Abstract

This article examines the role of key Islamic jurisprudential principles as constraints in the application of Islamic law, particularly in situations involving emergencies or conflicting obligations. It focuses on two foundational rules: al-rukhaṣ lā tunāṭ bi al-maʿāṣī (legal relief does not apply to immorality) and al-wājib lā yutraq illā li-wājib (an obligation may not be abandoned except for the sake of another obligation). Through a library-based research method, the study analyzes the meanings, sources, and practical relevance of these principles by discussing contemporary scenarios such as invoking rukhṣah during sinful travel, postponing prayer due to urgent medical duties, and balancing academic commitments with the obligation of Friday prayer. The findings highlight the significance of employing the principles of caution (iḥtiyāṭ) and prioritization (tartīb al-awlawiyyāt) in legal istinbāṭ (derivation). These limiting principles serve to protect the integrity of Sharia from the misuse of emergency concessions while promoting justice, public benefit (maṣlaḥah), and alignment between scriptural texts and real-life contexts. The integration of these rules is essential for formulating contextual Islamic legal responses that remain faithful to ethical and evidentiary foundations of Sharia.

Abstract

Islamic banking in Indonesia has undergone significant growth since the establishment of Bank Muamalat in 1991. This study examines the regulatory framework, operational principles, and the challenges and opportunities facing Islamic banking in addressing contemporary financial issues. Utilizing a descriptive-qualitative approach through a literature study, the research identifies Law No. 21 of 2008 and fatwas issued by the National Sharia Council–Indonesian Ulema Council (DSN-MUI) as the primary legal and ethical foundations for Islamic banking operations. Key contract mechanisms such as muḍārabah, mushārakah, and murābaḥah serve as Sharia-compliant alternatives to conventional interest-based systems. Despite this progress, Islamic banking faces several challenges, including low levels of Sharia literacy among the public, limited digital innovation, and intense competition with conventional banks. However, significant opportunities exist through partnerships with Islamic fintech, integration of Islamic social finance instruments (ZISWAF), and the promotion of sustainable finance initiatives aligned with the objectives of maqāṣid al-sharīʿah. The study underscores the need to strengthen regulatory frameworks and embrace technological advancements to build an inclusive, competitive, and future-ready Islamic banking system in Indonesia.

Abstract

The rapid advancement of digital technology has transformed global financial systems and introduced new instruments such as cryptocurrencies, which have attracted widespread attention in modern society. This article, titled “Digital Transactions and Cryptocurrency in the Perspective of Contemporary Fiqh al-Muamalah,” aims to analyze the legal status, ethical dimensions, and socio-economic implications of digital assets within the framework of Islamic jurisprudence. The study employs a qualitative-descriptive approach, drawing upon classical and contemporary fiqh sources, scholarly fatwas, and modern Islamic financial regulations. The findings indicate that digital transactions, including cryptocurrency usage, are permissible (mubah) under Islamic law, provided they fulfill the principles of Islamic muamalah—namely contractual clarity (al-aqd al-sarih), justice (al-adl), and avoidance of gharar (uncertainty), riba (usury), and maisir (gambling). Cryptocurrencies may be recognized as a legitimate form of investment and medium of exchange when their intrinsic value, transparency, and purpose align with Shariah principles. However, the volatility of value and potential misuse in illicit transactions necessitate strong Shariah oversight and state regulation. Therefore, from the standpoint of contemporary fiqh al-muamalah, cryptocurrencies can be classified as mal istibdali (substitutable assets), permissible under Shariah when they serve public benefit (maslahah ammah) and uphold ethical financial practices.

Abstract

Penelitian ini melakukan analisis komparatif-kritis terhadap Tafsir Al-Manar dan Tafsir Al-Maraghi, yang sama-sama bercorak Adabi Ijtima'i, untuk mengungkap akar perbedaan ('illat al-ikhtilaf) respons mereka terhadap modernitas. Melalui pendekatan kualitatif dengan metode muqāranah dan analisis konten, penelitian ini menganalisis aspek metodologis dan penafsiran substantif terhadap tiga ayat kunci: Q.S. Yunus [10]: 100 (akal), Q.S. An-Nisa' [4]: 59 (politik), dan Q.S. An-Nisa' [4]: 34 (keluarga). Temuan penelitian mengungkapkan bahwa meskipun berbagi corak dasar, kedua tafsir menunjukkan divergensi yang sistematis. Al-Manar, dengan dominasi bil ra'yi (70%) dan corak Islahi-Siyasi, menghasilkan respons yang transformatif dan polemis. Sebaliknya, Al-Maraghi, dengan dominasi bil ma'tsur (60%) dan corak Tarbawi-Ilmi, menghasilkan respons yang stabilisasi-edukatif. Penelitian ini menyimpulkan bahwa 'illat al-ikhtilaf utama terletak pada interaksi antara Tsaqofah al-Mufassirin (kerangka intelektual-kelembagaan) dan konteks historisnya. Al-Manar, produk Tsaqofah Salafi-Aktivis di era Modern Awal, mengadvokasi tajdid transformatif-politis. Sementara Al-Maraghi, produk Tsaqofah Azhari-Institusional di era Modern Pertengahan, mengadvokasi tajdid stabilisasi-edukatif. Dengan demikian, studi ini tidak hanya memetakan perbedaan, tetapi juga berkontribusi pada ilmu tafsir dengan memperkenalkan Tsaqofah al-Mufassirin sebagai kerangka analitis dan dua model pembaruan (tajdid) yang lahir dari corak Adabi Ijtima'i.
