Abstract

Corporations as the subject of law in its business activity has great potential to commit human rights violations either committed as the act of the Corporations with the pattern of human rights violation conducted by Direct Complicity that is human rights violation with direct involvement, Beneficial Complicity where company take direct benefit from human rights violation which others do. Silent Complicity as a form of corporate failure to stop or even do something when there are laws or laws that discriminate against a group in society. Violations committed by international and national corporations do not yet have a firm legal instrument that governs the accountability of the Corporations against human rights violations until July 6, 2011 based on United Nations Guiding Principles on Business and Human Rights. The relationship between business and human rights is conceptualized in the three pillars of the framework. The first pillar, stipulates that the state has an obligation to prevent, investigate, compensate and punish the violations of human rights committed by private actors. The second pillar, provides that corporations have a responsibility to respect human rights. The third pillar stipulates that the government should provide recovery access for victims of human rights violations.

Abstract

Decentralization is the delegation of authority to make decisions and policies to the manager or the people at the lower levels of an organization in the area of autonomy decisions are trimmed, just at the local level that save energy and money. In the concept of decentralization of the central government still has a role as a conduit of the budget through the budget deconcentration will be up to the province. Logically deconcentration will decrease along with the increasing decentralization of funds. In practical terms it is manifested in its merger phenomenon regional offices ministries to local governments. Enforced vertical pattern of deconcentration is embodied in the pattern of deconcentration in the provincial government is still funded by the center. Based on this reality, the criteria for transfer of funds from the central government to the regions is important.

Abstract

Corruption has been systemically widespread in era of regional autonomy, prevention model should still be found, not only the nations awareness and moral improvement, but rationally fill it through a series of legislative policies in formulating legislation, enhancing professional law enforcement, and prinsive implementation good governance, which is expected to achieve clean government, from corruption.

Abstract

Peranan Perusahaan Penempatan Tenaga Kerja Indonesia Swasta (PPTKIS) dengan skema privat to privat (P to P), merupakan mekanisme dan skema yang paling banyak di pilih oleh tenaga kerja indonesia yang berkerja di luar negeri. Besarnya jumlah tenaga kerja yang disalurkan melalui skema privat to privat (P to P), pada kenyataannya tidak diikuti dengan pengaturan dan prosedur yang baik, sehingga justru mendatangkan berbagai permasalahan bagi tenaga kerja dikemudian hari. Tulisan ini hendak menelaah berbagai permasalahan, berkenaan dengan rekrutmen tenaga kerja indonesia melalui mekanisme privat to privat, dan menawarkan solusi alternatif, untuk menanggulangi permasalahan tersebut.

Abstract

Money laundering, has been known in the world since the 1930s, with activities, from organized crime, from the proceeds of crime dark, for further bleached by the company with various business services. In Indonesia, money laundering, always get attention, in various writings, through research, seminars, but not fully implemented by law enforcement. Results PPATK, not followed by police investigators, although there is a strong desire, that the Commission, has started using money loundering laws, especially those associated with corruption.

Abstract

Gerandong currently is illegal vehicles circulating in the community, namely motor vehicles used for mobile rice mill facility by people who operate on the highway. The problem faced is the need for cheap transport of agricultural field of the community, while there are low-tech impact on the feasibility of operating licenses as a vehicle that runs on the highway, security levels, and pollution. Based on these problems Gerandong vehicle license ban needs to be solved in a comprehensive and integrated from upstream to downstream, in order to provide economic benefits, the development of science and technology for society, and safe for the environment. Gerandong management regulations are needed to ensure legal certainty, clarity of responsibility and authority of the government, and the role of society and the business world, so gerandong as an alternative vehicle for agriculture are proportional to run effectively and efficiently.

Abstract

The development of western philosophy has internalized the idea of positive legal thought. Whereas in fact the source of western philosophical thought is derived from the concepts of Islamic philosophy. Therefore, there needs to be a reorientation of the idea of positive legal thought derived from western philosophy to use Islamic philosophy. to free ourselves from the influence of Western philosophical thought, we must not be pursued by condemning, cursing and condemning it, but we dare to compete in a healthy and professional way to create concepts to build civilized civilized society, until the time comes people will come to the conclusion that in all aspects, the thoughts and concepts of building human civilization, Islam is superior to Western philosophy.

