Abstract

Abstract: This study aims to find out how the breakthroughs and policy change during the reign of Caliph Umar bin Abdul Aziz in the context of prospering his people, using qualitative methods that are used descriptively. The sources used are historical sources using library data. The result shows that public financial management policy of Caliph Umar bin Abdul Aziz is by optimizing state revenue by using zakat as the main source, optimizing jizyah, kharaj, usyur, ghanimah/fai, and taxes (dharibah). Improving the people’s welfare by optimizing the budget for people's welfare by created a good economic facilities and fixed up the agriculture fields. Whilst the impact of the policy carried out by Umar bin Abdul Aziz is an increase in people’s welfare, an increase in people's purchasing power, a reduction in poverty, a reduction in taxes because many of them changes theis faith to Islam, and those enhancement as the realization of the high islamic’s commitment in brotherhood and prosperity. Attainment of welfare was not only material or physical satisfaction, but also the fulfillment of spiritual needs as the capital for development. Abstract

Communication is a human need in every activity. Especially in muamalah, communication was an important role in the success and failure of these muamalah activities. Good communication can foster friendship and affection between humans. Ethics is a science that discusses the pros and cons of a human's behavior, human habits in his association with each other. Communication is the process of delivering a message or delivery of information which the meaning of the message’s sender to the recipient of the message, which is used as a tool to achieve certain goals. The ethics of Islamic communication is the procedure in conducting communication in accordance with moral values ​​in determining the good and bad behavior of a person by means of Islamic delivery, so that it leads to the benefit of humanity. This research uses library research method (literature) which focuses on searching and studying literature and other library materials by using qualitative methods and focusing the discussion on Surah al-Ahzab verse 32 and verse 70. Surah Al-Ahzab was a Madaniyah letter which discussing various legal issues, one of which is about the ethics of communication. Ethics in communication should be use qoulan karima and qoulan sadidan which are the teachings of Islam. Ethics taught in Surah al-Ahzab verse 32 and verse 70 teach us that in interacting we must use good ethics, especially in terms of communication, so as not to cause misinterpretation due to poor communication ethics.

Abstract

Waqf is also an instrument for creating justice and prosperity in the economic field. The main characteristic of endowments is when endowments have been fulfilled, then there is a shift in ownership from the owner to the ownership of Muslim communities which are expected to last and provide sustainable benefits. Waqf in the form of money (endowments of money) is seen as one way to make endowments can provide better and more results. Researchers are interested in conducting research on this waqf with a focus on looking at the behavior of the religious elites of the city of Malang in understanding and actualizing the endowments of money in their lives. In this case the religious elite of the city of Malang took samples from the Nahdlotul Ulama Organization (NU), Muhammadiyah and the Indonesian Islamic Da'wah Institute and some of the City boarding school caretakers. With the formulation of the problem 1) What are Malang City's religious elite views on the concept and implementation of cash waqf? 2) What is the appropriate format according to the religious elite of Malang City on the application of cash waqf? The type of research that will be used in this research is field research, namely research conducted in the arena or field of symptoms. With this type of research is expected to collect data and information obtained directly from respondents about the endowment of money for the religious elite in the city of Malang. The results of this study are the first religious elites of Malang City in terms of cash waqf giving legal jaiz in other words the practice of waqaf is not only dominated by the object of the object immovable waqaf, because it sees the situation and conditions that exist in society and for general welfare and not conflict with Sharia. Whereas in practice, the religious elite of Malang City has not yet carried out the mandate of the regulation stating that it must be orderly administration in terms of permits to be Nazar, deed of pledge waqaf and in cooperation with Islamic Financial Institutions (LKS). Second, the lack of information and socialization about this cash waqf, then the format that occurs in the community in applying this cash waqf is by directly giving the cash waqf property to Nazir directly. money that was forgiven. So that the religious elites of Malang also practice from what was signed above, because the contract directly from waqif explains in the contract for what the money is. As Muhammadiyah and other religious elites on that day also directly allocate the cash waqf received on the object of the contract that was explained at the time of the Waqf contract.

Abstract

Sebagai umat Muslim harus mencerminkan seluruh aktivitas sehari-harinya berdasarkan nila-nilai Islam, terutama dalam berekonomi sehingga perilaku bisnisnya pun harus berdasarkan prinsip dan nilai Islam. Selain itu, manajemen sumber daya manusia harus mampu diterapkan agar memperoleh manusia berkompeten dalam ekonomi dan bisnis sehingga terbentuk dalam perilakunya. Metode penelitian ini menggunakan kualitatif berupa studi pustaka. Hasilnya menunjukkan prinsip perilaku ekonomi dan bisnis Islam berupa tanggungjawab, keadilan, otonomi, dan integritas moral. Secara penerapan ekonomi dan bisnis Islam harus mampu mengaplikasikan keadilan dalam harga, pasar dan upah. Sistem keuntungannya tidak memperbolehkan adanya monopoli dan menghalalkan segala cara. Pada perilaku produksi mengutamakan prinsip kemaslahatan berupa proporsional, keadilan dan kepemilikan. Sedangkan konsumsi harus memperhatikan barang yang dikonsumsi, kehalalan dan kebutuhannya.

