Abstract

This study aims to analyze and formulate the restructuring of traditional medicine regulation within the national health system using a legal pluralism perspective to address the disharmonization of laws and regulations. This effort is undertaken to achieve legal certainty, public protection, and fair recognition of traditional practices. The research method employed is normative juridical, focusing on the analysis of legal norms, principles, and rules through statutory, theoretical, and doctrinal approaches. Data were collected through a literature review of primary, secondary, and tertiary legal materials, which were then analyzed qualitatively using legal interpretation and deductive reasoning. The regulation of traditional medicine currently has a strong foundation through Law Number 17 of 2023 on Health; however, significant normative disharmonization still exists. Regulatory conflicts are evident in the potential criminalization under the Criminal Code (KUHP) of non-medical practices deemed misleading, while the Health Law provides recognition of such practices. Formal standards established by the government tend to follow a modern medical paradigm, making them difficult for traditional practitioners—who rely on empirical experience and local wisdom—to fulfill. Protection of traditional knowledge as a collective right of indigenous communities has also not been adequately regulated within the national legal framework. An ideal regulatory restructuring requires synchronization among regulations and the adoption of legal pluralism principles so that the state legal system can accommodate customary law and social norms living within society. Certification mechanisms need to be made more inclusive by recognizing hereditary expertise, and supervision should be designed in a participatory manner involving local communities. Integrated harmonization will create a balance between the recognition of cultural identity and the assurance of safety for service users.

Abstract

This research aims to analyze the impact of legal pluralism on the protection of human rights and examine its implications on the development of the national legal system in Indonesia in order to find a concept that bridges the diversity of the system with the principle of justice. The type of research used is normative law that focuses on the study of legal norms, principles, and doctrines through a statutory approach and a conceptual approach. Secondary legal materials collected through literature studies are analyzed qualitatively with a deductive thinking pattern to produce systematic and logical conclusions related to the problem being studied. Legal pluralism in Indonesia manifests in the interaction between state law, customary law, and religious law that apply simultaneously and provides a choice for people to choose norms that suit their interests. The existence of this diverse system has a positive impact on the recognition of indigenous peoples' rights and access to substantive justice, but on the other hand it triggers legal uncertainty and potential human rights violations due to the dominance of state law or the practice of forum shopping. The development of the national legal system responds to this reality through efforts to harmonize regulations, as seen in the constitutional recognition of the unity of customary law communities and the integration of living law in the new Criminal Code. Legal reform is directed at the establishment of a system that is no longer centralistic, but is able to accommodate local values in order to achieve a balance between national interests and the protection of the rights of minority groups.

Abstract

This study aims to analyze in depth the strategic role of hospital management at RSU Agung Mulia in formulating policies, implementing cyber protection systems, and overcoming operational constraints to ensure health information security and prevent patient data breaches. A qualitative approach with a descriptive research type was applied to uncover facts directly in the field through a natural setting. The primary data collection technique was conducted through in-depth interviews with three key informants, namely the Director, the Head of the Information Technology Unit, and the Head of the Medical Records Department, which was further strengthened by objective direct observation methods. The data analysis procedure followed an interactive model encompassing data reduction, data display, and conclusion drawing stages. The results of the study indicate that management policies are focused on formulating strict internal regulations, restricting medical data access rights based on job roles, and mandating the signing of staff integrity pacts. The main obstacles faced by the institution include operational budget constraints, outdated hardware conditions, and low digital literacy among administrative staff, which trigger human errors in the service area. Managerial efforts to circumvent these limitations are realized through a financial cluster strategy with hardware leasing options, optimizing operating systems using open-source software, and conducting periodic phishing attack simulations. The implementation of a reward and punishment system combined with the appointment of cyber pioneers has proven successful in altering staff behavior to become more disciplined and increasing operational compliance in safeguarding patient data confidentiality.

Abstract

The phenomenon of medical disputes following the enactment of Law No. 17 of 2023 indicates the vulnerability of health workers to criminalization when medical services result in patient harm. Despite the issuance of the latest regulations, there is a research gap regarding the operational boundaries between excusable medical risks and punishable professional negligence. This study aims to analyze the legal protection mechanisms for health workers from the latest health law perspective. The research method used is normative legal research with statutory and conceptual approaches. The results show that Law No. 17 of 2023 provides legal protection through professional immunity rights, provided that standard operating procedures are met, along with a filtering mechanism through the Disciplinary Body to prevent premature criminalization. The study concludes that legal protection for health workers is integrative, balancing professional career certainty and patient protection rights through restorative justice. It is recommended that the government immediately issue technical implementing regulations regarding the examination procedures of the Disciplinary Body to ensure uniform procedures for law enforcement officers. Furthermore, health service facilities need to strengthen legal aid systems and risk management to mitigate the escalation of medical disputes in the future.

