Abstract

This study examines the existence and role of Customary Law in the recognition and protection of collective rights of Betawi Batik motifs as Traditional Cultural Expressions (TCE) and Traditional Knowledge (PK). Betawi Batik motifs have communal values ​​that are vulnerable to exploitation, and literature analysis shows that the formal Intellectual Property Rights (IPR) regime (Copyright and Industrial Design) is inadequate due to its individualistic nature and time constraints. This creates a protection gap against the collective rights of the Betawi community. This normative legal research uses a literature review, focusing on the synchronization of Customary Law norms and positive IPR. The results indicate that the principle of communal ownership and control functions through the Betawi Cultural Institution (LKB) still exist and are relevant. Therefore, this study constructs an integrative sui generis legal protection model. This model rests on three pillars: Communal Registration in the TCE database, Customary Control Mechanisms through BCIapproval, and Strengthening Ex-Officio Protection by the government. This model is expected to realize cultural justice and provide legal certainty for the preservation and commercialization of Betawi Batik in a sustainable manner. Abstract

Permasalahan sampah plastik di Indonesia semakin mengkhawatirkan seiring tingginya penggunaan plastik sekali pakai, termasuk di kalangan remaja. Kondisi ini menuntut keterlibatan generasi muda sebagai agen perubahan dalam upaya pengelolaan sampah yang berkelanjutan. Penelitian ini bertujuan untuk menganalisis peran remaja dalam pengurangan sampah plastik di Kecamatan Wuluhan, Kabupaten Jember, serta mengidentifikasi faktor sosial, religius, dan komunitas yang memengaruhi partisipasi mereka. Penelitian menggunakan pendekatan kualitatif dengan desain studi kasus. Teknik pengumpulan data meliputi wawancara mendalam, observasi partisipatif, dan dokumentasi. Analisis data dilakukan menggunakan model interaktif Miles dan Huberman yang mencakup proses reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa remaja berperan aktif dalam pengurangan sampah plastik melalui kegiatan pengumpulan dan pemilahan sampah, inovasi daur ulang berbasis kreativitas, serta kampanye lingkungan melalui media digital. Partisipasi remaja didorong oleh meningkatnya kesadaran ekologis, internalisasi nilai-nilai keagamaan, solidaritas sosial, dan dukungan kepemimpinan komunitas. Penelitian ini memperluas teori perilaku terencana dengan menegaskan bahwa faktor sosial dan spiritual berperan penting dalam membentuk perilaku ekologis remaja. Temuan ini mengindikasikan bahwa pemberdayaan remaja berbasis komunitas dan nilai lokal menjadi strategi efektif dalam pengelolaan sampah plastik yang berkelanjutan.
