Abstract

State sovereignty over airspace according to international law is complete and comprehensive. However, in practice, the use of unmanned aircraft (drones) has not been specifically regulated through international regulations or conventions. The slow development of drone regulations is due to the absence of laws and standards from the International Civil Aviation Organization (ICAO). This study aims to examine the legality of drones crossing state borders and Yemen's responsibility for the actions of the Houthi rebels. This study uses a normative legal method with a descriptive approach, using secondary data analyzed qualitatively, and drawing conclusions deductively. The results of the study show that although drones are equated with aircraft in their regulations, the term drone has not been explicitly regulated in national or international air law.

Abstract

The application of the ITE Law in defamation cases is closely related to how the state maintains a balance between protecting press freedom and respecting individual rights to a good name, with the creation of this scientific work which focuses on the discussion, How Press Freedom Affects Criminal Liability in Defamation Crimes in Online Media and Why the Application of the ITE Law Affects Reporting Accountability in Online Media which will later aim at studying how press freedom guaranteed by law in Indonesia, such as Law No. 40 of 1999 concerning the Press, affects criminal liability in defamation cases in online media, and how the limits of press freedom are applied in the digital space. This study uses a normative juridical method with a statutory and conceptual approach. The primary legal sources used are Law No. 40 of 1999 concerning the Press and Law No. 19 of 2016 concerning Information and Electronic Transactions (UU ITE). Freedom of the press plays a vital role in democracy, but in the context of online defamation crimes, limits must be applied to maintain a balance between freedom of expression and protection of an individual’s reputation. Law Number 40 of 1999 concerning the Press and Article 27 paragraph (3) of the ITE Law provide the legal framework governing these freedoms and limits.

Abstract

The application of differentiated criminal liability by investigators in handling collective assault cases represents the implementation of justice and individualization principles in Indonesia’s criminal law system. This principle requires that each offender be held accountable according to their level of culpability, intent, and contribution to the offense. Juridically, the legal basis for applying this differentiation lies in Articles 55 and 56 of the Indonesian Criminal Code (KUHP) concerning participation, Article 170 KUHP concerning group assault, and Articles 1(2) and 7(1)(a) of the Criminal Procedure Code (KUHAP), which authorize investigators to assess and determine the role of each participant. Additionally, this principle is grounded in the constitutional guarantee of justice under Article 28D(1) of the 1945 Constitution of the Republic of Indonesia and the principle of proportionality as stipulated in National Police Regulation No. 6 of 2019 on Criminal Investigation. Through the implementation of differentiated criminal liability, investigators are expected to uphold law enforcement that is fair, professional, and proportional thus preventing over-criminalization and ensuring substantive justice for all individuals involved in joint assault crimes.

Abstract

Penelitian ini bertujuan untuk menganalisis tanggung jawab hukum wartawan dan media dalam konteks delik pidana yang berkaitan dengan praktik jurnalistik di Indonesia. Dengan menggunakan pendekatan hukum normatif, penelitian ini mengkaji berbagai peraturan perundang-undangan yang mengatur tentang delik pers, termasuk Undang-Undang Nomor 40 Tahun 1999 tentang Pers dan Kitab Undang-Undang Hukum Pidana (KUHP). Hasil penelitian menunjukkan bahwa meskipun terdapat jaminan kebebasan pers, wartawan tetap berisiko menghadapi tuntutan hukum terkait pencemaran nama baik dan penghinaan. Kasus-kasus terkini, seperti vonis terhadap jurnalis Muhammad Asrul, menyoroti tantangan yang dihadapi wartawan dalam menjalankan tugasnya, di mana penyelesaian sengketa pers seharusnya diselesaikan melalui Dewan Pers, bukan pengadilan. Penelitian ini merekomendasikan perlunya penegakan hukum yang lebih konsisten terhadap ketentuan yang ada, serta perlindungan yang lebih kuat bagi wartawan untuk menjaga kebebasan berekspresi dan integritas media di era digital.
