Abstract

The Islamic capital market is currently growing rapidly as an investment alternative that is in accordance with Islamic principles. However, this growth is also accompanied by the rampant cases of fraudulent investments that harm investors and threaten the credibility of the Islamic capital market. This article discusses the challenges of regulation and strategies for optimizing investor protection in dealing with fraudulent investments in the Islamic capital market. Using a juridical-normative approach, this study analyzes the applicable regulations, weaknesses in supervision, and prevention efforts that have been carried out by relevant authorities such as the Financial Services Authority (OJK), the Indonesia Stock Exchange (IDX), and the National Sharia Council-Indonesian Ulema Council (DSN-MUI). The results of the study indicate that although Islamic capital market regulations in Indonesia have developed, there are still gaps in supervision and investor protection mechanisms, especially in terms of early detection and law enforcement against illegal investments. Therefore, it is necessary to optimize regulations by strengthening supervision mechanisms, increasing Islamic financial literacy, and utilizing technology such as Regulatory Technology (RegTech) in detecting and preventing fraudulent investments. With these steps, it is expected that the Islamic capital market can be more trusted, transparent, and able to provide better protection for investors.

Abstract

Penelitian ini mengeksplorasi pelaksanaan layanan financial technology (fintech) berbasis peer to peer lending (P2P lending) dalam kerangka hukum yang berlaku di Indonesia. Di tengah pesatnya perkembangan digital, P2P lending muncul sebagai alternatif pembiayaan yang praktis dan efisien. Namun, model ini juga memunculkan berbagai isu hukum, terutama menyangkut aspek perlindungan bagi investor (lender) maupun penerima dana (borrower). Tujuan dari penelitian ini adalah untuk mengkaji keberlanjutan praktik P2P lending, dampaknya terhadap para pemodal, serta bentuk perlindungan hukum yang tersedia bagi kedua belah pihak. Dengan menggunakan pendekatan yuridis normatif dan metode deskriptif kualitatif melalui studi literatur, penelitian ini menemukan bahwa meskipun telah terdapat regulasi dari OJK, masih terdapat berbagai kelemahan seperti risiko gagal bayar, penyalahgunaan data, dan minimnya transparansi informasi. Oleh karena itu, diperlukan peningkatan regulasi dan pengawasan agar perlindungan hukum terhadap seluruh pihak dalam transaksi fintech dapat terlaksana secara menyeluruh dan efektif.

Abstract

Digital transformation in the Islamic financial sector through the use of technology-based financing applications presents new dynamics in the legal relationship between business actors and consumers. This study aims to construct a legal protection model for consumers in the use of digital Islamic financing products, with a normative legal approach based on national laws and regulations, fatwas of the National Sharia Council–Indonesian Ulema Council (DSN–MUI), and the principles of Islamic economic law. The findings show that existing regulations are still partial and have not fully accommodated the complexity of application-based transactions, especially in terms of transparency of contracts, protection of personal data, and dispute resolution mechanisms. Therefore, integration between positive legal norms and the values of maqāṣid al-sharī‘ah is needed in order to realize a consumer protection system that is fair, proportional, and in accordance with the characteristics of Islamic finance in the digital era. Abstract

The Financial Services Authority (OJK) is an independent institution established under Law Number 21 of 2011. Its primary purpose is to implement an integrated system of regulation and supervision over all activities within the financial services sector. This study employs a normative legal research method through literature review and document analysis. The findings indicate that OJK's main duties include regulating, supervising, inspecting, and investigating activities across the financial services sector, which covers banking, capital markets, and non-bank financial institutions. OJK’s authority includes formulating policies, granting business licenses, monitoring compliance, and protecting the rights of consumers in the financial services industry.

