Abstract

Penelitian ini bertujuan untuk menganalisis integrasi antara hukum Islam dan hukum positif dalam penanganan kasus bullying di Pondok Pesantren Al-Hidayah Ciomas, dengan menggunakan pendekatan kualitatif, di mana data dikumpulkan melalui wawancara mendalam, observasi, dan dokumentasi; hasil kajian menunjukkan bahwa meskipun nilai-nilai hukum Islam seperti larangan terhadap kezaliman dan kewajiban menjaga hak sesama telah diterapkan secara normatif, implementasinya belum sepenuhnya terstruktur dalam mekanisme formal sebagaimana diatur dalam hukum positif, khususnya Undang-Undang Perlindungan Anak dan Permendikbud Nomor 82 Tahun 2015, sehingga diperlukan integrasi yang lebih sistematis antara keduanya untuk menciptakan regulasi internal pesantren yang mampu mencegah dan menangani bullying secara adil, efektif, dan sesuai dengan nilai- nilai keislaman serta ketentuan hukum nasional.

Abstract

This study aims to determine whether financial distress, audit delay, and audit opinion significantly affect partial and simultaneous auditor switching in transportation and logistiks sector companies listed on the Indonesia Stock Exchange in 2018-2022. The data in this study uses secondary data in the form of audited financial reports obtained through the Indonesia Stock Exchange website www.idx.co.id, and the sampling technique uses purposive sampling to produce a total sample of 12 companies. For data analysis techniques using, descriptive statistical analysis, logistik regression model feasibility test, logistik regression model analysis, and hypothesis testing. The results showed that audit delay partially has a significant effect on auditor switching, while financial distress and audit opinion partially have no significant effect on auditor switching. In addition, the results show that simultaneously financial distress, audit delay, and audit opinion affect auditor switching.

Abstract

This study aims to analyze the integration of Islamic law and positive (national) law in addressing bullying cases at Al-Hidayah Islamic Boarding School in Ciomas by employing a qualitative approach, with data obtained through in-depth interviews, observation, and documentation; the findings reveal that while Islamic legal principles—such as the prohibition of injustice and the obligation to uphold others’ rights—are normatively applied, their practical implementation lacks structured mechanisms as prescribed in positive law, particularly the Child Protection Act and Ministry of Education Regulation No. 82 of 2015, thereby necessitating a more systematic integration between both legal frameworks to establish internal pesantren regulations that can prevent and handle bullying effectively, fairly, and in accordance with Islamic values as well as national legal standards.
