Abstract

The presence of the children who work in places that are categorized as the worst forms of child appropriate for 1982 ILO Convention still be a serious problem and quite significant in this country. Child labor becomes a problematic because in practice the presence of the children there almost resembles the practice of slavery, exploitation of children throughout the day, so practically deprive a child of all their human rights in accordance with the Convention on the Rights of the Child as well as all laws and regulations applicable in the country this. Millions of Indonesian children are now being forced or compelled lost childhood and play them. Economic reasons, most of them forced into underage workers are loaded with risk. Millions of Indonesian children are now stuck in a situation of neglect, the threat of discrimination, exploitation, and violence.

Abstract

More recently, Indonesian education is facing many complex problems in which the root is the emergence of dichotomy between religious and science subjects. From that circumstance, it is strongly needed to have a fundamental concept to combine those two discrepant subjectsthrough“integration concept”.Curriculum integration is originally derived from “integrated curriculum”.This terminology is a curriculum model that can integrate skills, themes, concepts, and topics, which lies under various frameworks:within single discipline, across several disciplines, and within and across learners. Theoretically, the integration between religious and sciencesubjects is the concept that erasesdichotomy between these subjects. Despite from such advantegous sides, webbedmodel is, in fact, still considered to be the most suitable one used in learning process at elementary schoolsincethis model is designed as suited as possible with either theclassroom condition or the students. Besides, webbed model promotes phases to improve and foster values, which, consequently, needs many suggestions and acknowledgement from other partieswithin its learning process. In terms of its actual application, webbed model is not separatedwith the principle of curriculum integration which combines certain aspects including skills, themes, concepts, and topics. As a result, through this research, there will be final products; comprise of syllabus and lesson plan integrated and/or in accordance withthe principle of curriculum integration.

Problems kafa'ah actually there and a debate among scholarssect, opinion among the Hanafi school is more about kafa'ah discussin detail other thans chool, because the suspectaccording to the Hanafi school because cosmopolite kafa'ah born people living in Iraq, from diverse social backgrounds so that the Hanafi school considers importantin terms ofsocial kafa'ah (Sosial Equelity). kafa'ah theory those becomes inevitable. Abstract

Indonesian nation is undergoing a severe trial by the increasingmoral decline of the nation . Corruption , drugs , sex, fights andmany other deviant behavior that everyday adorn the local andnational media . Formal education institutions predicted aschurning generation of people has not been fully able to carryout the mandate of the national education goals in the printgeneration morality . That is where boarding Miftahul Hudaemerged as an alternative in efforts to reduce the destructiveimpact caused by the rate of change of era. The results showedthat Ponpes Miftahul Huda has good concept in coaching noblecharacter of students . Implementation of noble charactereducation in schools is done integrally through two mainpoints , namely teaching and habituation . Teaching studentsto understand the cognitive aspects as well as habituation bydirectly applying an understanding that has been gained ineveryday activities .

Abstract

This article points out the results of the study attempting to solve thespeaking problem faced by students in one of the Secondary School inEast Lampung. For the purpose of the topic, 35 students were selectedas the subject. Research method was Classroom Action Research withKemmis and Taggart model. It was conducted for about four cycles.According to the results of speaking test, findings showed that usingCommunicative Language Teaching (CLT) had positive meaningfuleffect on improving students’ speaking skill. To sum up, CLT is aneffective method to teach speaking to the subject.

Abstract

Kiai as a guardian in marriage is a phenomenon that is not uncommonamong Islamic societies, especially in rural communities that tend tostudy Islamic law through the books of fiqih salaf, which until now stillcause pro-cons among the kiai / Scholars and other Islamic societies.The issue discussed in this paper is the argument of the legality of kiaias a guardian in marriage without the guardian of Islam accordingto Islamic law and the legislation in Indonesia, in order to explain thekiai's argument as a guardian in marriage, to explain the legal basisarising from the kiai as the guardian in Marriage under Islamic lawand legislation.The results of this study indicate that the kiai's law as a guardian inmarriage without guardian nasab, marriage is considered unlawfulaccording to laws and regulations applicable in Indonesia andillegitimate according to jumhur ulama, because the guardians whoshould carry out are the judges and not the kiai

