Abstract

Regulations concerning government omissions and the concept of positive fiction play a strategic role in the national legal system. These two legal instruments serve to ensure legal certainty, protect the public, and encourage professionalism among state officials in the provision of optimal public services. However, their implementation has raised various questions and issues, especially since the enactment of the Job Creation Law. This study aims to describe the problems that arise due to government inaction and the application of positive fiction in state administration practices. The method used is normative legal research with a conceptual approach and case studies. Through theoretical analysis, court decisions, case studies, and elaboration based on regulations and principles of administrative law, this study finds that government inaction is part of concrete action. These actions are then addressed through the application of the concept of positive fiction as a corrective instrument against the government's failure to fulfill its obligations. However, the issue becomes complex when the authority to resolve disputes related to positive fiction is separated into two different branches of power since the enactment of the Job Creation Law. This separation has the potential to open up opportunities for abuse of process by parties seeking to profit from legal loopholes. Therefore, the authority to review positive fictitious actions should be part of the jurisdiction of the administrative court.

Abstract

A state of emergency is an inevitable circumstance that has arisen in several regions of the world, including Indonesia. In these circumstances, there is widespread abuse of authority manifested by the excessive curtailment of rights and the violation of constitutional norms for declaring emergencies. Thus, it is necessary to have oversight from other state institutions to provide adequate checks and balances. This research aims to measure the supervision of the Indonesian Constitutional Court during a state of emergency. Normative legal research is a type of research that uses a conceptual approach, a case approach, and a comparative country approach. Through the analysis of decisions, cases, and elaboration with the principles of State Emergency Law, this paper finds that of the 3 (three) aspects of judicial supervision during a state of emergency, the aspect of supervision in the form of testing the declaration of a state of emergency is an aspect that is not owned by the Indonesian judiciary. Whereas this aspect is important, the declaration of a state of emergency issued by the President is unconstitutional.

Abstract

This article aims to analyze the decision of the Indonesian Ulama Council concerning the principles of international relations stipulated in the 8th Ijtima' Ulama forum in 2024. The study has three primary focuses: to scrutinize the socio-political context as the background of the MUI's decision, to examine its arguments and methodology, and to investigate the social responses to the MUI's decision. A descriptive analytical approach is used to describe and understand a phenomenon that occurs, involving causes and effects. As the findings, the study reveals that the emergence of this MUI decision responded to the Palestine-Israel conflict escalation at the end of 2023, which caused diverse policies of Muslim countries in the world. Previously, the MUI also issued a fatwa on supporting the struggle of Palestine. To support its argument, the MUI cited a series of arguments which still generally apply the qauly or textual approach. These arguments are written without adequate explanation regarding their context from istidlal or instinbath approach. Apart from that, there are debates among the public regarding the idea of boycotting pro-Israel products. The government tends to be neutral concerning the boycott campaign, while it supports the essence of the fatwa and the MUI decision to support the struggle of Palestine. This result suggests that the MUI should improve its fatwa writing design to avoid misinterpretation. Likewise, the study might have practical implications for the government to deal with such MUI’s religious thoughts.

Abstract

This study examines water resource management in Indonesia following the annulment of the Water Resources Law by Constitutional Court Decision No. 85/PUU-XI/2013, which mandated that water governance prioritize the greatest prosperity of the people. Despite the subsequent enactment of Law No. 17/2019, persistent issues of corporate industrialization, exploitation, and privatization of water sources threaten citizens' fundamental right to water and ecological sustainability. The paper adopts Jasser Auda’s contemporary Maqashid al-Shariah with its system approach as an alternative analytical framework. Auda's methodology shifts the maqasid focus from classical preservation to construction, development, and the fulfillment of human rights (hifdz al-huquq al-insan), employing six interconnected features, including a hierarchical structure. The analysis explicitly places the fulfillment of the people's rights to water within Auda's General Maqasid (Maqasid al-‘Ammah). This classification underscores the urgent need for water access as a fundamental human necessity, requiring a social and public dimension of governance that transcends individual interests.