Abstract

The emergence of cryptocurrencies as a new financial instrument challenging the established financial system has been aided by advances in digital technology. By examining how well cryptocurrency transactions comply with sharia principles such as gharar, maysir, and riba, this study seeks to assess the idea from the perspective of Islamic Economic Law. A conceptual study based on literature analysis from several academic sources, rulings, and fatwas of scholars is the research methodology used. Thus, the results of the study indicate that cryptocurrencies have characteristics that raise legal questions in Islam, especially regarding their extreme volatility and speculative potential. While some scholars define them as digital assets that can be traded under certain conditions, others consider them haram because they contain elements of gharar and maysir. Therefore, to ensure that bitcoin transactions comply with the principles of Islamic Economic Law, more appropriate laws and sharia-based strategies are needed.

Abstract

This article analyzes the differences between conventional banking and Islamic banking systems in Indonesia, focusing on their operational principles and products. Indonesia, as a country with a large population and a Muslim majority, has two banking systems, namely conventional banking and Islamic banking. This article aims to provide a better understanding of these two banking systems and their implications for the development of an inclusive and sustainable financial system in Indonesia.

Abstract

In facing the challenges of globalization and increasing financial crimes such as money laundering and terrorism financing, the Know Your Customer (KYC) principle is an important pillar in maintaining the integrity of the financial system in Indonesia. This article analyzes the legal aspects of the application of the KYC principle in Indonesian banking institutions using a normative legal approach. The study was conducted on various regulations that serve as the legal basis, including Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering, as well as regulations from the Financial Services Authority and Bank Indonesia. The findings show that although the legal framework is available and the implementation of KYC has made a significant contribution to identifying and preventing suspicious transactions, there are still implementation challenges such as limited human resources, technology gaps, and ownership of official documents by customers. To increase the effectiveness of KYC, it is necessary to increase human resource capacity, utilize advanced technology, and strengthen cross-country cooperation in combating financial crimes.

Abstract

Sharia economic law has become a crucial pillar in the development of the economy in Indonesia, particularly in the context of entrepreneurship. This article aims to analyze the role of sharia economic law in promoting the growth of entrepreneurship in Indonesia, focusing on the fundamental sharia principles underlying economic transactions. Through a qualitative approach, this study explores various sharia financing products, such as murabahah, musyarakah, and mudharabah, which provide better financing access for entrepreneurs, especially among communities underserved by conventional financial systems. Additionally, this article discusses the challenges faced in implementing sharia economic law and provides recommendations to enhance understanding and application of sharia principles in the entrepreneurial world. The research findings indicate that sharia economic law not only contributes to increased access to financing but also promotes innovation and sustainability in entrepreneurial practices. Thus, the role of sharia economic law is highly significant in creating and realizing an inclusive and sustainable entrepreneurial ecosystem in Indonesia

Abstract

Sharia Pawnshop plays a strategic role in strengthening national economic resilience by providing fair, transparent, and interest-free Sharia-based financing access. Through rahn and ijarah contracts, it helps communities, especially SMEs, obtain capital without the burden of interest, thereby supporting sustainable economic growth. Digitalization of services further expands financial inclusion and facilitates public access to Sharia-compliant financing. The findings show that Sharia Pawnshop serves as a crucial instrument in building an economy based on Islamic values, emphasizing justice, welfare, and blessings in financial transactions.

Abstract

The development of information technology has driven the transformation of banking services through internet banking which provides easy access and transaction efficiency for customers. However, this progress also increases the risks faced by customers, especially related to unclear agreements, unilateral changes in provisions, and the use of detrimental standard clauses. This study aims to analyze legal protection for users of internet banking services according to Law No. 8 of 1999 concerning Consumer Protection. The method used is empirical legal research with a positive law approach and field data collection. The results of the study indicate that although there are no specific regulations that explicitly regulate internet banking, legal protection for customers can still be implemented through the interpretation of the Consumer Protection Law and other related regulations. This law provides a strong legal basis to protect customer rights from unilateral practices and imbalances in credit agreements. However, the implementation of this legal protection still faces challenges, especially related to customer legal awareness and legal certainty. Therefore, strengthening regulations and legal education are needed to improve protection for users of internet banking services in Indonesia.
