Abstract

Retribution refers to the payment imposed for the provision of market service facilities carried out by the local government. Its implementation must be conducted properly and in accordance with statutory regulations to ensure optimal benefits for the community. However, in practice, the collection of retribution fees at Simpang Sari Market differs from the stipulations outlined in Article 18, Paragraph (2) of the Regent Regulation of West Lampung Regency, which states: “Retribution officers are prohibited from altering or increasing the amount of the retribution fee.” In reality, the amount of retribution collected by officers diverges from the officially prescribed tariff. This study aims to investigate and analyze the implementation of market service retribution collection at Simpang Sari Market, and to examine it from the perspective of Fiqh Siyasah Tanfidziyyah (the Islamic theory of administrative governance). The research adopts a field research methodology using a descriptive approach, with data gathered through interviews and direct observation. Data were collected from pre-selected informants to ensure accuracy and relevance for this study. Although the local government has established regulations and provided implementation guidelines for the collection of market service retribution, several issues have emerged in practice. These include a lack of understanding among market vendors regarding the retribution system, poor coordination among collection officers, and the involvement of unauthorized individuals who collect fees outside the formal governmental structure.

Abstract

This study aims to analyze the relationship between Indonesia and Palestine from the perspective of the Preamble to the 1945 Constitution of the Republic of Indonesia (UUD 1945) and Siyasah Dauliyah. The Preamble to the 1945 Constitution emphasizes that colonialism must be abolished because it is contrary to the values of humanity and justice. From the perspective of Siyasah Dauliyah (Islamic foreign policy), Indonesia's stance reflects its moral and political obligation to defend oppressed nations. In addition, Indonesia also has an obligation to participate in creating world order based on independence, lasting peace, and social justice. Therefore, Indonesia's support for Palestine can be understood as a form of implementing the constitutional mandate as well as part of Indonesia's foreign policy that consistently rejects all forms of colonialism. The method used in this study is qualitative with a content analysis approach or library research. The data was obtained from the 1945 Constitution, government policies, diplomatic documents, and relevant literature on Indonesia-Palestine relations. The results of the study show that Indonesia's support for Palestine is manifested in various forms, such as recognition of Palestine as an independent state, diplomatic efforts in international forums, and the provision of humanitarian aid. This confirms that Indonesia's support for Palestine is not merely a diplomatic interest, but also a manifestation of national identity and fundamental principles of the state.

Abstract

This study aims to analyze the implementation of Article 6 paragraph 3 of Permendikbudristek Number 30 of 2021 concerning the prevention and handling of sexual violence in higher education institutions through the perspective of Fiqh Siyasah Tanfidziyyah, with a focus on studies at the Raden Intan State Islamic University (UIN) Lampung. This study is motivated by the urgency of protecting victims of sexual violence and the need to strengthen a responsive, fair, and Islamic law-based handling system. The method used is empirical juridical with a qualitative approach. Data was obtained through relevant laws and regulations, field observations, in-depth interviews with campus bureaucrats, the PPKS/PSGA task force, LKBH, students, and analysis of official policy implementation documents. The findings show that UIN Raden Intan Lampung has implemented progressive policies for the prevention and handling of sexual violence, in line with Article 6 paragraph 3 of Permendikbudristek No. 30 of 2021. From the perspective of Fiqh Siyasah Tanfidziyyah, this policy reflects the exercise of administrative authority by the campus as wali al-amr, which aims to maintain the welfare and honor of the academic community. The implementation of this policy demonstrates the integration of positive norms and sharia values, particularly in efforts to prevent harm (mafsadah) and realize the protection of human rights in the context of higher education.

Abstract

Pertumbuhan pesat Kota Bandar Lampung memicu kebutuhan mendesak akan sarana prasarana, terutama drainase, yang seringkali bermasalah dan menyebabkan banjir. Menanggapi hal ini, Pemerintah Kota Bandar Lampung menerbitkan Peraturan Daerah Nomor 08 Tahun 2015, mewajibkan pengembang menyerahkan Prasarana, Sarana, dan Utilitas (PSU) kepada pemerintah untuk pemeliharaan. Penelitian ini menganalisis implementasi Pasal 15 Ayat 4 Perda tersebut oleh Dinas Pekerjaan Umum (PU) dari perspektif Fiqh Siyasah Tanfidziyah. Menggunakan metode “field research” kualitatif dengan wawancara dan observasi, studi ini menemukan bahwa Dinas PU dan Dinas Perkim telah berupaya maksimal dalam implementasi, termasuk koordinasi antar lembaga, penerapan prinsip amanah. Namun, implementasi masih terkendala oleh keterbatasan anggaran, cuaca ekstrem, kurangnya kesadaran masyarakat, kondisi saluran yang buruk,  keterbatasan sumber daya, dan koordinasi yang belum maksimal. Akibatnya, implementasi Perda belum maksimal di lapangan, terutama karena masalah komunikasi dengan pengembang terkait drainase yang tidak layak. Meskipun demikian, upaya pemerintah secara umum sejalan dengan prinsip pelayanan Islam dalam Fiqh Siyasah Tanfidziyah, meskipun belum sempurna. Penelitian ini memberikan wawasan tentang tantangan implementasi kebijakan infrastruktur dan meningkatkan kepatuhan pengambang serta relevansinya dengan Fiqh Siyasah Tanfidziyah, Kesimpulannya, meskipun pemerintah telah berusaha maksimal, pelaksanaan di lapangan masih belum sepenuhnya memenuhi harapan.

