Abstract

Based on historical records, the demand to change the rules of marriagein Indonesia from pre-independence till now was initiated by the women’smovement and feminist. These cases had have at the beginning of the 20thcentury that women’s movement has influenced the world women in the3rd world. Thus, it have an effect for open the eyes of many people over theoppression of women as a result of the rules of conventional marriage andthe need for enforcement of women’s rights.

Abstract

Disposesi is a genuine treasure of philosophy in Islam was introduced by aMuslim philosopher Baqir as-Sadr. With his pithy thoughts, Baqir bridgingpolar empiricism and rationalism are dichotomous. In the context of theissue of polygamy, with the construction of Disposesi’s think, polygamy isa proposition that is believed to be true in the Qur’an and it is a primaryconception. Furthermore, the conception of the secondary will be representedby both empirical blocks on one side and on the other side of the rationalblock in the interpretation of the text.

Abstract

The pluralism of law which is applying, that is Islamic law and customarylaw, has not found the related point to go to the integral law yet. It is becauseof till now in the Republic of Indonesia is using system of national law whichbased on several system of law that has a various pattern. That third systemsof law are applying in Indonesia for a long time and dinamic. In early era,before colonialism, the relation of both addressed to pattern of integrationwith level of different coalescence in every sphere. The come of colonizermade a mark on the furthermore era with the pattern that reducted theapplying law (Islam and custom) in Nusantara step by step till the top withapplying a theory of reception. Furthermore, by reaching freedom, slowlythe system of national law took role in developing and rearranged law inNusantara, in other words, developing the theory of codification.To make that various law be able to be commander in living nationally andstately needs to be balanced the comprehension of national law which isintegral. The mean of it in this writing is finite to the idea to see the systemof national law like a law that makes a system of law of custom, Islam, andwest as a source and reality of history which proportionates with the realexperience of nation from early its existence till now, so that, to be nationallaw, Islamic and customary laws are signed not to be incompatible with thephilosophy of national law, and also, the system of national law ought torepresentate the value which lives and run by society.

Abstract

In the contex of Islamic education, teacher is not someone who has a dutyto teach to the students. More than that, teacher is the spiritual father whogives a soul knowledge, leads the morals and make a right for bad behaviorwhich did by the students. But if we turn to the reality this day about adegradation of teacher’s ethic in any region, we perhaps little doubt thecredibility of teacher in having that duty and responsibility. Even, the senseof pesimism will soon if we see the sequence of news that makes the teacheras a main actor in any criminal and immoral behavior.That problem needs to be based on the importance of total comprehensiontoward the values of moral or ethic for a teacher who particularly willbe a need urgely. It is same as the view of al-Māwardī about the ethic ofteacher, which must have a several ethic, as tawadlu’ and avoid the attitudeof priding itself (‘ujub). Having ability to read the characteristic everystudents, avoid itself form shubbat, need to be qana’ah, sincere, and neverlose hope. That thought of al-Māwardī is sure very relevant with the worldof education in Indonesia at this moment.

Abstract

In the process of educating at TK (Primary School), one of the main goalsis to develop the creativity of children optimally. It is so important aboutdeveloping the creativity of children can be seen from the difference ofthe role of the teacher which is early dominating a class, now must givemore a chance to the children to take a more active and creative role in thecomfortable atmosphere and that is supported with supplying educativegames. That dimension is underlying this research.This research heads for increasing the creativity of children through usingthe tools of educative games. Those tools which are used are origami paper,poster paint, and plastisin. The kind of this research is a research of classaction, because this research is relevant and agrees with the object ofresearch. The subject of this research is all of the pupils in group BI in TKABA I Braja Harjosari, 32 Pupils.The collecting of data that is collected in this research is observation,interview/discussion, and documentation. This research is going to actin cycle I and II around six times meeting. After analyzing and workingthrough in this research, the writer can take the conclusion that the usingtools of educative games can increase the creativity of the children age 5-6years. It can be proved with the percentage of !inal learning to cycle I up to56, 25% and then increasing at the cycle II becomes 71, 87%

Abstract

The development of the techology of information and communication hasin luenced the aspect of human living. That development can be seen from the kind of education which is based on technology. Applying technology of information and communication (TIK) is inally shown to the learning method in the schools and universities. One of the applications of the role of technology of information and communication in supporting to the learning process is by using blog.Blog is the application which is free of charge that can be used as one online-learning media. There are steps that need to be run in its developing: 1) making email; 2)making blog account; 3) making project menu, pro ile, download and information or according to necessary; 4) adapting with the level of learning.Developing blog as a media of Islamic learning in university is hoped to increase the understanding of Islamic learning in the level of university, also able to increase the knowledge of internet technology in this context of developing blog.

