Abstract

Prove of land ownership by customary land is generally unwritten, just a confession of the surrounding communities with nature sign boundaries. If land ownership cannot be supported by strong evidence, the land may be registered by someone else who has getting physically for 20 years or more in consecutively and qualified on Government Regulation No. 24 of 1997 concerning Land Registration. Proof of old rights derived from the customary land law is rationally difficult to prove because there are no written documents. Customary land law does not know written ownership, only physical possession continually so it is very prone to conflict or dispute. In order to develop land administration in Indonesia, the values of customary land law contained in its principles is expected to be reflected in the land administration so it can reduce land conflict in the community. The role of customary land law has a large portion of the national land law. The role of government or ruling is very important to create a conducive condition in the land sector. A land is not allowed for personal or group interests, its use must be adjusted with the condition and the characteristic of their rights so useful, both for the prosperity and helpful to community and state.

Abstract

States should take appropriate steps to ensure the effectiveness of domestic judicial mechanisms when addressing business-related human rights abuses. These steps may include ways to reduce legal, practical and other relevant barriers that could lead to a denial of access to remedy. To a certain degree, these problems exist in Indonesia’s judicial remedy mechanism. This article examines court decisions in five cases involving Transnational Corporations (TNCs). These decisions are examined to identify challenges and opportunities in bringing a case on ESC rights violations against TNCs. It is found that claim on ESC rights violation may be brought to the court, and the court has jurisdiction to entertain the case. However, of the five cases filed against TNCs, only in one case has the court decided in favour of the plaintiff. Most of the cases were rejected on procedural matters. This situation suggests that it remains burdensome for the victims of ESC rights violations to seek remedy at the court. There are procedural burdens that has to be faced by plaintiff when bringing ESC rights case against corporations, particularly TNCs. Nevertheless, there are new develop-ments in relation with pursuing ESC rights in court. One of the important development is private business contract between the govern-ment and private corporations may be annulled by the court, if the exercise of the contract would violate the government's obligation to fulfil human rights of the citizens

Abstract

Penelitian ini bertujuan untuk mengetahui pengaturan hukum dan penerapan sanksi pidana terhadap tindak pidana credit/debit card fraud di Indonesia. Metode penelitian yang digunakan adalah penelitian normatif dengan mengelompokan ketentuan-ketentuan yang relevan dengan tindak pidana credit/debit card fraud yaitu berdasarkan Undang- Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik; selain itu digunakan pula Convention on Cybecrime 2001. Analisis bahan hukum dilakukan melalui pendekatan perundang-undangan (statue approach) untuk menciptakan suatu ius constituendum mengenai penerapan sanksi pidana terhadap kejahatan credit/debit card fraud. Hasil penelitian menunjukan pengaturan dan sanksi pidana terhadap tindak pidana credit/debit card fraud di Indonesia masih tergolong minim. Pertama, belum dikomodasinya ketentuan yang secara langsung mengatur mengenai computer related fraud. Kedua, belum diaturnya sanksi pidana berbentuk tindakan yang bersifat restitutif bagi pelakunya.

Abstract

Keteraturan alam semesta dan objek lainnya dapat dideskripsikan baik oleh kosmologi maupun fisika. Namun dari keteraturan objek itu terdapat segi atau aspek ketidakteraturan atau fraktal (patah) yang sulit dideskripsikan oleh matematika model Auklides dan Kalkulus. Benoit Medelbrot mencoba menjelaskan objek kacau tersebut dengan teori Fraktal yang pada dasarnya merupakan cabang dari matematika. Teori Fraktal tersebut mempengaruhi pandangan terhadap hukum yang mengilhami Charles Sampford yang kemudian mencetuskan teori hukum chaos. Inti teori hukum chaos ialah (1) hubungan sosial, termasuk hubungan hukum dibentuk berdasarkan hubungan kekuatan (power relation), (2) pihak-pihak yang membuat hubungan itu tidak memiliki memiliki kekuatan yang sama atau seimbang, dan (3) pada waktu pelaksanaan hubungan itu masing-masing mendasarkan pada pendapat mereka secara subjektif. Ketiga hal itulah yang menimbulkan chaos. Akan tetapi suasana chaos itu pada akhirnya akan kembali pada keteraturan karena adanya kekuatan penarik (strange attractror) yang dalam dunia hukum adalah hukum dan kekuasaan negara. Kekacauan (chaos) pada dasarnya terdapat pada hubungan yang berbasis kebebasan yang melewati batas-batas ketertiban. Bila kekuatan penarik berhasil memulihkan kekacauan itu sehingga tercipta keserasian antara ketertiban dan kebebasan maka tercapai kedamaian yang merupakan tujuan hukum.

