Abstract

Environmental problems are increasing every day. This results in a decrease in the carrying capacity of the environment. Population growth also puts a burden on the carrying capacity of the environment. To improve the quality of carrying capacity, it is necessary to implement the principle of sustainable development. With the implementation of sustainable development principles that balance economic, social and environmental aspects, the quality of the carrying capacity of the environment will be better so that the availability of natural resources for future generations will be guaranteed.

Abstract

AbstractThe aim of this article is to review and analyze the management policy of Ujungnegoro-Roban Coastal Park. This research type is empirical research with qualitative approach. Data source used is primary and secondary data source. Primary data sources were obtained through interviews with officials in the relevant offices, while secondary data was obtained through literature studies. Ujungnegoro-Roban Coastal Park was formed based on the Decree of the Minister of Marine Affairs and Fisheries of the Republic of Indonesia No. Kep.29 / Men / 2012 on the Determination of Coastal Areas and Small Islands Ujungnegoro-Roban Batang Regency in Central Java Province. The coastal park is formed because it meets the criteria in Regulation of Minister of Marine Affairs and Fisheries No. Per.17 / Men / 2008 concerning Conservation Area in Coastal Areas and Small Islands. Ujungnegoro-Roban coastal park potentially damaged coral reef ecosystem, mangrove, abrasion, and sedimentation. Coastal management policy in Ujungnegoro-Roban Coastal Park has been implemented by the Government of Batang Regency such as the installation of artificial reefs and mangrove planting. With the transfer of authority of the coastal park management from the district government to the provincial government, a regional regulation on zoning plan that divides the sea space so as to realize conservation objectives.Keywords: Policy; conservation; coastal areas; protection.AbstrakTujuan artikel ini adalah mengkaji dan menganalisis kebijakan pengelolaan Taman Pesisir Ujungnegoro-Roban.Jenis penelitian ini yaitu penelitian empiris dengan pendekatan kualitatif.Sumber data yang digunakan adalah sumber data primer dan sekunder. Sumber data primer diperoleh melalui wawancara dengan pejabat pada dinas terkait, sedangkan data sekunder diperoleh melalui studi pustaka.Taman Pesisir Ujungnegoro-Roban dibentuk berdasarkan Keputusan Menteri Kelautan dan Perikanan Republik Indonesia Nomor Kep.29/Men/2012 Tentang Penetapan Kawasan Konservasi Pesisir dan Pulau-Pulau Kecil Ujungnegoro-Roban Kabupaten Batang di Provinsi Jawa Tengah. Taman pesisir tersebut dibentuk karena memenuhi kriteria dalam Peraturan Menteri Kelautan dan Perikanan Nomor Per.17/Men/2008 tentang Kawasan Konservasi di Wilayah Pesisir dan Pulau-pulau Kecil.Taman pesisir Ujungnegoro-Roban berpotensi mengalami kerusakan ekosistem terumbu karang, mangrove, abrasi, serta sedimentasi.Kebijakan pengelolaan wilayah pesisir di Taman Pesisir Ujungnegoro-Roban sudah dilaksanakan oleh Pemerintah Kabupaten Batang diantaranya dengan pemasangan terumbu karang buatan dan penanaman mangrove.Dengan berpindahnya kewenangan pengelolaan taman pesisir dari pemerintah kabupaten ke pemerintah provinsi, maka diperlukan peraturan daerah tentang rencana zonasi yang membagi ruang laut sehingga dapat mewujudkan tujuan konservasi.Kata kunci: Kebijakan; konservasi;wilayah pesisir;perlindungan.

Abstract

AbstractEnvironmental issues are currently getting a lot of attention both in Indonesia and internationally. The rise of irresponsible deforestation, air pollution in big cities, irresponsible industries for the waste produced, the use of goods that are difficult to decompose, and so on are examples of how bad environmental conditions are today. In fact, the guarantee for a healthy environment is stated in the 1945 Constitution of the Republic of Indonesia. In addition, the environment is also regulated separately in Law Number 32 of 2009 concerning Environmental Protection and Management. The principle of sustainable development should be applied in carrying out all activities that affect the environment. However, the present generation who are responsible for the availability and preservation of natural resources for future generations so that intergenerational justice can be realized.Keywords: Intergenerational Justice; Environmental justice; Human Rights; Sustainable Development.

