Abstract

AbstrakTrial By Press atau peradilan dengan penggunaan media yang bersifat publikasi massa adalah sebuah istilah bentuk peradilan yang dilakukan dengan melalui penulisan atau pembicaraan dari satu sisi pihak secara bias biasanya dilakukan dengan bantuan publikasi secara luas secara sadar dengan tidak membeberkan keseluruhan fakta yang ada dengan demikian menjadikan penulisan atau pembicaraan tersebut tidak tidak lagi berimbang dengan demikian berakibat menjadikan penulisan atau pembicaraan tersebut adalah bagaikan sebuah putusan. pascareformasi terjadi pergeseran dalam hukum pers di Indonesia. Pascareformasi pers nasional menganut prinsip kemerdekaan pers sebagaimana diatur dalam Undang-Undang No. 40 Tahun 1999 tentang Pers yang menjadi payung hukum bagi seluruh kegiatan pers di Indonesia. Dalam hal ini, tidak diperbolehkan dilakukan sensor dan pemberedelan terhadap semua produk pers. Meskipun demikian, tetap terdapat rambu-rambu hukum yang harus ditaati oleh pers dalam melaksanakan pemberitaannya. Terlebih saat ini telah muncul Undang-Undang No. 14 Tahun 2008 tentang Keterbukaan Informasi Publik. Dalam kerangka hukum pers dikenal konsep freedom of expression yang mencakup konsep freedom of press dan freedom of speech. Pers dalam arti sempit dikaitkan dengan konsep freedom of press.Kata Kunci: Trial By Press, Undang-Undang No. 40 Tahun 1999AbstractTrial By Press or trial with the use of media that is mass publication is a term for a form of justice that is carried out by means of writing or discussion from one side of the party in a biased manner, usually carried out with the help of wide publications consciously by not disclosing all the facts that exist, thereby making the writing or the conversation is no longer out of balance, thus the result is making the writing or talk like a decision. post-reform there has been a shift in press law in Indonesia. Post-reformation, the national press adheres to the principle of press freedom as stipulated in Law no. 40 of 1999 concerning the Press which is the legal umbrella for all press activities in Indonesia. In this case, it is not permissible to censor and ban all press products. Even so, there are still legal signs that must be obeyed by the press in carrying out their reporting. Especially now that Law No. 14 of 2008 concerning Public Information Disclosure. Within the legal framework of the press, the concept of freedom of expression is known, which includes the concepts of freedom of press and freedom of speech. Abstract

Abstrak Artikel ini membahas pengaturan perizinan dan kepemilikan bank di Indonesia sebagai bagian dari upaya menjaga stabilitas dan integritas sistem perbankan nasional. Otoritas Jasa Keuangan (OJK) menerapkan regulasi yang ketat dalam setiap tahapan perizinan, mulai dari pendirian, kegiatan usaha, hingga perubahan status kelembagaan bank. Di sisi kepemilikan, pembatasan penguasaan saham oleh satu pihak dilakukan untuk mencegah dominasi pasar, meminimalisir konflik kepentingan, dan mendorong penerapan tata kelola yang sehat. Reformasi kebijakan seperti terbitnya POJK Nomor 12/POJK.03/2021 menunjukkan komitmen pemerintah dalam menciptakan industri perbankan yang sehat, transparan, dan berkelanjutan. Dengan demikian, pengaturan yang komprehensif atas perizinan dan kepemilikan bank merupakan pilar penting dalam memperkuat ketahanan sektor keuangan di Indonesia.Kata kunci: perizinan bank, kepemilikan bank, OJK, POJK 12/2021, regulasi perbankan.

