Abstract

The handling of terrorism crimes in Indonesia requires a balance between safeguarding the rights of perpetrators as individuals entitled to human rights and fulfilling the rights of victims affected by such acts of violence. This study aims to evaluate how human rights protections for terrorism suspects are upheld during legal proceedings, as well as how the state strives to protect and rehabilitate victims of terrorism under Law No. 5 of 2018 on the Eradication of Criminal Acts of Terrorism. Using a normative juridical approach, this research analyzes a case study based on the North Jakarta District Court’s Decision No. 1580/Pid.Sus.Terrorism/2020/PN.Jkt.Utr. The findings indicate that terrorism suspects are granted fair legal treatment, including the right to defense, a fair trial, and protection from torture, in accordance with the principle of non-derogable rights under international human rights law. On the other hand, Law No. 5 of 2018 establishes a clearer and more comprehensive legal framework to ensure victims' rights, including rehabilitation, compensation, and restitution. However, the implementation of victim protections still faces various technical and administrative challenges. This study recommends strengthening mechanisms for victim protection and enhancing legal enforcers' awareness of human rights principles in handling terrorism cases.

Abstract

Dalam komunitas Muslim, poligami merupakan isu yang kompleks dan sensitif, terutama dalam kaitannya dengan perkembangan sosial dan modern. Tujuan dari penelitian ini adalah untuk menganalisis praktik poligami dari perspektif hukum Islam dan hukum Indonesia, serta mengkaji stigma sosial yang dihadapi oleh perempuan dan tanggapan generasi Muslim terhadap praktik tersebut. Islam menjunjung tinggi poligami dengan syarat keadilan, sementara hukum Indonesia, seperti yang dinyatakan dalam Undang-Undang No. 1 Tahun 1974 tentang Perkawinan, memerangi pelaksanaannya melalui prosedur yang ketat. Dari perspektif sosial, politik sering kali memperkuat stereotip negatif tentang perempuan dan ketidakadilan gender. Penelitian ini juga meneliti generasi milenial Muslim yang semakin kritis dan melek terhadap norma dan nilai gender. Metodologi yang digunakan dalam penelitian ini adalah studi kualitatif dengan menggunakan metode deskriptif-analitis melalui tinjauan literatur dan sumber-sumber lainnya. Temuan penelitian menunjukkan bahwa terdapat hubungan antara norma agama, hukum nasional, dan perubahan sosial dalam poligami di era modern. Perlu adanya pendekatan holistik dan kontekstual agar peraturan dan praktik poligami sesuai dengan prinsip keadilan dan kemanusiaan.

Abstract

The judiciary plays an important role in upholding law and justice in Indonesia. To maintain the integrity of judges, two supervisory bodies were established: the Judicial Commission (KY) and the Supreme Court (MA). However, in practice, there is often an overlap of authority between the two institutions, especially in terms of overseeing the behavior of judges. This research aims to trace the root of the overlapping issues by reviewing the legal basis governing the authority of the Judicial Commission (KY) and the Supreme Court (MA), and its impact on the independence of the judiciary. The method used is normative juridical with a statutory and conceptual approach, as well as examining several Constitutional Court decisions related to this issue. The study results indicate that the overlap in oversight functions is caused by unclear boundaries of authority as stipulated in the law, leading to potential institutional conflict. Going forward, it is necessary to align regulations and improve coordination between the Judicial Commission (KY) and the Supreme Court (MA) so that the oversight function can operate more effectively without disrupting the independence of the judiciary.
