Abstract

This study traces the formation, development and decline of the Deli Hindu Sabba organization in the city of Medan, North Sumatra, Indonesia. This article examines the emergence of Indian Tamil community organizations in the pre-independence period of Indonesia. This paper uses historical research methods to reconstruct events in the past. Data obtained through literature study from various documents. The data obtained were processed using critical methods to determine the authenticity and validity of the data obtained. The analytical method used is descriptive narrative to describe the chronology of events and aspects that affect the course of events. The study found that the Deli Hindu Sabba organization had its ups and downs: it was founded in 1913 and had developed since, but it stopped conducting activities in 1918 until Kumarasamy took over this organization in 1928. After that, Kumarasamy was pivotal role in the development and activities of this organisation. These activities included providing free education with Tamil language guidance, Indian Boy Scout and Mother Paguthi to empower Tamil community in Medan. Besides that, various arts and sports activities were also carried out. However, the organization suffered a setback in 1942 when former chairman of organization converted into Buddhism, making the organization lacked the important figures that could become its spearhead. In addition, it is the same year of the Japanese occupation which had banned all organizations in Indonesia during that time. Abstract

Abstrak Penelitian ini di latar belakangi mengenai penjualan obat keras tanpa resep di Apotek yang dilakukan oleh apoteker. Apoteker dianggap negatif oleh media di Indonesia, dikarenakan terdapat praktek yang tidak sesuai. Adapun tujuan penelitian ini untuk mengetahui penjualan obat keras tanpa resep dokter di Kabupaten Lebak. Selanjutnya, untuk mengetahui tanggung jawab hukum administrasi bagi apotek yang menjual obat keras tanpa resep dokter, dan bagaimana pengawasan yang dilakukan oleh BPOM terhadap obat keras yang memiliki izin edar. Jenis penelitian ini menggunakan penelitian yuridis normatif empiris, dengan pendekatan Undang-Undang, Sosiologis. Data untuk analisanya menggunakan analisa secara kualitatif. Hasil Penelitian ini yaitu penjualan obat keras tanpa resep dokter merupakan pelanggaran hukum. Apotek dalam setiap menjual obat keras harus berdasarkan ketentuan yang ada, dan bertanggung jawab untuk melaporkan setiap penjualan obat keras kepada Pemerintah, dalam hal ini Dinas Kesehatan. Adapun sanksi yang diberikan kepada pelaku usaha kefarmasian terhadap penjualan obat keras tanpa resep dokter yaitu sanksi administratif dimulai peringatan tertulis, penghentian sementara kegiatan hingga pencabutan SIA. Upaya pengawasan yang dilakukan oleh Pemerintah yaitu dengan membentuk BPOM sebagai pengawasan obat keras yang ilegal. Adanya BPOM pengawasan pemerintah lebih terjamin, dan masyarakat lebih aman dan nyaman dalam menggunakan obat-obatan yang mereka butuhkan. Kata Kunci: Tanggung Jawab, Hukum, Apotek Abstract This research is motivated by the issue of over-the-counter sales of prescription drugs in pharmacies conducted by pharmacists. Pharmacists are perceived negatively by the media in Indonesia due to inappropriate practices. The objectives of this research are to determine the sales of prescription drugs without a doctor's prescription in Lebak Regency. Furthermore, to understand the administrative legal responsibilities for pharmacies selling prescription drugs without a doctor's prescription, and how the supervision is carried out by the National Agency of Drug and Food Control (BPOM) for prescription drugs with circulation permits. This research employs a normative empirical juridical approach with legal and sociological perspectives. Qualitative analysis is used for data analysis. The results of this research indicate that the sale of prescription drugs without a doctor's prescription is a legal violation. Pharmacies must adhere to existing regulations when selling prescription drugs and are responsible for reporting each sale to the government, specifically the Health Department. Sanctions imposed on pharmaceutical business operators for selling prescription drugs without a doctor's prescription include administrative penalties ranging from written warnings to temporary cessation of activities to revocation of the pharmacy license. Government oversight is carried out through the establishment of BPOM to monitor illegal prescription drug sales. The existence of BPOM ensures more effective government supervision, providing greater safety and comfort for the public in using the medications they need. Keyword: Rensponsibility, Law, Pharmacy