Abstract

Traditional health services are increasingly sought by the public as an alternative or complement to modern medical treatment. Although these practices are recognized within Indonesia’s national legal system, existing regulations remain incomplete, particularly concerning civil law liability when harm occurs to clients. This study analyzes the forms of liability borne by business actors, including liability arising from tort and default, as well as mechanisms for dispute resolution and compensation. Employing a normative juridical method, this research integrates statutory, conceptual, and case approaches. Data were collected through literature studies and analyzed qualitatively. The findings indicate that business actors may be held legally accountable under Article 1365 and Article 1239 of the Indonesian Civil Code. Liability may result in both material and immaterial compensation, provided in accordance with applicable positive law in Indonesia. Strengthening regulations on traditional health services is therefore essential to ensure legal certainty and protection for consumers while maintaining professional accountability.

Abstract

Rendahnya pemahaman masyarakat desa terhadap sistem hukum waris di Indonesia yang bersifat pluralistik, baik berdasarkan Kitab Undang-Undang Hukum Perdata maupun Kompilasi Hukum Islam, sering menimbulkan sengketa keluarga, ketidakadilan pembagian harta warisan, dan konflik berkepanjangan. Permasalahan tersebut juga terjadi di Desa Kedungbanteng, Kabupaten Blitar, yang masyarakatnya masih terbatas dalam memahami konsep dasar hukum waris, persamaan dan perbedaan sistem waris, serta mekanisme pembagian waris yang sesuai dengan ketentuan hukum. Kegiatan pengabdian kepada masyarakat ini bertujuan meningkatkan pengetahuan dan kesadaran hukum masyarakat terkait pembagian waris yang adil dan sesuai hukum. Metode pelaksanaan dilakukan melalui penyuluhan hukum, diskusi interaktif, dan sesi tanya jawab dengan pendekatan partisipatif. Kegiatan diikuti oleh 45 peserta yang terdiri dari perangkat desa, tokoh masyarakat, guru, dan warga Desa Kedungbanteng. Materi disampaikan secara sederhana dan aplikatif dengan contoh kasus konkret pembagian waris. Evaluasi dilakukan melalui pretest dan posttest serta observasi partisipasi peserta selama kegiatan berlangsung. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat sebesar 75% terkait konsep hukum waris dan mekanisme pembagian warisan menurut KUHPerdata dan KHI. Selain itu, peserta menunjukkan meningkatnya kesadaran untuk menyelesaikan pembagian waris secara musyawarah dan sesuai ketentuan hukum. Kegiatan ini diharapkan menjadi langkah preventif dalam meminimalkan sengketa waris serta memperkuat keharmonisan keluarga dan ketertiban sosial di masyarakat desa.   Abstract  The low level of understanding among village communities regarding Indonesia's pluralistic inheritance law system, both based on the Civil Code and the Compilation of Islamic Law, often leads to family disputes, unfair inheritance distribution, and prolonged conflict. This problem also occurs in Kedungbanteng Village, Blitar Regency, where the community still has limited understanding of the basic concepts of inheritance law, the similarities and differences between inheritance systems, and inheritance distribution mechanisms in accordance with legal provisions. This community service activity aims to increase public knowledge and legal awareness regarding fair and legal inheritance distribution. The implementation method is carried out through legal counseling, interactive discussions, and question and answer sessions with a participatory approach. The activity was attended by 45 participants consisting of village officials, community leaders, teachers, and residents of Kedungbanteng Village. The material was presented in a simple and applicable manner with concrete examples of inheritance distribution cases. Evaluation was carried out through pretest, posttest, and participant observation during the activity. The results of the activity showed a 75% increase in community understanding regarding the concept of inheritance law and inheritance distribution mechanisms according to the Civil Code and the Compilation of Islamic Law. Furthermore, participants demonstrated increased awareness of the importance of resolving inheritance distribution through deliberation and in accordance with legal provisions. This activity is expected to serve as a preventative measure to minimize inheritance disputes and strengthen family harmony and social order in village communities.

Abstract

This study aims to evaluate and synthesize the legal responsibilities of traditional health service providers under Law No. 17 of 2023 on Health. Using a qualitative approach with a Systematic Literature Review (SLR) design, the research identifies regulatory developments and legal practices relevant to traditional health services in Indonesia. Data collection involved online databases such as Science Direct, PubMed, and Google Scholar, using keywords like “legal responsibility,” “traditional health services,” and “Health Law No. 17 of 2023.” Samples were purposively selected based on inclusion criteria, including publications from 2023 to 2025 explicitly discussing legal issues in traditional health services.The study employed a systematic protocol comprising selection guidelines, quality criteria, and data extraction formats. Thematic analysis was used to identify key patterns such as forms of legal responsibility, mechanisms for patient protection, and standards for traditional health practices. The findings reveal that Law No. 17 of 2023 provides a more comprehensive legal framework by regulating administrative obligations, civil responsibilities, and criminal sanctions for traditional health service providers. Additionally, the law strengthens patient protection mechanisms through quality standardization, practice licenses, and service transparency. Despite its limitation in not conducting field studies and potential bias from online literature, the research process upheld scientific integrity and academic transparency. The study significantly contributes to understanding the relevance of traditional health regulations in legal practice in Indonesia and serves as a foundation for future policy development.

