Abstract

Islamic business ethics teach people to have a good behavior and to avoid the bad ones. It is based on Islamic values. Islam has a role about the weights of goods. It has been written in Al-Qur’an and hadits. Islam suggests people do business in a right way; because Islam deals with productivity in trade. Abstract

This research was to measure the level of satisfaction users of Management Education Islam alumnus at public and privat sectors. Furthermore, the research is to mapping the types of professions and distribution of alumnus in East Kalimantan. The aims of this research are to know key position and to measure level of satisfaction of the carrier institutions that use alumnus of Management Education Islam at East Kalimantan. This research is qualitative descriptive with study case approach. Writer used observation, questionnaire and documentation to collect data. Analysis of data using percentage formula and mean test. The conclusions are: (1) Alumnus of Management Education Islam has key position at carrier world with professions: Administration Staff at College, Bank Teller, Customer Service at Bank, Administration at Finance and at Telkomsel, Imam KUA, and Board on Religius Organizations; (2) Distribution of alumnus: Samarinda, Balikpapan, Nunukan, Tarakan, Bulungan and Paser; (3) 59% alumnus has key position appropriate with their academic background and 41% not appropriate; and (4) Level of measurement of the user of the alumnus at 2,318. It is at range 1,668-2,334 that means satisfy.  So we can say that alumnus of Management Education Islam in order to do their job is good enough.

Abstract

Development of the local culture as Islamic religious learning model approach is very necessary at this time. Because religion is very in touch with cultural values. Islamic culture such as Habsyian, Manaqiban, reciting sholawat to Prophet Muhammad (solawat Diba '), celebrating Prophet's birthday, and Isro mi'roj, tahlilan, reciting barzanji are becoming increasingly committed by the Muslim community in Ssamarinda. Development of the local culture is not only done among society, but it has touched a post-secondary education institutions, high school and others. It is very interesting because morally is very effective of religious instruction taught religious teachers in their schools. The way how they follow through Manaqib Habsyian and recitation would bring a positive trend among the students. With the performance of the all-white dressed adds spirit to Islam among students. Development of local culture as stated above should be preserved and supported among educators and related agencies. Keep in mind the development of Islam and its spread in Indonesia in conjunction with the local culture as a means of delivery. It almost happened in regions throughout Indonesia as an archipelago country.

Abstract

This study is directed to describe: 1) the guarantee of protection in the law for children rights who are born without marital status, 2) the support of the legal culture of society in the realization of the protection of children rights who are born without marital status. The result of study shows that: (1) The law has not given any guarantee of protection for children rights who are born without marital status. It is because there is no harmonization of the law and it is against the internal law culture where the law enforcers have not run the legal law optimally to conduct a good protection since they should accept or refuse the content of Constitutional Court No. 46/PUU-VIII/2010. (2) The supports of the legal culture of society, in the realization of the protection of children rights who are born without marital status, are good enough as long as they are supporting religious values and justice values which are being applied in the society.

Abstract

The objective of this study was to know the strategy of English department program management to improve the quality its program through acreditation standard. The data were collected by using observation, interview, and documentation. Data were analyzed by using SWOT analysis. Improving the quality of English department consists of: 1) developing the vision, mission, and the target of the English study program, 2) strengthening the management and quality assurance of the English program, 3) improving the quality of the alumni of English study program, 4) improving the human resources of the English study program, 5) evaluating curriculum and management of the English study program, 6) developing the fund, facilities, and information system of the English study program, and 7) networking and developing the research, community services, and cooperration with other parties.

Abstract

This article is an attempt to find solutions to the problems of the Muslims who practice field pawn. Field pawn practiced that was conducted so far only based on local customs laws and is considered to deviate from the basic principles of Islamic economics, namely; help each other, the prohibition of using treasure with the falsehood and the ban on the practice of usury. Field pawn done with handed over the land / fields to others to be controlled temporarily with all their profits and in return he got a loan of cash, and the land will be returned when the loan is redeemed or repaid. Actually, the main function of the devolving of the land is a guaranty for the loan funds that is received by land owner, and consequently the land is at the authority of the lender, so all land use is in the right lender. Looking at from the contract side, field pawn carried out without the clear contract, on the one hand is borrowing and on the other hand is considered as buying and selling because the land owners do not have the right to use it except with the permission of the lender so that it is called buying and selling.