Abstract

By enactment of Law No. 8 Year 2015, a new era of Regional Elections have begun, as the Law requires the Indonesian people to hold all Regional Elections simultaneuously. In particular, the most recent Simultaneous Regional Elections was held amidst conflicts of leadership in two major political parties. This gave rise to criminal acts of Letter Forgery in a massive, structurized, and systematical manner throughout the Regional Elections phases. Based on the analysis of Election Oversight Committee (Bawaslu) Decision No. 01/PS/BWSl.Kalteng.21.00/08/2015 and Election Ethics Committee (DKPP) Decision No. 56/DKPP-PKE-IV/2015, there is a challenge in election crime regulations, which must be done quickly with time limit, as mandated by Law No. 8 Year 2015. The human factor that runs the law that is far from ideal, coupled with the dualism within political parties, increases the chance for acts of forgery, which not only resulted in administrative breaches but also have criminal implications. To address this, non-penal approaches would bring more justice and legal order than penal laws. In this regard, a reform is in order, by increasing the knowledge of people involved in the Regional election process. Furthermore, in line with the development of criminal provisions in the Election Law and Penal Code, in practice the integrating approaches is needed between penal and non penal, various related regulations regarding regional elections must also be amended and revised, to accommodate the national political development.

Abstract

SE MKLH Number: SE-06 / PLB3-PS / 2015 and SE MKLH Number: S.1230 / PBL3-PS / 2016, is a Circular Letter of the Ministry of Environment and Forestry Directorate General of Waste Management, Waste and Hazardous and Toxic Materials, containing applying the application of paid plastic bags (PPB) to modern retail business. The appeal through the two Circular Letters is done because Indonesia has been ranked second in the use of environmental polluter bags after China. This paper aims to examine (1). political laws of PPB policy from a political, sociological, economic and philosophical perspective; (2). purpose of political content of KPB policy law; and (3). law enforcement policy of PPB. The conclusion of this study is that PPB policy is needed to change the behavior of highly consumptive society and change the paradigm of waste management, so that what is aspired in Article 5 paragraph (1), Article 20, Article 28H paragraph (1), and Article 33 paragraph (3) and paragraph (4) of the 1945 Constitution of the State of the Republic of Indonesia can be realized through Law Number 18 Year 2008, Government Regulation Number 81 Year 2012 and MKLH Regulation concerning CDE policy to be designed.

Abstract

AbstractPower is a depiction of the right to do and not to act which gives birth to certain powers which have the dimension of unity between rights and obligations (rechten en plichten). In relation to the process of governance, rights contain the power to govern themselves (Zelfregelen) and manage themselves (Zelfbesturen), while obligations horizontally mean the power to administer the government properly. Thus, the substance of authority in government is the ability to take legal actions or actions of government. Therefore, every power and authority inherent in every state organizer, the moral and ethical foundation as the basis for the integrity of state administrators must be the main factor in assessing and testing its performance which is realized in the form of respectable policies in the framework of increasing dignity and value fair and civilized humanity for all Indonesian people. Thus, every state organizer must have a strong ethical foundation so that its policy products do not conflict with the constitutional mandate. AbstrakKekuasaan merupakan penggambaran tentang hak untuk berbuat dan tidak berbuat yang melahirkan  wewenang tertentu yang berdimensi kesatuan antara hak dan kewajiban (rechten en plichten). Dalam kaitan dengan proses penyelenggaraan pemerintahan, hak mengandung pengertian kekuasaan untuk mengatur sendiri (Zelfregelen) dan mengelola sendiri (Zelfbesturen), sedangkan kewajiban secara horizontal berarti kekuasaan untuk menyelanggarakan pemerintahan sebagaimana mestinya. Dengan demikian, substansi wewenang dalam pemerintahan adalah kemampuan untuk melakukan tindakan atau perbuatan hukum pemerintahan. Oleh karena itu, setiap kekuasaan dan kewenangan yang melekat pada setiap penyelenggara negara, maka landasan moral dan etika sebagai basis integritas penyelenggara negara harus menjadi faktor utama dalam menilai dan menguji kinerjanya yang diwujudkan dalam bentuk kebijakan yang bernilai terhormat dalam kerangka meningkatkan harkat dan martabat serta nilai kemanusiaan yang adil dan beradab bagi seluruh rakyat Indonesia.  Dengan demikian, setiap penyelenggara negara harus memiliki landasan etika yang kuat agar produk-produk kebijakannya tidak bertentangan dengan amanat konstitusi.
