mengidentifikasi faktor-faktor yang menyebabkan kendaraan pribadi beralih menjadi kendaraan umum serta untuk mengevaluasi peran dan upaya Dinas Perhubungan Kota Pontianak dalam mengawasi dan menertibkan kendaraan pribadi yang beroperasi sebagai angkutan umum. Metode yang digunakan dalam penelitian ini adalah pendekatan sosio-legal. Hasil penelitian menunjukkan bahwa fenomena mobil pribadi yang beroperasi sebagai angkutan umum marak terjadi di Kota Pontianak menuju Singkawang, yang disebabkan oleh berbagai faktor seperti terbatasnya lapangan pekerjaan dan kebutuhan ekonomi. Dinas Perhubungan telah melakukan razia dan penertiban meskipun menghadapi kendala kekurangan personel. Pelaku usaha yang melanggar akan dikenakan sanksi sesuai peraturan perundang-undangan, yang dapat berupa peringatan, denda administratif, atau pencabutan izin.

Abstract

ABSTRAKPenelitian ini didorong oleh meningkatnya penggunaan teknologi kecerdasan buatan (AI) dalam proses penciptaan karya kreatif. Kasus viral “Tung Tung Sahur” yang menggambarkan ciptaan audio dengan bantuan teknologi AI menimbulkan polemik terkait siapa yang berhak atas karya tersebut. Rumusan masalah yang diangkat adalah bagaimana perlindungan hukum terhadap karya yang dihasilkan dengan bantuan AI serta bagaimana urgensi reformulasi Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dalam menghadapi tantangan teknologi tersebut. Tujuannya untuk menganalisis kesesuaian hukum positif Indonesia terhadap perkembangan AI dalam ranah Hak Kekayaan Intelektual (HKI), khususnya hak cipta.Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual. Teknik analisis data dilakukan secara kualitatif, dengan menelaah peraturan perundang-undangan yang relevan, literatur hukum, dan studi kasus terkini. Teori utama yang digunakan adalah teori keadilan distributif dalam hukum kekayaan intelektual serta teori personhood dalam hak cipta.Hasil penelitian menunjukkan bahwa sistem hukum hak cipta di Indonesia belum secara eksplisit mengakomodasi karya berbantuan AI, sehingga menciptakan kekosongan hukum dan ketidakpastian bagi para pencipta dan pengguna. Oleh karena itu, diperlukan reformulasi regulasi yang mengatur batas peran AI dalam proses penciptaan dan mekanisme atribusi hak cipta agar tetap menjamin perlindungan hukum dan keadilan bagi para pihak yang terlibat. Kata kunci: Hak Cipta, Karya Berbantuan AI, Reformasi Undang-Undang, Kreativitas Digital, Kasus "Tung Tung Sahur", Perlindungan Hukum

Abstract

Penelitian ini menganalisis perbandingan hukum antara pembiayaan modal ventura dan pembiayaan al-musyarakah terhadap perusahaan pasangan usaha dalam kaitannya dengan pembagian keuntungan modal. Tujuan penelitian ini adalah untuk memahami kesamaan dan perbedaan aspek hukum kedua bentuk pembiayaan tersebut. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach), metode penelitian, termasuk tinjauan pustaka dan analisis induktif, untuk mengumpulkan data. Temuan penelitian menunjukkan bahwa pembiayaan modal ventura melibatkan investasi di perusahaan dengan tujuan pembagian keuntungan sesuai dengan formula yang disepakati, sedangkan pembiayaan al-musyarakah dicirikan oleh kerja sama antara nasabah dan lembaga keuangan Islam untuk membagi keuntungan dan membagi risiko.. Kedua bentuk pembiayaan ini sama-sama memiliki karakteristik risiko tinggi karena menempatkan penyertaan modal sebagai dasar pembagian keuntungan dan kerugian. Temuan ini menegaskan pentingnya kejelasan klausul perjanjian untuk menjaga keseimbangan hak dan kewajiban para pihak serta meminimalkan potensi kerugian. Abstract

The rapid development of the digital economy, marked by the adoption of pricing algorithms, has introduced new dynamics to Indonesia's competition law landscape. Algorithmic systems enable autonomous price setting based on market data learning without direct human intervention. This condition potentially gives rise to algorithmic cartels, a form of market coordination occurring without explicit agreement, yet producing anti-competitive effects similar to conventional cartels. The national legal framework, specifically Law No. 5 of 1999 and KPPU Regulation No. 4 of 2010, remains inadequate to address this phenomenon, as it is still anchored to a traditional paradigm requiring the element of “agreement” as a prerequisite for proving violation. This study aims to analyze the dilemma faced by the regulator (KPPU) in proving the existence of algorithmic cartels against the principle of fair competition in the digital era. Employing a normative juridical approach, this study examines relevant legislation, academic literature, and international policies from the OECD and European Commission. The findings indicate a regulatory gap in Indonesia's competition law regarding proof involving autonomous systems. Furthermore, the KPPU faces conceptual and technical obstacles in determining legal intent (legal intent) and the validity of digital evidence derived from algorithmic systems. The study concludes that proving algorithmic cartels must shift from an intent-based approach to an effects-based approach, which focuses on assessing the economic impact on market structure and consumer welfare. Therefore, strategic recommendations include reinterpreting the element of “agreement” in Article 1, paragraph 7, and Article 11 of Law No. 5 of 1999 to encompass algorithmic coordination that generates anti-competitive effects. Additionally, the KPPU is mandated to develop digital evidence guidelines and strengthen the multidisciplinary institutional capacity to effectively oversee algorithmic behavior. These steps are crucial for Indonesian competition law to adapt to the realities of the digital economy while ensuring justice and legal certainty.