Abstract

Development that carried out every day requires policies to limit and regulate these activities. Development that still relies on natural resources is still abundant in Indonesia. Continuous development will have a positive impact, but it cannot be denied if the development also has a negative impact. One of them is the declining capacity of the environment. If this happens continuously it can have an impact on the survival of all living things, not only humans. Therefore, a policy that regulates permits related to the development is needed. Indonesia has a legal basis relating to environmental destruction instruments that regulate about the types of environmental-related permits such as Environmental Impact Analysis. If there are legal rules, the rules are also important. Implementation of Environmental Permits that will have an impact on maintaining the carrying capacity of the environment.

Abstract

Plastic is a part of human life. Plastic packaging dominates the packaging market share in the world, replacing cans and glass packaging. Plastic is used because it is an inexpensive material, not easily weathered, lightweight, and anti-rust. Human activities cannot be separated from the use of plastics, but the increasing use of plastic results in increased pollution of land and even oceans. This also certainly affects the world's ecosystem. Because of the dangers of plastic for the environment, the government has begun to aggressively create programs and policies aimed at educating the public about the impact of plastic consumption and its dangers on the environment. It also aims to change people's culture of using single-use plastics. Not only the government, but at the university policy level it is also necessary to make policies regarding the restrictions on the use of single-use plastics. This study uses an empirical juridical research method that uses a juridical approach by analyzing primary data in the form of interviews and secondary data derived from primary legal materials. The purpose of this study was to determine the policy of reducing single-use plastic waste in the Sultan Ageng Tirtayasa University environment. These policies will be reviewed based on the principles of sustainable development or sustainable development which balances four aspects, namely economic, social, environment and law aspects

Abstract

Permasalahan lingkungan menjadi isu yang tidak terbantahkan baik di Indonesia maupun di dunia. Perkembangan teknologi, dunia industri dan pertumbuhan penduduk memiliki pengaruh terhadap permasalahan lingkungan yang mempengaruhi daya dukung dan daya tampung lingkungan hidup. Kegiatan yang memiliki potensi merusak lingkungan memerlukan perizinan agar kegiatannya tidak mengancam lingkungan. Kegiatan yang berdampak bagi lingkungan seperti menghasilkan limbah akan mengganggu daya dukung dan daya tampung lingkungan. Perlindungan dan pengelolaan lingkungan hidup sesuai dalam Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup bertujuan untuk melindungi Negara Kesatuan Republik Indonesia dari pencemaran dan/atau kerusakan lingkungan hidup. Tujuan tersebut dapat dicapai salah satunya dengan cara pencegahan melalui adanya dokumen analisis mengenai dampak lingkungan (Amdal). Tujuan dari penulisan ini adalah untuk mengetahui peran Amdal sebagai instrumen pencegahan pencemaran dan kerusakan lingkungan. Dengan metode penelitian yuridis normatif penulis akan melakukan studi kepustakaan baik dari buku, jurnal, maupun peraturan perundang-undangan. Amdal merupakan salah satu instrumen pencegahan dan/atau kerusakan lingkungan hidup yang penting. Dengan adanya Amdal pemerintah maupun masyarakat dapat mengawasi kesesuaian dan kekonsistenan pemilik usaha atau kegiatan dengan dampak lingkungan yang dihasilkan dari kegiatannya. Abstract

The COVID-19 pandemic has heightened the vulnerability of women and children to violence, necessitating prompt and effective legal assistance. This research addresses this urgent issue by developing the Perada application, a digital platform for reporting and seeking legal consultation and assistance for victims of violence. The study is conducted by the Faculty of Law at Untirta, aligning with its vision of an integrated, smart, and green campus. The application leverages smartphone technology to provide accessible support, utilizing the expertise of faculty members and students while collaborating with the Women's and Children's Protection Agency and law enforcement. Employing the Waterfall development model, the research combines descriptive, quantitative, and inferential analyses to evaluate the app’s creation process, usability, and alignment with legal principles. This study contributes to innovative, tech-driven solutions for enhancing legal protection and underscores the role of academia in addressing societal challenges.