Abstract

The increase in waste volume every year in Tangerang Regency has caused the existence of the Jatiwaringin TPA, Tangerang Regency to be increasingly concerning. The Tangerang Regency Government, through the Tangerang Regency DLHK, has the responsibility for waste management as regulated in Article 2 and Article 3 paragraph (1) of Tangerang Regency Regulation Number 1 of 2023 concerning Waste Management. The purpose of this study was to determine the implementation of the Tangerang Regency Government's responsibility in waste management at the Jatiwaringin TPA and the obstacles to the implementation of the Tangerang Regency Government's responsibility in waste management at the Jatiwaringin TPA based on Tangerang Regency Regulation Number 1 of 2023 concerning Waste Management. The theories used are the theory of legal responsibility and the theory of the welfare state. The research method is empirical juridical. The research specifications are descriptive analytical. Data sources are primary data and secondary data. Data collection techniques are by interviews and related documents. Data are obtained and analyzed descriptively with a qualitative approach method. The results of this study are that the Tangerang Regency DLHK has not been optimal in carrying out its responsibility for waste management at the Jatiwaringin TPA using the theory of legal responsibility, namely due to the implementation of roles, including rights and obligations. Although the Tangerang Regency DLHK has attempted the Kurasaki, Kurasakan program and the application of waste management technology to reduce the volume of waste at the Jatiwaringin TPA. However, the use of the open dumping method which is still used at the Jatiwaringin TPA and the minimal provision of waste management facilities and infrastructure as a form of negligence in the role of implementing obligations. The implementation of this responsibility still experiences obstacles, including budget limitations, limited human resources and technology, limited land capacity of the TPA, and lack of public awareness in waste management. These obstacles indicate that the legal responsibility of the Tangerang Regency DLHK in realizing the principles of a welfare state, which should guarantee welfare and social justice for the community, is not yet optimal.

Pasal 13 ayat (4) Peraturan Daerah Kota Cilegon Nomor 10 Tahun 2018 tentang Perlindungan dan Pengelolaan Lingkungan Hidup menyebutkan bahwa Pemerintah Daerah wajib melakukan pemantauan kualitas lingkungan hidup di daerah untuk mengetahui kecenderungan kualitas lingkungan hidup. Identifikasi masalah, yaitu bagaimana pelaksanaan kewenangan Dinas Lingkungan Hidup dalam penanggulangan pencemaran udara di Kota Cilegon berdasarkan asas keberlanjutan dalam Peraturan Daerah Kota Cilegon Nomor 10 Tahun 2018 tentang Perlindungan dan Pengelolaan Lingkungan Hidup Daerah dan apa saja kendala pelaksanaan kewenangan Dinas Lingkungan Hidup dalam penanggulangan pencemaran udara di Kota Cilegon. Teori yang digunakan, yaitu teori kewenangan dan penegakan hukum. Metode penelitian yang digunakan adalah metode yuridis empiris dengan spesifikasi penelitian kualitatif deskriptif analitis. Hasil penelitian ini menunjukkan bahwa Dinas Lingkungan Hidup melaksanakan penanggulangan pencemaran udara berdasarkan kewenangan delegasi Pasal 41 Peraturan Daerah Kota Cilegon Nomor 10 Tahun 2018 tentang Perlindungan dan Pengelolaan Lingkungan Hidup Daerah dengan melakukan pembinaan, penegakan hukum berupa pengawasan dan pemberian sanksi, konsultasi serta pendampingan teknis terhadap penanggung jawab usaha dan/atau kegiatan, namun menghadapi hambatan pada terbatasnya sarana dan prasarana yang dimiliki. Hambatan yang dihadapi memerlukan perbaikan pada dua elemen, yaitu struktur hukum memerlukan penguatan melalui peningkatan alokasi anggaran yang memadai. Budaya hukum perlu ditegakkan secara konsisten untuk mendorong kepercayaan masyarakat terhadap Dinas Lingkungan Hidup Kota Cilegon melalui edukasi dan sosialisasi terkait status lingkungan hidup, prosedur pengaduan secara berkala, pemberian informasi peringatan pencemaran, serta optimalisasi pengembangan sistem informasi lingkungan yang terpadu, terkoordinasi dan dipublikasikan.
