Abstract

Kegiatan Pengabdian Kepada Masyarakat ini berjudul “Penyuluhan Hukum Pelestarian Lingkungan Daerah Pesisir”. Tujuan dari kegiatan pengabdian ini adalah untuk meningkatkan pemahaman masyarakat terkait penegakan hukum lingkungan mengenai pelestarian lingkungan daerah pesisir  sehingga dapat memberikan kepastian hukum dan perlindungan hukum serta pencegahan kerusakan lingkungan. Target capaian luaran kegiatan pengabdian kepada masyarakat ini adalah sebagai berikut: (a) publikasi pada jurnal ber-ISSN, (b) publikasi pada media massa, (c) peningkatan pemahaman hukum bagi masyarakat. Tahapan kegiatan yang akan dilakukan sebagai berikut: (a) tahap persiapan meliputi: survey; pemantapan dan penentuan lokasi dan sasaran; penyusunan bahan/materi pelatihan, yang meliputi: bahan tayangan, slide powerpoint, (b) tahap pelaksanaan meliputi: (1) penjelasan materi tentang pelestarian lingkungan daerah pesisir. Sesi ini juga menitikberatkan pada pemberian penjelasan hukum sebagai wujud edukasi kepada mitra, (2) penyuluhan hukum pelestarian lingkungan daerah pesisir tersebut dilakukan oleh tim pengabdian masyarakat dari perguruan tinggi dengan melibatkan mahasiswa.  Metode yang digunakan selama proses kegiatan pengabdian kepada masyarakat meliputi: (a) metode ceramah dipilih untuk memberikan penjelasan langsung materi penyuluhan pelestarian lingkungan daerah pesisir, (b) metode tanya jawab yang memungkinkan masyarakat menggali pengetahuan sebanyak-banyaknya tentang materi penyuluhan.

Abstract

Kegiatan Pengabdian kepada Masyarakat ini bertujuan untuk meningkatkan pengetahuan, pemahaman, dan kesadaran hukum masyarakat mengenai pelestarian lingkungan daerah pesisir di Kelurahan Tondonggeu, Kecamatan Nambo, Kota Kendari. Permasalahan yang dihadapi mitra adalah masih rendahnya kesadaran masyarakat terhadap pentingnya menjaga kelestarian lingkungan pesisir, terutama terkait pembuangan sampah dan perlindungan ekosistem pesisir, sehingga berpotensi menimbulkan pencemaran dan kerusakan lingkungan. Kegiatan dilaksanakan melalui metode penyuluhan hukum dengan pendekatan ceramah, diskusi, dan tanya jawab yang melibatkan dosen, mahasiswa, serta masyarakat setempat. Materi yang disampaikan mencakup ketentuan peraturan perundang-undangan di bidang perlindungan dan pengelolaan lingkungan hidup, khususnya Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup serta regulasi terkait pengelolaan wilayah pesisir. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat mengenai pentingnya menjaga kelestarian lingkungan pesisir, hak dan kewajiban masyarakat dalam perlindungan lingkungan, serta dampak hukum dan lingkungan akibat pencemaran. Antusiasme peserta selama kegiatan juga menunjukkan meningkatnya kesadaran hukum masyarakat untuk berpartisipasi aktif dalam menjaga kelestarian wilayah pesisir. Dengan demikian, penyuluhan hukum ini efektif sebagai upaya edukasi dalam membangun budaya sadar hukum dan mendorong partisipasi masyarakat dalam mewujudkan pengelolaan lingkungan pesisir yang berkelanjutan.

Abstract

This research is entitled "Legal Protection for Minors Victims of Online Prostitution Through the Michat Application in Kendari City." The actual situation that is intended to be realized through the Child Protection Law is the protection and guarantee of children's rights from all actions or deeds that are detrimental to them. Children, as the next generation of the nation's ideals in their growth and development, have the right to protection from sexual violence, torture, and treatment that degrades their dignity as human beings. Children must receive protection so that they do not become victims of any crime, including sexual violence committed directly or indirectly by individuals, groups, or the government. The very rapid development of information technology has both positive and negative impacts on people's lives. One of the most disturbing negative impacts is the increase in sexual crimes against children in cyberspace. Children as a vulnerable group require special legal protection due to their inability to defend themselves physically and mentally. This study aims to determine how the regulation and implementation of legal protection for children as victims of prostitution through the Michat application in Kendari City. This research is interesting for examining the legal protection model, as legal protection is key to realizing the ideals of law itself: legal certainty, justice, and utility. This article employs a normative, empirical legal research approach, drawing on primary and secondary legal sources, utilizing three approaches to the problem: the statute approach, the conceptual approach, and the case approach.