Abstract

Sexual exploitation of children is popularly called by CSEC or SexualExploitation of Children is a fundamental violation of the rights ofthe child. The infringement consisted of sexual abuse by adults, athird person, or others. The child is treated as a sexual object. Sexualexploitation of children is a form of coercion and violence againstchildren, and lead to forms of forced labor and slavery. Sexualexploitation of children is now becoming a matter of extreme concernthat has yet to be resolved. Sexual exploitation of children is a crimeagainst humanity that must be prevented and eliminated, because inaddition to violating the Convention on Rights of the Child (CRC), alsocontrary to religious and cultural norms.Criminal law protection of child victims of sexual exploitationembodied in Section 76 I and 88 Law of the Republic of IndonesiaNumber 35 of 2014 on the Amendment of Act No. 23 of 2002 onChild Protection. A form of legal protection for children as victimsof CSEC in the jurisdiction of Police of East Lampung, among othersProviding services optimally to the victim in the framework of thecomplaint and the disclosure of cases involving the victims, facilitatethe implementation of a post mortem on the victim, Concealingthe identity of the victim during the process of examination andFacilitating the process of assistance and rehabilitation to the victims.

Abstract

Waqf is the release of the property that is represented from the ownerby withholding his principal treasures and giving charity for the sakeof social interest for the common good. In changing the status of waqfproperty, the turn of the object and the purpose of the waqf are verystrict in Syafi'i's Imam, however, on the basis of an emergency and theprinciple of maslahat, among jurists like Imam Hanafi, the change canbe made, So that the benefits of endowments that continue to continueas shadaqoh fingers, not mubadzir because it is damaged, does notwork anymore and so forth. With that change, the status of the objectas a waqf property is essentially undamaged.This research is basically aimed to know the view of Imam Syafi'i andImam Hanafi regarding the change of wakaf's property status, itcan be understood that regarding the change of wakaf wealth statusaccording to Imam Syafi'i it is said that the wakaf property that isnot working anymore still can not be sold, Exchanged, replaced andtransferred, except in a state of necessity the wakaf property can beexchanged or sold. Whereas Madzhab Hanafi is of the opinion that thewaqf objects that have been or are not functioning anymore whichis no longer in accordance with the allocation, it may sell, change,replace or move the wakaf objects, in order to function or bringmaslahat in accordance with the purpose of waqf, or to obtain moremaslahat Great for the public interest, especially the Muslims.

Abstract

Pernikahan dalam Islam pada dasarnya menganut asasmonogami,karena asas tersebut lebih dapat menjaminterpenuhinya hak-hak istri. Namun demikian, Islammemperbolehkan suami melakukan poligami, disertai dengansyarat-syarat yang ketat, yaitu kemampuan suami berlaku adilterhadap para istrinya. Penelitian ini menggunakan metodekualitatif lapangan (field research). Metode pengumpulandata yang digunakan adalah: Wawancara, observasi dandokumentasi. Teknis analisa data yang digunakan adalahteknik analisa data kualitatif.Hasil penelitian adalah sebagai berikut: implementasi konsepadil dalam berpoligami di Desa Sumberrejo, KecamatanBatanghari, Kabupaten Lampung Timur belum sepenuhnyasesuai dengan ajaran Islam. Kriteria adil yang belum sesuaidengan ajaran Islam adalah kriteria adil dalam hal pemberiantempat tinggal yang sepadan kepada masing-masing istri,tanpa membedakan latar belakang masing-masing itri, baikistri yang kaya, maupun istri yang miskin. Demikian puladalam hal pembagian hari, tidak dilakukan secara samakepada masing-masing istri, tetapi berdasarkan keinginansuami. Hal tersebut tidak sesuai dengan ajaran Islam yangmenekankan bahwa pembagian hari tidak hanya mengacu kepada pemenuhan kebutuhan biologis suami atau istri, tetapiperwujudan kasih sayang dan perhatian suami. Adapun dalamhal pemberian nafkah belanja sehari-hari diberikan sesuaidengan kemampuan suami dan kebutuhan istri. Hal tersebutsejalan dengan pendapat jumhur ulama (Maliki dan Hanafi)yang mengatakan bahwa pemberian nafkah tidak dilakukanberdasarkan kadar tertentu, tetapi berdasarkan keadaanmasing-masing suami-istri.
