Abstract

The Ministry of Religion of Malang City in September 2023 launched a religious moderation village. From this village, there are families who have multiple religions, whether from the father, mother, or child. In this case, the head of the Ministry of Religion hopes that there will be an emphasis on the urgency of togetherness and moderation in religion to realize harmony in the Indonesian state, because religious diversity in Indonesia has great potential that must be protected and fostered, especially through a religious moderation program that must be pursued from the smallest sector of the State, namely a multi-religious family. In this study, field research was used to obtain objective, actual, and strong data. The data source was taken directly from the research location, which was done by visiting the informants through interviews. The researcher conducted interviews with multi-religious families in the religious moderation village in Malang City. Multifaith families often face challenges both within and outside the family. The most common challenge is social pressure, meaning that in societies where interfaith marriages and families are accepted or extended families are accepted, although not common, family members may put pressure on spouses and children to choose a religion.

Abstract

This article examines whether ridha in fiqh munakahat can remain legally meaningful when a child's apparent assent is produced through grooming. The study departs from a doctrinal gap: classical fiqh generally discusses ridha in relation to coercion (ikrah), whereas child grooming operates through gradual psychological manipulation and unequal power relations. Using normative legal research with a conceptual and maqasid-based approach, this article analyzes classical discussions of ridha together with Jasser Auda's maqasid al-shariah, especially hifz al-nafs, hifz al-'aql, and hifz al-nasl. The article argues that a child's compliance in a grooming situation cannot be treated as valid ridha because it lacks psychological maturity, freedom from manipulation, and awareness of consequences. Its contribution lies in proposing a substantive formulation of ridha that moves beyond formal consent and functions as a doctrinal test for assessing exploitative relationships involving children. This reformulation strengthens the child-protective orientation of Islamic family law and clarifies the normative incompatibility between grooming and the objectives of sharia.

Abstract

Inkonsistensi yuridis telah menimbulkan perbedaan dalam implementasi praktis hukum keluarga di Indonesia, baik dalam aspek perkawinan, perceraian, dan harta waris. Tujuan dari penelitian ini adalah menganalisis inkonsistensi yuridis antara KHI dan KUHPerdata untuk mewujudkan harmonisasi hukum. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan metode analisis komparatif. Hasil penelitian menunjukkan bahwa inkonsistensi antara KHI dan KUHPerdata muncul karena perbedaan sumber hukum dan filosofi dasar. KUHPerdata bersumber dari hukum sipil Eropa (Burgerlijk Wetboek) yang bersifat sekuler dan menempatkan individu sebagai subjek hukum yang otonom. Sementara KHI bersumber dari Al-Qur’an, hadis, dan fiqh, dengan sumber dari ajaran Islam. Inkonsistensi tersebut terjadi dalam berbagai kasus baik di aspek perkawinan, aspek perceraian, dan aspek kewarisan. Oleh karena itu, upaya harmonisasi dapat dilakukan melalui pembaharuan legislasi, pedoman Mahkamah Agung, sosialisasi dan pendidikan hukum, serta penguatan peran hakim.
