Abstract

AbstrakMakna kata skinah memiliki dua sudut pandang, yaitu secara obyektif dan subyektif. Masyarakat yang secara terus menerus mengkonstruksi kata sakinah melalui proses eksternalisasi. Pada waktu yang bersamaan hal tersebut mempengaruhi kesadaran subyektif masyarakat tersebut melalui proses internalisasi. Sakinah merupakan suatu konsep yang sedang dikonstruksi dan bukan merupakan sebuah realitas yang final. Konstruksi keluarga sakinah akan selalu mengalami pembentukan yang disebut dengan proses dialektis yang dijalankan oleh masyarakat sebagai instrumen pembentuknya. Konstruksi keluarga sakinah nampaknya mulai terpisah dari masyarakat, bahkan tokoh agama sekalipun. Sakinah yang dijelaskan oleh seorang ulama sebagai keluarga yang saling mengerti peran dan tanggung jawab dalam keluarga dan saling menghormati serta mengedepankan musyawaroh telah menjadi suatu kenyataan yang obyektif. Dalam Islam maupun pemikiran barat menyatakan bahwa dalam membangun keluarga yang bahagia harus merujuk pada nilai-nilai moral, spiritual dan juga agama sebagai dasar kehidupan sebuah keluarga.

Abstract

ABSTRACT            In Indonesia, age is one of the requirements for someone who wants to get married. The existence of the law on marriage age restrictions is for the benefit of family and marriage as regulated in article 7 paragraph 1 of Law No.1 of 1974 that in marriage the bride must be 19 years old and the bride must be 16 years old If this is not fulfilled, the marriage dispensation provided by the Religious Courts must be used. In the Decision of the Surabaya Religious Court number (519/ Pdt.P/2018/PA.Sby) the judge granted the petition of the petitioner, namely giving a dispensation to the applicant's child who had not yet been sentenced to age for marriage. As for this study to determine the judge's consideration of early marriage dispensation based on the Decision of the Surabaya Religious Court number (519/Pdt.P/2018/PA.Sby) and to find out the decision in the perspective of Islamic law.            The method used by the authors in this study is a qualitative or empirical method with documentation data collection techniques which are then analyzed to obta           in conclusions            From the results of the research conducted it can be concluded that, the judge's consideration in deciding the case (519/Pdt.P/2018/PA.Sby) first though the applicant's child had not reached the age of 19 years as stipulated in law number 1 of 1974 but the applicant's child showed his ability to get married then in order to prevent the judge from being obedient, he granted the petitioner's request by providing a marriage dispensation. Both court rulings are in accordance with Islamic law because the Shari'a do not provide a certain age limit for marriage.Keywords: Judge Considerations, Marriage, Early Marriage Dispensation

Abstract

ABSTRACTIn the Balinese community, especially the people in the Kecicang Islam Village of Bungaya Village Kangin Bebandem Karangasem, there is a tradition in the marriage process called "Nyuang Nganten". This tradition one day before the contract of the prospective bridegroom brings the prospective bride to his residence at night. In this tradition, the bride and groom are picked up by the bridegroom's relatives and accompanied by the community while in this tradition the bridegroom's family brings something like betel leaves, sugar, prestige, coffee, tobacco and others.From the background of the problem, the writer formulates the problem into 2 questions, namely 1) How is the Nyuang Nganten tradition in the Islamic village of Kecicang? 2) What are the views of scholars and community leaders about the Nyuang Nganten tradition ?. This research is a field research using qualitative-descriptive method. The method used for data collection is by observation, interview, and documentation.The conclusion of this research is that the Nyuang Nganten tradition of the Kecicang Islam village of Bungaya Kangin Village is a hereditary heritage of ancestors so that it still exists. This custom is a prerequisite before holding a marriage in Kampung Kecicang Islam.  In the procession before the wedding there are several meetings required to bring up to smoothen the marriage. According to as community and religious leaders, the Nyuang Nganten custom is a necessity in marriage in the Kampung Kecicang Islam community and even if this custom is not implemented, we are not considered as respecting the custom and violate local regulations and this affects the psychological family. The views of scholars and community leaders in Kampung Kecicang Islam believe that the Nyuang Nganten custom does not violate Islamic law. In fact, this tradition may be worked on and/or abandoned.Keywords: Tradition, Nyuang Nganten, Islamic Law