Abstract

Provinsi DKI Jakarta sebagai ibu kota negara termasuk ke dalam kota metropolitan karena dihuni oleh lebih dari 10 juta penduduk. Masalah yang ada di kota besar adalah pencemaran udara yang diakibatkan oleh kendaraan bermotor dan industri manufaktur. Pencemaran udara berdampak pada kesehatan masyarakat, menurut data dari WHO, pencemaran udara ambien bertanggung jawab atas 7,6% kematian global dan sekitar 7 juta kematian dini terjadi setiap tahun sebagai akibat dari kombinasi polusi udara dalam ruangan (rumah tangga) dan polusi ambien (luar ruangan), sebagian besar karena peningkatan kematian akibat stroke, penyakit jantung koroner, penyakit paru-paru, Penyakit Paru Obstruktif Kronik (PPOK), dan Infeksi Saluran Pernapasan Akut (ISPA). Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Sumber data yang digunakan dalam penelitian ini adalah data sekunder yang berasal dari buku, artikel, jurnal ilmiah dan literatur yang berhubungan dengan penelitian ini. Berdasarkan analisis yang dilakukan penulis mengenai upaya pemerintah Provinsi DKI Jakarta terhadap pengendalian pencemaran udara adalah dengan memberikan mandat pada Tim Kerja Pengendalian Pencemaran Udara melalui Keputusan Gubernur Nomor 576 Tahun 2023 tentang Strategi Pengendalian Pencemaran Udara untuk melaksanakan rencana aksi dalam pengendalian pencemaran udara. Hambatan yang terdapat dalam pelaksanaan pengendalian pencemaran udara ini adalah keputusan gubernur tersebut kurang komprehensif sehingga tidak menyentuh akar permasalahan dan kurangnya koordinasi dengan pemerintah pusat serta pemerintah daerah lain.

Abstract

This study aims to thoroughly examine the implementation of precautionary principles in environmental impact assessment (EIA). In order to achieve the stated objective, a socio-legal study method was adopted. The obtained results showed that in the context of environmental approval requirements in Indonesia, EIA remained a key requirement. Typically, in the process of preparing, implementing, monitoring, and evaluating certain activities to be carried out, the principle of caution is ensured to be upheld optimally. This principle is often introduced to ensure that all projects permitted by the government do not pose a propensity to harm the community. In EIA process, there is an obligation to examine the opinions of individuals who could be directly affected by an activity before its implementation. Despite the effectiveness of this approach, it was observed to still possess certain weaknesses. This includes the fact that even after EIA has passed the assessment phase, continuous monitoring and evaluation are still necessary. The government must ensure that any risks associated with an activity are identified and addressed.

Abstract

In the practice the maritime boundary delimitations can cause the overlap of claims between states with opposite or adjacent coasts. Regarding the maritime boundary between Indonesia and Timor-Leste, there was never a maritime boundary between both States, so it needs a settlement of disputes of maritime boundary delimitation between both parties. Therefore, these research aims to explain the methods and principles that could be used in resolving maritime boundary delimitation dispute between state with opposite or adjacent coasts based on international law and analyze how obstacles and solution to solve maritime boundary delimitation dispute between Indonesia and Timor-Leste (East Timor). This research uses normative legal research and Empirical Research Methods. The results of the research show that: (1) the maritime boundary delimitation between Indonesia and Timor-Leste uses enclaving, equidistant, and three-step approach method. (2), Indonesia and Timor Leste have the potential to determine maritime boundaries in the three areas, namely the area to the north of the Oecusse (Ombai Strait), to the north of Timor Island (Wetar Strait) and to the south of Timor Island (Timor Sea). Timor-Leste will still get a maritime territory in District Oecusse but the extent would be negotiated with Indonesia first, while in the Wetar Strait, the territorial sea division of the two countries would consider the outer islands of both countries.
