Abstract

Penelitian ini bertujuan untuk mengungkap SEMA Nomor 2 Tahun 2023 dalam pencegahan perkawinan beda agama. Persoalan ini menarik untuk diteliti karena perkawinan beda agama sering meninggalkan polemik di masyarakat, termasuk di kalangan praktisi hukum. Penelitian menggunakan metode pustaka, sifatnya deskriptif analitis menggunakan sumber data hukum primer dan sekunder. Riset ini menyimpulkan bahwa SEMA menjadi petunjuk bagi hakim sekaligus untuk memutus polemik di kalangan hakim dan masyarakat. SEMA Nomor 2 Tahun 2023 ini juga berperan dalam pencegahan pernikahan beda agama dan sejalan dengan ajaran agama yang sesungguhnya memerintahkan setiap pemeluknya menikah dengan pria maupun wanita yang seagama. Oleh sebab itu ketika marak terjadinya penetapan pencatatan perkawinan pasangan beda agama dari peradilan sesungguhnya hal itu bisa diakhiri dengan SEMA tersebut. Sudah selayaknya hakim dalam memeriksa perkara perkawinan terlebih dahulu menggunakan asas formal yakni hukum perkawinan, bukan menggunakan hukum lain yakni hukum administrasi kependudukan.

Abstract

Monogami adalah asas yang terkandung dalam Undang-Undang 1 Tahun 1974 tentang Perkawinan di Indonesia, yaitu laki-laki hanya memiliki istri satu, hal ini seirama dengan prinsip mubadahlah agar dapat berbuat adil. Realitanya, upaya pemerintah dalam meminimalisir angka perceraian yang disebabkan oleh poligami dengan cara mewujudkan e-KTP fenomena poligami masih marak kita saksikan. Pertanyaannya adalah, bagaimana telaah mubadalah terhadap poligami pada era digital di Indonesia? Penelitian ini bertujuan untuk menelaah fenomena pologami dalam kacamata mubadalah untuk mewujudkan keadilan. Penelitian ini merupakan jenis penelitian kualitatif dalam bentuk liberary seseach yaitu mengkaji tentang fenomena poligami pada era rad an pasca diwujudkannya e-KTP, yang kemudian telaah dengan teori mubadalah untuk mewujudkan keadilan. Dalam konteks digital, fenomena poligami sebenarnya telah terstruktur, yaitu orang kerap melakukan poligami secara resmi yaitu terdaftar di pegawai pencatat nikah, sedangkan markanya poligami yang terjadi pada era digital ini adalah penipuan ijin nikah pada istri pertama, sehingga akan menimbulkan konflik hingga pada ranah perceraian akibat terkhianati. Dalam telaah mubadalah bahwa fenomena poligami ini bertentangan dengan prinsip-prinsip mubadalah, yaitu rahmah dan akhlakul karimah, yaitu suami tidak memiliki rasa sayang pada istrinya hingga melakukan penipuan surat ijin poligami, dan perilaku penipuan seperti ini adalah bentuk dari suami yang tidak bertanggungjwab dan tidak memiliki akhlakul karimah.

Abstract

Recently, being childfree has become a trend in modern Muslim society. Childfree is practiced not only by celebrities but also by common people in Indonesia, particularly in Lampung and West Java provinces. On the one hand, the decision to be childfree is an individual right of each family, but it is considered contrary to the goals of Islamic law, which are to preserve offspring. This study examines the childfree phenomenon in modern Muslim communities in Lampung and West Java through the perspective of maqāṣid al-sharī'ah. This research employed a qualitative method with an ethnographic approach. The research suggested that modern Muslim communities in Lampung and West Java Provinces choose childfree for economic, mental, health, perspective, and environmental reasons. According to maqāṣid al-sharī'ah, being childfree contradicts Sharia's purpose of preserving offspring. Sharia promotes marriage and having healthy offspring. Meanwhile, Sharia cannot justify childfree due to lifestyle or economic factors. Specifically, a fear of not being able to provide for the child's future needs because Allah ensures livelihood for every servant who has faith and works diligently. At the same time, being child-free due to health reasons is permissible.

