Abstract

Regional Head Elections (Pilkada) often encounter disputes that impact political stability and public trust. This study compares siyasah law and positive law in resolving Pilkada disputes. Positive law, based on formal regulations, emphasizes legality and transparency through institutions like the Constitutional Court. Conversely, siyasah law, rooted in sharia principles, offers a deliberation-based approach focusing on communal welfare. The analysis reveals that positive law excels in legal certainty but lacks adaptability to local contexts, while siyasah law is more flexible but faces challenges in implementation within a plural society. This study recommends integrating both approaches to establish a more equitable, effective, and community-responsive dispute resolution mechanism for Pilkada.

Abstract

The dissolution of the mass organization Hizbut Tahrir Indonesia (HTI) by the Indonesian government in 2017 has generated significant discourse concerning its legal foundations and implications from the perspective of Fiqh Siyasah Dusturiyah (Islamic Constitutional Jurisprudence). This decision was enacted through Government Regulation in Lieu of Law (Perppu) Number 2 of 2017, which amended Law Number 17 of 2013 on Community Organizations. The government justified this action by asserting that HTI's activities were incompatible with the principles of Pancasila and the 1945 Constitution, and posed a potential threat to the unity and integrity of the Unitary State of the Republic of Indonesia (NKRI). From the lens of Fiqh Siyasah Dusturiyah, this measure can be interpreted as an initiative to safeguard public welfare (maslahah) and prevent harm (dar’u al-mafasid), aligning with Islamic political principles that emphasize the importance of national stability and security. Nevertheless, the dissolution has also ignited debates surrounding the protection of fundamental rights, particularly freedom of association and expression, within the framework of a democratic state governed by the rule of law. This tension highlights the complex interplay between state authority, constitutional principles, and the protection of civil liberties in a pluralistic society.

Abstract

Pelaksanaan pemerintahan desa masih terdapat kekurangan dalam pelaksanaan pelayanan publiknya terutama dalam memberikan layanan prima kepada masyarakat. Isu riset terkait bagaimana profesionalisme dan fungsi administrasi desa dalam upaya untuk meningkatkan pelayanan warga. Penelitian ini menggunakan pendekatan sosio legal riset dengan memanfaatkan data kualitatif lapangan melalui observasi, wawancara, dan dokumentasi. Analisa data dilakukan mulai dari reduksi data, penyajian data, dan menarik kesimpulan. Hasil dari penelitian ini menunjukkan bahwa Profesionalisme aparat desa dapat dipahami dari kepatuhannya dan kompetensi dibidangnya. Dalam tugas administrasinya dapat dilihat dari semangat kinerja yamg dibuktikan dengan pelayanan yang tepat serta responsif terhadap warganya. Sedangkan upaya meningkatkan profesionalisme dilakukan dengan pembinaan, evaluasi, pengawasan dan pendisilinan.