Abstract

In this modern era, Khamar (liquor) is more identical and better known by the name of drugs (narcotics, psychotropic, and other dangerous drugs). Drugs are forbidden to consume for human. Narcotics and psychotropic are cited in Law Number 22 of 1997 where both are Khamars. In Law Number 5 of 1997, psychotropic is a drug or a substance, natural or synthetic, both are not narcotics which have psychoactive effect through central nervous system that causes typically changes in mental activity and behavior. This study is descriptive qualitative. Research on Law, descriptive is to show or describe individual accurately, condition, symptom or a particular group, and to determine the spread of a phenomenon. It is stated that someone is a drunk of Khamar and gets a Had punishment when she or he is tried and true or proved by his or her self-testimony or two witnesses. Law number 35 of 2009 about narcotics classifies a criminal of drug abuse into two types; the criminal as a drugs user is cited 116, 121 and 127 articles and the criminal is not as a drug user is cited in 112, 113, 114, and 129 articles. There are two types of drugs users, for himself and drug dealer (cited in 116 and 121 articles). The drugs users without any doctor’s supervision, they should be rehabilitated when they are addicted. But for the criminal as drugs not-user, is classified into four; owner (cited in 111 and 112 articles), producer (cited in 113 article), carrier (cited in 114 and 119 articles), drugs dealer (cited in 129 article). So that, base-foundation of Islamic Laws is based on “benefitted, resisted damage and danger.” The importance of Islamic Law to be built based on resisted damage and danger is to prevent and prohibit all kinds of substances that endanger.

Abstract

The aim of this research are to know objective condition of curriculum at Muamalah Courses now (that still be used now) and to know development of curriculum based on stakeholders needs. Analysis model that be done is interactive analysis, with four components: data reduction, data display, conclusion and verification doing by simultaneously. The result is both in term of design, implementation and evaluation still need reviewed and assessed comprehensive and completely based on stakeholders needs.

Abstract

The objectives of this study are to explain the tafseer of M. Hasbi Ash-Shiddieqi and M. Quraish Shihab about the law in Alquran. The researcher analyzed comparatively the two mufassir tafseer. The laws in Alquran analyzed, in this study, are about handcutpunishment, zina, and moslems hijab. The researcher used descriptive comparative research design. The sources of the data were Tafsir Alquranul Majid An-Nur which was written by M. Hasbi Ash-Shiddieqy and Tafsir Al-Misbah which was written by M. Quraish Shihab. The finding shows that Hasbi and Quraish Shihab tafseer about QS.Al-Maidah (38) consists of lawsuits. They wrote that the thief, in QS Al-Maidah, is one who steals things for many times. These two mufassir does not have any differences in interpreting QS Al-Maidah (38). However, the tafseer of Quraish Shihab seems to be more details and wide than the tafseer of Hasbi is. The two mufassir said that handcut punishment can be applied if there is not other way to resolve it. QS.An-Nur: 2, according to Hasbi dan Quraish Shihab, consists of firmly lawsuits for one who commited doing zina, that is, scourging 100 times. Hasbi argues that this scourging is for married man/woman. It is different to Quraish Shihab since it is for unmarried man/woman. For those who are called muhsan.muhsanah, they are punished by scourging to the death. Quraish Shihab claims that this scourging is hard to execute since it needs a confession from the person who commited to crime and it should fulfilled a special strict conditions. In terms of Moslem hijab, in QS Al-Ahzab: 59, Hasib stated that it is an obligatory. It should be dressed respectifully and particulary it was applied for the wives of prophet. Quraish Shihab argues that hijab is not an obligatory for Moslems women. He claims that it is a traditional custom of Arab women.

Abstract

The implementation of legislation either nationally or internationally linked to the implementation of restorative justice as one of the alterntif in the process of implementation of conviction against children in conflict with the law had been applied, but the case has not yet been thoroughly and still limited at the law enforcement officers and observers who are committed and integrity as well as having the attention to this problems. The implementation of restorative justice which is applied at each level of the process of criminal justice in the form of taking back the children to their parents, versioned by handing the children to Panti Sosial Marsudi Putra (PSMP), and the implementation of social integration through giving CB, CMB, and PB for children who are already serving imprisonment. Some obstacle factors the implementation of restorative justice as one of the alternatives in the implementation of conviction against children in conflict with the law, including physical building facilities and non-physical facilities and legal substance. It is because restorative justice has not been expressly regulated, even though in the law nomer 11, 2012 concerning about the Child Criminal System has been regulated but until now it has not been declared valid. The other factors are legal structure and legal culture.