Abstract

Law enforcement against hate speech in Indonesia has predominantly relied on a repressive approach under the Electronic Information and Transactions Law (ITE Law), often failing to uphold the principles of substantive justice. This article evaluates the effectiveness of the current approach and proposes restorative justice as a more humane and participatory alternative paradigm. Using the socio-legal research method, this study analyzes the concept of restorative justice in addressing hate speech through interviews with legal stakeholders and legal literature and scientific analyzes. This discussion finds, first, that law enforcement against hate speech under the ITE Law remains suboptimal and fails to fully reflect the principles of substantive justice. A punitive-centric approach often neglects critical social dimensions, including the perpetrator’s background, the victim’s circumstances, and the broader cultural context—resulting in legal disparities and the risk of societal over-criminalization. Second, a shift toward restorative justice is imperative. This paradigm offers a more humanistic and transformative framework by prioritizing the restoration of social relations, victim recovery, and the active accountability of offenders. Its inclusive and dialogical nature fosters reconciliation and contributes to a more just, inclusive, and sustainable legal system.

Abstract

Economic globalization has led to the birth of an integrated international trading system through multilateral legal regimes. International trade law no longer merely regulates cross-border transactions, but has developed into an instrument of global economic integration that shapes the national policy structure of member states. The World Trade Organization (WTO) plays a central role as an institution that institutionalizes the principles of liberalization, non-discrimination, and certainty of trade law through various multilateral agreements. This research aims to analyze the position of international trade law as an instrument of global economic integration and examine the normative role of the WTO in shaping world trade governance. The method used is normative legal research with legislative, conceptual, and comparative approaches. The results of the study show that the WTO has succeeded in creating harmonization of global trade standards through the principles of Most Favoured Nation, National Treatment, and a binding dispute resolution mechanism. However, such integration still leaves the problem of structural inequality between developed and developing countries, the weak effectiveness of Special and Differential Treatment, and limited national policy space. Therefore, WTO governance reform and strengthening the domestic capacity of developing countries are needed so that global economic integration takes place in a fair and sustainable manner.

Abstract

This study examines the increasing demands of globalization by asserting that higher education institutions must develop governance systems that operate effectively and ensure accountability. It argues that the implementation of Good University Governance functions as a strategic instrument to reinforce transparency, accountability, and participatory management within higher education institutions. The study investigates whether such implementation can significantly enhance educational quality in accordance with sustainable development objectives. Employing a normative legal research method, this research applies statutory, conceptual, and comparative approaches, including a comparison with governance practices in Malaysia and Singapore. The findings demonstrate that first, the implementation of Good University Governance substantially improves the quality of university governance by promoting institutional transparency, accountability, and responsiveness to societal needs. Second, higher education institutions encounter persistent challenges in implementing Good University Governance, particularly in relation to inadequate infrastructure, limited human resource capacity, regulatory inconsistency, and weak monitoring and transparency mechanisms. Third, the study formulates legal strategies that prioritize regulatory strengthening, effective supervision, protection of stakeholder rights, and the integration of technology to establish adaptive, transparent, and accountable governance systems that support the realization of quality education within the framework of sustainable development.

Abstract

Objectives: This study aims to analyze the influence of Sharia values in the portfolio optimization process and evaluate their specific contribution to risk and return within the Indonesian Sharia capital market.Methodology: This research used a quantitative approach with a descriptive-associative design. Analyze secondary data (stock prices and financial statements) from companies in the Jakarta Islamic Index (JII) for the 2018–2024 period. The analysis combined the Markowitz portfolio optimization method with multiple linear regression to test the impact of Sharia compliance on performance.Findings: Integrating Sharia values enhances portfolio efficiency, evidenced by higher Sharpe ratios and lower risk levels (11.80% vs 13.50% in traditional models). Furthermore, the regression analysis showed that the Sharia compliance score has a positive and significant impact on portfolio returns, with a coefficient of 0.031 and a p-value of 0.011.Conclusion: Applying Sharia values to portfolio optimization is an adaptive and strategic approach that makes portfolios not only ethical but also financially competitive. The study concludes that Sharia principles serve as a tool for risk mitigation and enhance long-term investment sustainability.