Abstract

ABSTRACTThis research was a study of a custom named Pisuke property located on the island of Lombok, the custom is about customary marriage process, and the Pisuke is a gift from the bridegroom in the form of a number of property such as money, rice fields, or animals for the guardian of the bride so that the custom could accept the marriage, it was a gratitude to the bride's guardian who has been taking care and giving her daughter a living since childhood, even though it forces the bridegroom.So, the researcher examined the views of traditional leaders and sasak religious leader in Aiq Darek about the custom, and the purpose of this study are: first, to find out their views, second, to find out the comparison between their views about the Pisuke property law.The method used by the author in this study was a qualitative or empirical method with the data collection techniques such as observation, interview, and documentation, then analyzed it to get conclusions.The conclusions of this study: first, the opinion between the traditional leaders and religious leader of Sasak in Aiq Darek about the Pisuke custom was vary on customary law. secondly, from the their opinion comparison, the custom contained elements of benefit and disadvantage, and the custom must be in line with the Shari'a. Keywords: Pisuke Property, Custom, Marriage

Abstract

ABSTRACTBased on the reality that is happening now. Divorce in some cities has increased, especially in Surabaya city. Therefore, the Office of Religious Affairs (KUA) Sawahan runs a secret marriage learning program (BERKAH) with the aim of stabilizing the bride and groom. The program is instructed directly from KUA center to KUA sub-districts with class A status and this research aims to provide supplies to bride and groom couples.This type of research is included in the field research, namely research based on the results of observations and interviews with the head of the KUA Sawahan District regarding the BERKAH program. The researcher collected data directly and interviewed the parties concerned at the KUA Sawahan District, Surabaya City. After the data is collected, the author analyzed using a qualitative method.The results of the research stated that the program was an attempt to provide provisions for the bride and groom. In order for the bride and groom to be more stable in running the household. From the perspective of Maqa>s{id Shari>’ah, the program is very closely related to maintaining religion, maintaining the soul, maintaining reason, guarding offspring and protecting property.Keywords: Consolidation of Brides, BERKAH Program, Maqa>s{id Shari>’ah.

Abstract

Abstract In the life of the Lamaholot tribe, customs and beliefs are still developing strongly. It is still found in the Lamaholot tribal community in East Flores, East Nusa Tenggara regarding  "Belis" in the marriage process. "Belis" is a tradition of noble values and forms of respect for women. The purpose of "Belis" is the legal determinant of a marriage, as a sign that the girl has left her home family, and as a tool to raise the name / degree of the family There are various forms of "Belis" in East Nusa Tenggara that are used in the form of gold, silver, money, and animals such as buffalo, cows or horses. The uniqueness of the "Belis" lamaholot community is concrete in the form of value and size of elephant ivory that is difficult to obtain. Although elephant ivory is very difficult to obtain, this tradition still applies and is maintained by the Lamaholot community.The purpose of this study is 1) to find out how the traditional practice of "Belis" in the Lamaholot tribe community 2) to find out how the views of ulama, traditional leaders, and the viewpoint of Islamic law about the customs. The subjects of this research are the local community, community leaders and Ulama '. This research is a type of qualitative research using data collection methods and methods of observation, interviews, and documentation while the data processing is Editing, Classifying, Analizing and Concluding.The conclusions of this study are 1) that the tradition of "Belis" in the Lamaholot tribe is a legacy of ancestors and until now this tradition still exists 2) according to traditional leaders and different religious leaders, according to religious leaders that the tradition of "Belis" is contrary to the Shari'a Islam. And according to traditional leaders, adat belis does not contradict because adat has to be maintained. But to maintain the brotherhood between them, they are at peace and agree to improve the custom of "Belis". If viewed from the perspective of Islamic law that part of the traditional process of "Belis" is contrary to the basic method of Islamic law. Keywords: Belis, Tradition, Marriage

Abstract

Apabila dilihat dari sudut pandang Hukum Waris Islam, maka anak yang lahir dari perkawinan beda agama tidak mempunyai hak untuk mendapatkan harta waris apabila tidak seagama dengan pewaris yang dalam hal ini pewaris beragama Islam. Namun demikian apabila pewaris tidak beragama Islam (non-muslim), sedangkan ahli warisnya tidak seagama dengan pewaris (non-muslim), maka tetap berhak mewaris. Hal tersebut didasarkan pada hubungan darah antara pewaris dengan ahli waris, sebagaimana diatur dalam ketentuan Pasal 832 KUH Perdata maupun Pasal 171 huruf c Kompilasi Hukum Islam (KHI).  Hambatan hak mewaris anak yang lahir dari perkawinan beda agama adalah belum adanya unifikasi yang mengatur tentang waris karena dalam kenyataannya masih terdapat pluralisme hukum waris, sehingga dalam menyelesaikan masalah  hak mewaris anak yang lahir dari perkawinan beda agama masing-masing pihak tunduk pada hukum yang berbeda yaitu berdasarkan hukum agama atau adat. Namun demikian berkaitan dengan hal tersebut, hak mewaris anak yang lahir dari perkawinan beda agama dapat diatasi dengan dikeluarkannya Fatwa Munas VII Majelis Ulama Indonesia (MUI) Nomor 5/MUNAS-VII/MUI/9/2005 yang menyatakan bahwa pemberian harta kepada orang yang berbeda agama hanya dapat dilakukan dalam bentuk hibah, hadiah dan wasiat. Sehingga hambatan hak mewaris anak yang lahir dari perkawinan beda agama dapat teratasi.