Abstract

Coastal communities possess social, economic, and geographic characteristics that can create barriers to the fulfillment of the right to health, particularly for women and children. Limited access to legal information and healthcare services means that some community members do not fully understand that health is a fundamental right guaranteed by the constitution and statutory regulations. This community service initiative aims to raise legal awareness among coastal residents in Mowundo Village, North Konawe Regency, regarding the protection and fulfillment of the right to health for women and children. The activity was conducted using a legal outreach method comprising preparation, material presentation, interactive discussion, a question-and-answer session, and an evaluation of participant understanding. The outreach material covered the legal basis for the right to health, women's rights regarding reproductive health services, children's rights to adequate healthcare and proper growth and development, the prevention of violence against women and children, and mechanisms for lodging complaints and resolving rights violations. The results indicate an improved understanding among the community regarding the status of women and children as rights-holders, as well as the responsibilities of families, the community, village government, and the state in ensuring the fulfillment of the right to health. The initiative also encouraged residents to be more proactive in accessing healthcare services, filing complaints, and participating in creating a healthy coastal environment that is supportive of women and children. Thus, legal outreach serves as an educational tool to strengthen legal awareness and support the sustainable improvement of public health standards.

Abstract

The "mail-order bride" phenomenon frames marriage as a context that can be exploited for the recruitment, transportation, harboring, or control of women for the purpose of exploitation. From a victimological perspective, the central issue is not merely whether a marriage appears voluntary, but rather how factors such as socio-economic vulnerability, gender inequality, deception, abuse of a position of vulnerability, dependency on intermediaries, and post-departure isolation shape the victimization process. This study employs a normative-juridical method—incorporating statutory, conceptual, victimological, and contextual socio-legal approaches—based on a literature review of regulations, scholarly works, prior court rulings and studies, and official sources regarding human trafficking. The analysis reveals that the mail-order bride scheme is covert in nature, as trafficking relationships can be disguised as marital unions. A victim's consent to the marriage does not automatically negate the possibility of human trafficking if elements such as deception, abuse of a position of vulnerability, payments or benefits to those controlling the victim, and an intent to exploit are present. In Southeast Sulawesi, a research gap exists regarding the lack of developed databases and empirical studies that specifically map the pathways to victimization for women in the region—including factors such as migration, poverty, access to employment, legal and digital literacy, and inter-regional or transnational recruitment mechanisms.

Abstract

Law enforcement against offenders afflicted with severe mental disorders, particularly paranoid schizophrenia, frequently generates juridical controversy regarding the fulfillment of the geen straf zonder schuld principle (no punishment without fault) as stipulated in Article 44 of the Indonesian Criminal Code (KUHP). This phenomenon is vividly illustrated in Decision Number 150/Pid.B/2024/PN.Jkt.Brt, in which the defendant, Andi Andoyo, was sentenced to sixteen years of imprisonment for the premeditated murder of Fresa Danella, despite medical evidence comprising a Visum et Repertum Psychiatricum and sworn forensic psychiatric expert testimony confirming his diagnosis of paranoid schizophrenia. This study aims to examine the construction of criminal responsibility (toerekeningsvatbaarheid) attributed to the paranoid-schizophrenic perpetrator in the decision in question and to analyze it from a criminological perspective in order to trace the criminogenic factors underlying the offense. Employing a normative legal research method with statutory, conceptual, and case approaches, this study qualitatively analyzes secondary legal data through descriptive analysis. The findings indicate that the panel of judges disregarded the medical evidence and nonetheless constructed the defendant as a legal subject possessing full capacity for criminal responsibility, a conclusion that contradicts Van Hamel's cumulative parameters of responsibility as well as the juridical recognition afforded by Law Number 18 of 2014 concerning Mental Health. Criminologically, the element of "prior planning" used as the basis for aggravating the sentence is more accurately understood as a pseudo-adaptive response to command hallucinations and delusions, compounded by a systemic failure of social and medical supervision as explained through social control theory. This study concludes that retributive imprisonment without an accompanying order for comprehensive psychiatric rehabilitation fails to address the criminogenic root of the problem and risks becoming a flawed precedent for the future adjudication of persons with mental disorders (ODGJ), thereby underscoring the need for consistent application of Article 44 of the KUHP grounded in a multidimensional approach integrating legal, psychopathological, and social dimensions