Abstract

Penelitian ini mengkaji implementasi Peraturan Daerah Provinsi Lampung Nomor 6 Tahun 2022 tentang Pengelolaan Hutan oleh Unit Pelaksana Teknis Daerah Kesatuan Pengelolaan Hutan Konservasi (UPTD KPHK) Tahura Wan Abdul Rachman, ditinjau dari perspektif Siyasah Tanfidziyyah. Hutan memiliki peran penting dalam menjaga keseimbangan ekosistem dan menopang kehidupan, namun Tahura Wan Abdul Rachman menghadapi berbagai ancaman kerusakan yang disebabkan oleh perbuatan manusia. Oleh karena itu, perlindungan hutan menjadi urgensi yang tidak dapat diabaikan. Tujuan penelitian ini adalah menganalisis implementasi peraturan daerah tersebut dan meninjau implementasinya dari sudut pandang Siyasah Tanfidziyyah. Penelitian ini menggunakan metode studi lapangan (field research) dengan pendekatan deskriptif kualitatif, mengumpulkan data primer melalui wawancara dan data sekunder dari dokumen terkait. Hasil penelitian menunjukkan bahwa UPTD KPHK Tahura Wan Abdul Rachman telah berupaya maksimal dalam perlindungan hutan melalui pendekatan pre-emptive, preventive, dan repressive, serta pemberdayaan masyarakat dan pemanfaatan teknologi. Namun, implementasi ini belum optimal karena masih terdapat kendala seperti keterbatasan personil dan banyaknya masyarakat yang melakukan penggarapan kawasan secara ilegal. Dari perspektif Siyasah Tanfidziyyah, perlindungan hutan yang dilakukan belum sepenuhnya menerapkan prinsip al-maslahah al-'ammah (kemaslahatan masyarakat) karena belum adanya program khusus untuk menyediakan mata pencarian alternatif bagi masyarakat yang sebelumnya merusak hutan.

Abstract

Technological advancements have reshaped our work principles, deviating from established standards. In the construction industry, many individuals and companies persist in using outdated technology, overlooking current technological strides. Building Information Modeling (BIM) stands out as a contemporary solution, offering numerous benefits not only to individual stakeholders but also to all parties involved in a construction project. Despite BIM's potential advantages, numerous practitioners remain entrenched in their comfort zones, demonstrating a lack of awareness. In response to this, a collection of articles addressing various aspects of BIM, including its benefits, obstacles, challenges, and integration with technologies like Computer-Aided Design (CAD), Unmanned Aerial Vehicles (UAV), and the Internet of Things (IoT), has been assembled. By accentuating BIM's distinctive characteristics, this research seeks to enhance awareness, ultimately fostering increased adoption and development of BIM technologies. The comprehensive exploration of BIM's traits aims to bolster awareness, paving the way for widespread adoption and advancement within the construction industry. Abstrak Pekembangan teknologi terus mengubah prinsip-prinsip kerja yang sudah terbentuk sebelumnya. Pada industri konstruksi, sayangnya masih banyak individu dan perusahaan yang menggunakan teknologi lama dan mengabaikan kemajuan teknologi saat ini. Building Information Modeling (BIM) menjadi salah satu solusi terkini yang memberikan banyak manfaat tidak hanya untuk pihak-pihak terkait individual tetapi juga untuk semua pihak yang terlibat dalam proyek konstruksi. Meskipun demikian, banyak praktisi yang masih nyaman menggunakan teknologi lama, hal tersebut menunjukkan masih kurangnya kesadaran terhadap pentingnya BIM sebagai teknologi terkini. Sebagai respons terhadap hal tersebut, beberapa artikel terkait BIM telah dikumpulkan, membahas manfaat, hambatan, tantangan, dan integrasi dengan teknologi lain seperti Computer-Aided Design (CAD), Unmanned Aerial Vehicles (UAV), dan Internet of Things (IoT). Dengan menyoroti karakteristik unik BIM, penelitian ini bertujuan untuk meningkatkan kesadaran, sehingga memperkuat peluang adopsi dan pengembangan teknologi BIM. Eksplorasi menyeluruh terhadap sifat-sifat BIM bertujuan untuk memperkuat kesadaran (awareness), membuka jalan bagi adopsi dan kemajuan luas dalam industri konstruksi.