Abstract

This written Journal goal is for knowing how is Islamic view law, about career woman, where is this era a lot of woman choose double role as house wife as well a career woman. Method of this written is library reaserch by collecting material from same journal, scientific books and holy books, about Islamic law with expectation my this written can be one of woman reference for placing herself.Woman is one of human special being created by Allah, swt., which is destinea as a complementary in man life. As is Allah, swt., created Hawa for accompany Nabiullah Adam runs life and finally develop human being on earth. Woman in jahiliyah period just made it as a second group after men folk in ancient times, a father feith embarrased if he had a girl because there were presumption that a girl is family disgrace. Then Allah, swt., delegated Rasulullah, saw., to lift female degree. In the present, women are not longer censidered as a weak creatures, even women have been equal part with man in terms of work and ability, but it is not necessarily make women have to get out of her line nature. As a special human being who will get the title of mother and wife later, Islam is greatly appreciated women with no restriction if a woman wants to be a cereer, however Islam is not regulating everithing, so that there is a balance between obligation and right for a woman.

Abstract

Pelatihan dan pengembangan pada umumnya digunakan oleh perusahaan, organisasi, lembaga dan instansi-instansi lainnya. Sama halnya di dalam Kantor Urusan Agama diperlukan berbagai pelatihan dan pengembangan, termasuk pada pelatihan perkawinan. Pelatihan ini bertujuan untuk memberikan pemahaman yang menyeluruh tentang kaidah-kaidah Islam, tentang keluarga dan persiapan fisiologis serta psikologis mereka agar pasangan calon pengantin lebih memahami dunia perkawinan dan membekali mereka pengetahuan untuk membentuk keluarga yang bahagia. Penelitian ini bertujuan untuk menganalisis tinjauan program pelatihan perkawinan di KUA kecamatan Pameungpeuk. Program pelatihan perkawinan ini diselenggarakan di KUA kecamatan Pameungpeuk bertujuan untuk meningkatkan hubungan sebelum memasuki dunia rumah tangga sehingga dapat menciptakan hubungan pernikahan yang stabil dan sesuai harapan. Penelitian ini merupakan jenis penelitian deskriptif kualitatif dengan metode pengumpulan data observasi, wawancara dan kepustakaan untuk dilakukan analisis terhadap tinjauan program pelatihan perkawinan di KUA kecamatan Pameungpeuk. Hasil dari penelitian ini menunjukkan bahwa program pelatihan perkawinan pada Kantor Urusan Agama (KUA) merupakan salah satu program pemerintah dalam rangka mengurangi angka perceraian di Indonesia terutama di KUA Kecamatan Pameungpeuk. Terdapat dua jenis program yang dilaksanakan yaitu seminar umum dan konseling individu. Program pelatihan perkawinan diharapkan dapat memberikan manfaat bagi calon pengantin yang akan membangun rumah tangga yang sakinah mawaddah warahmah.

Abstract

Abstrak            Hybrid contract merupakan kesepakatan dua pihak untuk melaksanakan suatu akad yang mengandung dua akad atau lebih.  Hybrid contract menyisahkan perdebatan para ulama tentang keabshan hukumnya. Perdebatan ulama yang pro dan kontra tentang hybrid contract menjadi fokus penelitian ini.           Penelitian ini merupakan penelitian kepustakaan, dengan pendekatan deskriptif kualitatif,  melalui telaah dokumen kepustakaan,  analisisnya dengan metode  induktif yakni dari lapangan tertentu yang bersifat khusus, kemudian hasil penelitian tersebut ditafsirkan sebagai kesimpulan untuk membangun  suatu proposisi atau teori yang dapat digeneralisasikan secara luas. Hasil penelitian menunjukan para ulama terpecah menjadi dua dalam mensikapi keabsahan hybrid contract, ada yang pro dan kontra. Yang pro beralasan bahwa hukum asal dari akad adalah boleh dan sah, tidak diharamkan selama ada dalil hukum yang mengharamkannya. Ulama yang mengharamkan hybrid contract beralasan bahwa hukum asal dari akad adalah dilarang kecuali ditunjukkan boleh oleh agama. Mayoritas  Ulama membolehkan praktek hybrid contract dengan batasan-batasan yaitu hybrid contract yang jelas-jelas terlarang oleh nas} agama, yang dijadikan sebagai hilah riba dan mengandung unsur riba, serta hybrid contract yang akibat hukumnya saling berlawanan. Key word: hybrid contract, Ulama, Keabsahan