Abstract

This study aims to analyze the juridical implications of the total prohibition of female circumcision under Article 102(a) of Government Regulation No. 28 of 2024 and to formulate a principled legal classification that distinguishes physically harmful invasive procedures from non-invasive symbolic cultural or religious practices. The enactment of Article 102(a) marks a decisive regulatory shift from the conditional harm-reduction framework of Ministry of Health Regulation No. 1636/2010 to a categorical ban; however, the provision's failure to define the boundary between invasive female genital mutilation and non-invasive symbolic acts generates three compounding juridical failures: unresolved constitutional tension with Article 18B(2) of the 1945 Constitution, unjustified legal exposure for healthcare workers performing harmless symbolic acts, and the risk of driving dangerous clandestine practices. No prior study has addressed this interpretive gap through a doctrinal classification framework applicable to Article 102(a). This study employs a normative legal research method integrating statutory, conceptual, and case approaches, with analysis conducted through identification, systematization, interpretation, and norm construction stages. The findings establish a two-tier classification model structured around four objective indicators — physical harm, medical risk, instrument use, and legal consequence — distinguishing Category 1 invasive FGM (subject to absolute prohibition) from Category 2 non-invasive symbolic rituals (conditionally permissible). The study further proposes a four-paragraph normative reformulation of Article 102(a) and recommends the issuance of technical implementing guidelines to operationalize the classification, protect healthcare workers from disproportionate liability, and harmonize health law unification with Indonesia's constitutionally recognized legal pluralism.

Abstract

Pelaksanaan informed consent dalam pelayanan kesehatan di Indonesia masih menghadapi kesenjangan antara norma hukum dan praktik lapangan, termasuk di rumah sakit rujukan nasional. Penelitian ini bertujuan menganalisis implikasi hukum informed consent, pembatasan tanggung jawab hukum dokter, serta perlindungan hukum bagi dokter dan pasien di RSUP Dr. Sitanala Banten. Metode yang digunakan adalah yuridis empiris dengan pendekatan perundang-undangan dan konseptual; data diperoleh melalui wawancara mendalam terhadap lima informan dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa: (1) informed consent menjadi dasar legalitas tindakan medis dan menimbulkan hubungan hukum yang mengikat antara dokter dan pasien; (2) tanggung jawab hukum dokter dibatasi oleh standar profesi dan pelaksanaan informed consent yang sah, sehingga komplikasi yang telah diinformasikan tidak otomatis dikategorikan sebagai kelalaian; dan (3) informed consent berfungsi sebagai instrumen perlindungan hukum preventif yang menjamin hak pasien atas informasi sekaligus memberikan kepastian hukum bagi dokter. Penelitian ini merekomendasikan penguatan supervisi informed consent dan peningkatan kualitas komunikasi medis sebagai upaya pencegahan sengketa medis.

Abstract

Pelanggaran kerahasiaan informasi kesehatan pasien oleh dokter merupakan fenomena hukum yang semakin mengkhawatirkan di Indonesia, mengingat data BSSN mencatat 103 insiden kebocoran data sepanjang 2023 dan Indonesia masuk 10 besar negara dengan kebocoran data terbesar di dunia. Penelitian ini bertujuan menganalisis bentuk pelanggaran perdata pemberian informasi kesehatan pasien oleh dokter secara tidak sah, pertanggungjawaban perdata dokter berdasarkan Pasal 1365 KUHPerdata, serta mekanisme penyelesaian sengketa yang tersedia bagi pasien yang dirugikan. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa: (1) bentuk pelanggaran mencakup pemberian informasi kepada pihak tidak berwenang, pembukaan rekam medis tanpa persetujuan, penyebaran melalui media digital, dan penyalahgunaan data kesehatan; (2) pertanggungjawaban perdata timbul apabila terpenuhi unsur perbuatan melawan hukum, kesalahan, kerugian, dan kausalitas; (3) penyelesaian sengketa dapat dilakukan melalui litigasi maupun non-litigasi dengan prioritas mediasi. Penelitian ini merekomendasikan penguatan regulasi teknis perlindungan data kesehatan digital dan peningkatan kesadaran hukum tenaga medis.