Abstract

The vision of Aceh Government in 2012-2017 is Aceh are dignified, prosperous, just, and independent based on the legislation of Aceh government as a form of Memorandum of Understanding. One of the visions of Aceh government 2012- 2017 is the improved welfare of Acehnese people through quality health services through increasing life expectancy, infant mortality, decreasing the prevalence of malnutrition as well as the effectiveness of the treatment of infectious diseases to the achievement of the MDG’s. Model policies adopted by the Aceh government is monitoring and track record of cases, tv monitor, routine and case sms, a special program policy model, and the model of budget balancing. Model policies adopted by the district/city government is making a supporting program, All Village Midwives Must Live in the Village, deliveries assistance is performed by professional health workers, adjustment to the ability of APBK. Support new regulation of Regent Regulation (Perbub) on Malaria Elimination and No Smoking Area. MDG’s target is not entirely in accordance with the indicator being built, because it requires adjustments in accordance with the ability of both district or city areas. Regulatory support is not adequate to support the achievement of the MDG’s in the field of health.

Abstract

The following brief analysis is trying to look at the shifting mechanism of land rights of the Malay people from a historical perspective. The point of analysis stems from the description contained in the literature of customary laws produced by some academics and of the Dutch colonial officials. It subsequently runs using of some secondary materials and other colonial-based archives. The analysis finally concludes that in the span of nearly a half of a century, since the period of the Dutch, Japanese capitulation, the period of independence, the land rights of the Malay people has become a “toy play” of the ruling regimes, with all formulas being implemented in each period. The laws imposed upon this well-known fertile land have been successfully enriching the rulers and a wide range of business people with strong access to it.

Abstract

Scientific normativity of law conceived as a character inherent in legal science as a sui generis. Jurisprudence basically studies the law, something that initially emerged from the dogmatic belief in philosophy. Dogmatism refuse to alter beliefs one iota. The teachings of dogmatic philosophy stem from the teachings of Plato and reflected in the legal enforceability. Dogmatism in the law is reflected in the Corpus Juris Civilis. Along with the development of post Era Scholastic philosophical thinking, the philosophy synthesizes thought between dogmatic thinking and skeptic has appeared in the Age of Enlightenment. This idea is reflected in Transcendental Idealist philosophy thought of Immanuel Kant. The core idea is that real human beings are given the ability to understand based on empirical experience and actually also able to gain an understanding of the human being that is the essence of symptoms. Transcendental Idealist, thus dynamic, moving to look for values that are useful for life. Transcendental Idealist thought then be adopted Kelsen in the teaching of normativity in legal positivism. Normativity in the teachings of Hans Kelsen’s legal positivism derived from the integration of empirical positivism and idealistic empiricism.

Abstract

The establishment of universal health care marks a new momentum for the progressive realization of the right to health in Indonesia. The problem of corruption in health sector endangers the sustainability of effective and quality health care, therefore, Indonesia established an anti-fraud system to protect the universal health insurance fund. This research seeks to analyze the current anti-fraud system in universal health insurance through the lens of international law and principles of good governance. The sociolegal approach is chosen to study the relationship between the State party obligations to international law and the implementation of international law concerning universal health care and anti-corruption in the designated anti-fraud system. Good governance principles are essential in designing an effective anti-fraud system due to the correlation between human rights and anti-corruption that both areas emphasize good governance principles as guiding principles for the realization of human rights and the making of potent anti-corruption strategy.

Abstract

The Kei Islands of Southeast Moluccas, like other parts of Indonesia, have a customary order and cultural diversity. The values of local wisdom existing in the Kei community, which is contained in the customary law of Larwul Ngabal, is a very important cultural social capital in the social integration of its society. The type of study was an empirical research with sociological-anthropological juridical approach. The results show that the existence of customary law of Larwul Ngabal supports the implementation of regional autonomy with full authority and reinforcement in local regulations based on local wisdom in Kei Island. The dominant factors that caused the values of customary law of Larwul Ngabal have not provided legal strength in the implementation of local government is because it is determined by the recruitment factor of the leader who lacks capacity and competence. Added to the polarization of political parties and the values of local wisdom on financial strength in determining leadership. Therefore, to realize good local governance in Kei Islands, the values of customary law of Larwul Ngabal in various Local Regulations and local government policies must be accommodated, keeping in mind the custom, governmental and religious factors that are the foundation of Kei community life.

Abstract

Indonesia is known as one of the richest countries for its biodiversity. Plants, animals, and forest are very diverse in every region in Indonesia. Unfortunately, from time to time the numbers of biodiversity have been decreased along with the development of Indonesia. Nowadays, numbers of Sumatera Tigers and Orang Utan are not more than 400 since they were traded, captured, and killed in the name of economic development. Even wildlife habitat, forest, were converted to non-forestry use. Theoretically, Indonesia has Conser-vation Act which is the Law Number 5 of 1990 on Conservation of Biodiversity and Ecosystem in which providing protection to the biodiversity. However, this law mostly talks about conservation system rather than providing legal protection to the wildlife and its habitat. In addition, the law seems to stand on its own, meaning only Biodiversity Law regulates protection to wildlife. Other acts like Forestry law, Environmental law, Plantation law, and Mining law do not provide wildlife protection. While both flora and fauna are the most vulnerable elements affected by activities which are regulated by those laws. The existence of the conditions above indicates that the legal protection of wildlife needs to be improved. One of the improvement efforts is to reform the Indonesian wildlife protection law. The law reform of Indonesia wildlife protection can be done through comparative approach toward legal framework of wildlife protection of Indonesian and United States.