Abstract

The case of household violence physically or psychologically nowadays isoften we hear. That reality factually shows that the violence in the householdtoward wife, is the common phenomenon in the societal environment.This case is sure not away from the social construct which is developed inthe middle of society that s husband is the head of family and has a fullauthority to the part of family including wife. In that context this researchis making effort to peel off how the problem of protecting implementationtoward women in violence (KDRT) and Islam gives the answers.In the context of women protection in the household, Al-Quran texts give alot of answers which order to make the relationship of household as ma’rufin the meaning of equal, fair, and democratic. In the terminology of UshulFiqh, this concerning agrees with what the goals of law are, that is the lawtoward ive aspects (al-kulliyat al-khams), which one is soul protection (hifzan-nafs). This explains that Islamic law brings the mission of protection, itis as a God’s mercy to all humans in this world. It is also harmonization withthe law of women protecting in Indonesia.

Abstract

The being of Islamic igures in Indonesia in past becomes important in the history of Islamic world. There is main chain which is connecting among Indonesian Islamic igure and others especially in Middle East. This main chain particularly to the relation of geneology science of Middle East, especially in Makkah-Madinah, until becomes igure who has a reputation and network level-world.One of the Islamic Nusantara’s igures who has a important role in the religious living in this country is Muhammad Arsyad al-Banjari. From main chain side of knowledge, he belongs with ‘the graduate of Middle East.’ In this point, it becomes important to go along how the construct of Arsyad Al-Banjari’s thought is, as in his work (kitab). This investigation of course will engage ‘the biographic side’ from the igure, including geneology of knowledge and also science posture which is taken when it is closed to the reality of the society.The thought of al-Banjari about marital law, especially in his kitab, annikah. This kitab speci ically examines the marriage with the systematic from marital law, essential principles, till the break of marriage including the detail in each contain. In that kitab, the law that al-Banjari offers, ‘almost’ all of them adopt from Fiqh Sya i’iyyah.

Abstract

The article presents the rise of multinational corporation effect towardinnovation in globalization era and how islamic economics viewsthem—as an alternative perspective in analyzing this problem. “Therise of multinational corporatian reduces the product innovation”. It is aassumption and appears as an interpretation to market-mechanism. Thethesis will elaborate in the paper. It means that innovation reduction iscaused by multinational corporation product following market trend. Thethesis, indeed, corrobates John Xiros Cooper’s theory. “The market is simplyan economic mechanism which has no extraordinary powers to shift theground of thinking and knowing in any general sense. It is merely, they willsay, a mechanism for allocating resources among producers, a mechanismfor the setting of commodity prices, for distributing goods, for adding value,for raising capital to sustain enterprise, and so on.” Wrote Xiros Cooper.To understand the reason why multinational corporation rising makesinnovation weak will use sociological approach, especially epistemology ofmarket—Xiros Cooper theory.

Abstract

The knowledge about risk in an investation is the important thing. Decisionof investaion for the investor is regarded the era that will come is unclear,it is contains a risk for inverstor. In order that in Islamic perspective, basicinvestation that needs to know in the institution of Islamic inance syariah such as bank that also place to invest fund. In the system of Islamic economy, ionvestation can decrease the poverty and increase the income with a way to bene it the wealth productively. The investation activity which agrees with Islamic syariah is the effort to produce the better life (falah), giving the bene its (maslahah) and keeping away the way of forbidden investation, that is riba, gharar, and maysir. But, productive investation can be implemented with the cooperation and proffessional in doing the main principle of syariat. The control of risk in banking industry is the main part for investor to invest. The management of this risk includes identi icating risk, measuring risk, managing risk, limiting risk, and observing risk. Through this approach the risk and the taking advantange can be measured. So the investor will get the chance return or value of sharing resulit optimally and also prospectively. The indeterminancy level of risk and return of result are the challenge its self to the syariah banking. The validity of law “hish risk brings about high return”forces syariah banking to apply the manage the risk that is more superior from conventional banking. So that the syariah banking must create a team that is able to manage and that is the include of the menegement of risk its self.