Abstract

The recontextualization of family law in Muslim-majority countries has gained significance amidst contemporary social, political, and legal transformations. This study examines the reforms of family law in Indonesia, Tunisia, and Turkey, focusing on gender equality, women's rights, and the limitation of polygamy. Employing a qualitative methodology with a comparative approach, data were gathered from literature reviews, legal documents, and regulations in each country. In Indonesia, the Compilation of Islamic Law (KHI) integrates Islamic jurisprudence with local traditions and human rights principles. Tunisia’s Code du Statut Personnel (CSP) replaces traditional Islamic family law with a secular system emphasizing gender equality. In Turkey, the secular Turkish Civil Code incorporates some elements of Islamic jurisprudence, particularly in inheritance. The findings reveal that while all three countries aim to improve women's positions and align family law with social progress, their approaches differ based on socio-cultural and political contexts. The study concludes that the recontextualization of family law in these countries reflects efforts to balance tradition and modernity, offering improved protection for women's rights through varying local adaptations. These findings contribute to a deeper understanding of family law dynamics in Muslim societies and provide recommendations for reform in similar contexts.

Abstract

This article is about the position of husband and wife regulated in Article 31 of the Indonesian Marriage Law (UUP). The provisions of the position of husband and wife are allegedly gendered and contradictory, because they place husbands and wives not on equal footing, Article 31 when read textually has implications for the subordination of women. The purpose of this article is to analyse the provisions of the position of husband and wife in the Indonesian Marriage Law from the perspective of Mubadalah. Mubadalah theory is used to analyse the equality of husband and wife in the household. The method used is qualitative, the type of this article is librabry research (library research), a normative approach with a focus on analysing Article 31, data sources are obtained from literature related to mubadalah. The results show that Article 31 of the UUP places the position of husband and wife differently, the husband as the head of the household while the wife is a housewife, this text can be gendered and seems masculine. In the perspective of mubadalah, Article 31 of the UUP is not in line with the values of justice and equality. Article 31 of the UUP needs a jucial review for the realisation of a maslahah family based on the principle of equality between husband and wife in the household.

Abstract

The laws and regulations in Indonesia have regulated the existence of new regulations regarding the age limit for marriage, which is 19 years old for men and women, as stipulated in Law Number 16 of 2019 in response to the birth of the Constitutional Court Decision Number 22/PUUXV/2017, marriage dispensation can be granted if it meets two requirements, namely; First, urgent and have, Second, have sufficient evidence. In fact, this rule often makes it difficult for the community, so that finally many efforts to dispensate marriage are made in order to be able to carry out formal marriage contracts. The problem is how do judges respond to the submission of marriage dispensation to children who are far from the minimum age limit for marriage, which is 19 years for men and women, and what is their contribution to efforts to reform marriage law in Indonesia? To contribute new ideas to the renewal of marriage law scientifically and logically. This research is a type of library research, with a scientific-rational approach to the minimum age limit for marriage in Law Number 16 of 2019, with the theory of sadd al-dzariah as an effort to be able to present legal justice. The conclusion is that the determination of the Religious Court judge regarding marriage dispensation on urgent grounds as the main argument, so that there are often decisions on marriage dispensation at the age of under 16 years, although sadd al-dzariah is a solution that is solutive according to the evidence submitted, but logically it violates the rules of scientific-rational. Abstract

This study aims to analyze the factors influencing the choice between Lampung customary law and Islamic law in inheritance distribution among inter-ethnic couples in the Pepadun community of Padang Ratu, Central Lampung Regency. Lampung customary law, which emphasizes family values and cooperation, is often the main guideline in inheritance distribution. However, in the context of inter-ethnic couples, tensions between the application of customary law and Islamic law often arise, especially in the distribution of inheritance rights which are more proportional according to Islamic law. This research employs a qualitative approach with in-depth interviews with customary leaders, religious leaders, and local community members, as well as field observations to explore inheritance practices. The results indicate that although customary law is dominant, customary deliberations involving family members and customary leaders play a significant role in integrating both legal systems. Moreover, Islamic law offers a fairer perspective in inheritance distribution, considering the rights of men, women, and children in a proportional manner. This study is expected to provide a deeper understanding of the dynamics of inheritance law in the Pepadun community and highlight the importance of deliberation in achieving social justice for all parties involved. Abstract