Abstract

Abstract The millennial era is a continuation of the globalization era as well as becoming a new era of challenges. Anyone who can make good use of it can become a great opportunity so that the challenge brings blessings. Conversely, for people who cannot utilize properly and appropriately, in navigating the ark of life this can experience failure and even deterioration. People who can turn challenges into opportunities will succeed in achieving life's ideals, reach their material and spiritual life well-being, and proportionally position their physical and spiritual needs. To help people who are not good at maximizing opportunities and challenges, especially in the millennial era, Islamic Extensiontake full responsibility and contribute to be part of the government to produce a generation ofWorkersmorality, smart, smart, devoted to achieving a noble life. This article uses qualitative research with a literature study approach. A literature study is a study conducted with a focus on books, scientific works such as journals, and various other scientific writings. This article concludes that the existence of Islamic Extension Workers in the middle of the community is very strategic with several potentials. First, PAI's strategic position helps to explore various information that is directly experienced by the community. Second, PAI's strategic position helps to understand the different characters of the community and requires handling different solutions. Third, it helps the government to form a society that is virtuous, moral who are praiseworthy, devoted, love the motherland, productive, directing people to achieve world success until the hereafter.

Abstract

This article is motivated by the conflict between the participants of Mubarakah Sharia Insurance and PT Asuransi Sharia Mubarakah after the bankruptcy decision. The case of PT Asuransi Syariah Mubarakah was examined and decided by the Commercial Court. Law No. 50/2009 concerning amendments to Law No. 3/2006 concerning the Religious Courts explains that Islamic economic disputes become the absolute competence of the Religious Courts. This gap needs to be reviewed from the theory of the law of the law and the principle of Lex posterior derogat priori legi. The next problem that arises is the non-fulfillment of the rights of the insurance participants after the bankruptcy decision. this issue is analyzed using the Fiduciari Duty, Ultra Vires and piercing the corporate veil approach in the context of corporate law. This approach is used to review legal protection for insurance participants. The method used is a Nomative qualitative approach. The data used are library research and field research. There are 2 conclusions in this article, First, the bankruptcy problem is still handled by the Commercial Court due to the strength of the rule of law and the tendency of the parties and curators who have confidence in the commercial court. Second, the lack of legal protection provided to the participants of PT. Mubarakah Sharia Insurance due to lack of legal protection from the Ministry of Finance and the Financial Services Authority and the absence of rules governing insurance participants (policyholders). Losses that cause companies to go bankrupt are seen as negligence of managers to conduct business such as not complying with the level of solvency and not conducting liquidation prior to bankruptcy. Therefore, the Curator should charge and hold the Directors and commissioners accountable for paying debts to insurance participants.

Abstract

Perkawinan yang sering menimbulkan perdebatan adalah perkawinan beda agama. Dari perkawinan beda agama tersebut dipandang sebagai salah satu faktor penghambat dalam mendapatkan kewarisan dari orang tuanya.Rumusan masalah adalah apakah faktor dan dampak perkawinan beda agama pada suku Bali sehingga tidak mendapatkan hak waris dan bagaimanakah hak waris akibat perkawinan beda agama perspektif hukum Islam dan gender pada masyarakat suku Bali di Desa Mulyosari Kecamatan Pasir Sakti Lampung Timur. Serta bertujuan untuk mengetahui faktor dan dampak perkawinan beda agama pada suku Bali sehingga tidak mendapdan untuk mengetahui atkan hak waris hak waris akibat perkawinan beda agama perspektif hukum Islam dan gender pada masyarakat suku Bali di Desa Mulyosari Kecamatan Pasir Sakti Lampung Timur. Penelitian ini menggunakan jenis penelitian lapangan (Field Risearch).. Sumber data pada penelitian ini yaitu sumber data primer dan sekunder. Sedangkan teknik pengumpulan data menggunakan observasi, wawancara, dan dokumentasi. Faktor dalam perkawinan beda agama yang terjadi Desa Mulyosari Kecamatan PasirSakti Lampung Timur yang mengakibatkan terhalangnya ahli waris untuk mendapatkan harta warisan. Akan tetapi terdapat solusi seorang ahli waris beda agama tersebut tetap memperoleh harta waris melalui wasiat wajibah. Wasiat wajibah merupakan solusi dalam hal pembagian waris kepada ahli waris beda agama dengan jumlah perolehannya tidak boleh melebihi 1/3 dari harta waris. Dari adanya solusi dalam masalah waris bagi non muslim menjadi prinsip keadilan dalam gender yang mengutamakan kerukunan keluarga, menjaga dan mempertahankan keutuhan keluarga dengan tetap saling menghargai dan menghormati.

Abstract

Indonesia with majority Islam as its majority religion, with their obligation to give zakat, donations and alms, needs role model. The Nurul Hayat Foundation with all its business units is one of the institutions in mu'āmalah māliyah which should be considered as the role model. This article is field research. The results of this study indicate that the Nurul Hayat Foundation is implementing what they call the four commitments (independent, trustworthy, professional (ISO 9001: 2015), and implementing the 5R culture (mandiri/concise, amanah/neat, resik/clean, rawat/caring and rajin/diligent), and empowering). In institutional governance, Nurul Hayat applies four stages: the planning, organizing, implementing and supervising.