The Nyongkolan tradition is a distinctive marriage procession within the Sasak community in Lombok, West Nusa Tenggara, which combines elements of customary law with Islamic law. This study aims to examine how the integration of Islamic law and Sasak customary law occurs in the implementation of Nyongkolan, as well as the challenges faced in harmonizing the two. Using a descriptive qualitative approach, data was obtained through in-depth interviews, participatory observation, and documentation involving religious leaders, customary figures, and members of the Sasak community involved in the marriage procession. The findings of the study show that although there is potential conflict between the principle of simplicity in Islam and some customary elements considered excessive, both Islamic law and customary law play important roles in strengthening the relationship between the two families of the bride and groom, as well as preserving local cultural values. Dialogue and mutual understanding between religious leaders and customary figures are necessary to achieve harmonious integration between the two. This study reveals the importance of maintaining a balance between tradition and religious teachings to preserve the essence of a marriage that is legitimate both in terms of religion and culture, as well as enriching the identity of the Sasak community.

Abstract

Abstract: This research explores Generation Z’s perspectives on early marriage through the lens of Maqashid Syariah. The study reveals that most members of Generation Z oppose early marriage, considering it an obstacle to personal growth, education, and economic stability. However, some still view it as a viable option under certain conditions, particularly in relation to economic and cultural influences. From a Maqashid Syariah standpoint, early marriage has diverse implications. Concerning hifz ad-din , it should be approached with adequate mental and spiritual preparedness to avoid potential harm. In terms of hifz an-nafs , the physical and psychological health risks, especially for women, are significant considerations. Regarding hifz al-aql, interrupted education due to early marriage can negatively impact an individual's future prospects. From the hifz an-nasl perspective, insufficient readiness to raise children may affect the well-being of future generations. Lastly, in the aspect of hifz al-mal, financial instability among young couples often results in economic hardship. This study offers crucial insights for policymakers and scholars in developing preventive measures against early marriage in alignment with Maqāṣid Syariah principles. It emphasizes the need to consider not only religious teachings but also the broader socio-economic consequences in decision-making. Abstract

Tulisan dalam artikel ini membahas mengenai peranan pemerintah daerah terhadap pelaksanaan corporate social responsibility (CSR). Tujuannya untuk mengetahui bagaimana arah kebijakan dan pengaturan CSR di provinsi Lampung. Metode yang digunakan adalah kajian pustaka dengan menggunakan pendekatan yuridis. Berdasarkan Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas mewajibkan setiap perusahaan untuk melaksanakan CSR. Peran pemerintah daerah Provinsi Lampung dalam pelaksanaan CSR yaitu dengan membentuk Peraturan Daerah Provinsi Lampung Nomor 16 Tahun 2012 tentang Tanggung Jawab Sosial Perusahaan dan Peraturan Gubernur Nomor 30 Tahun 2011 tentang Pedoman Pengelolaan CSR/PKBL. Peran pemerintah daerah dalam hal pelaksanaan CSR menurut Pergub No. 30 tahun 2011 yaitu, membentuk forum komunikasi dan tim fasilitasi. Kedua tim tersebut memiliki kewajiban mewadahi seluruh pihak yang terlibat pelaksanaan CSR, yaitu pemerintah, perusahaan dan masyarakat. Pergub No. 30/2011 juga mengatur pedoman mekanisme pengelolaan CSR dimulai dari; 1) perencanaan; 2) pelaksanaan; 3) pembinaan dan pendampingan; 4) pelaporan dan evaluasi. Berdasarkan hal tersebut secara khusus pemerintah kota Metro juga telah menerbitkan Peraturan Daerah Nomor 6 Tahun 2016 tentang Tanggung Jawab Sosial Perusahaan.
