Abstract

The rapid development of international business law requires judges to re-scrutinise principles of contract law in the Civil Code. Therefore, principles of good faith, protection of third-party, retroaction, and restoration to pre-contract position will be analysed to provide objectively constructive feedback for judges when hearing over request for contract annulment.  Pesatnya perkembangan hukum bisnis internasional mengharuskan hakim untuk mempelajari kembali asas-asas hukum perjanjian dalam KUHPerdata. Prinsipprinsip itikad baik, perlindungan bagi pihak ketiga, retroaktif, dan kembali ke keadaan semula akan dianalisis dalam tulisan ini sehingga memberikan konstruksi obyektif kepada hakim dalam memutus permohonan pembatalan perjanjian agar jangan sampai menimbulkan perkara baru.

Abstract

AbstractJohn Austin has been widely criticized and supported in equal measure for his bold assertion that international law is not ‘real law’ due to the lack of a ‘sovereign’. This article explores Austin’s position and analyzes it as against its veracity in relation to current legal systems; modern contemporary international law; and analysis of legal questions in the international arena. While indeed Austin’s position was true about the legal systems of his time, the same cannot be transposed into the international legal system. If on the other hand the transposition is necessary, it will be shown that international law is indeed ‘real law’ with a somewhat real ‘sovereign’ just like any municipal law

Abstract

This study analyzes the meaning and scope in terms of property rights disputes or other disputes on specialis rule of clause (2) Article 50 paragraph (2) of the Law on Religious Courts and its implications to the boundary of the absolute competence between religious court and district court. This research also viewed the practice of disputes settlements deal with the property rights or other disputes on Islamic economics cases. The study was conducted by analyzing the legal regulations and court rulings related to islamic economic cases lodged property rights disputes or other disputes. Research was equipped with primary data and analyzed qualitatively. Penelitian ini mengkaji dan menganalisis makna dan cakupan dalam istilah sengketa hak milik atau sengketa lain pada aturan spesialis, Pasal 50 ayat (2) UU Peradilan Agama beserta implikasinya terkait batas kewenangan absolut antara pengadilan agama dengan pengadilan negeri serta praktik penyelesaian sengketa hak milik atau sengketa lain yang selama ini diputus terkait perkara ekonomi syariah. Penelitian dilakukan dengan menganalisis peraturan hukum dan putusan pengadilan terkait perkara ekonomi syariah yang tersangkut sengketa hak milik atau sengketa lain. Penelitian dilengkapi dengan data primer yang selanjutnya dilakukan analisis secara deskriptif kualitatif.

Abstract

The purpose of this research is to further see the implementation of duties and functions of the National Sharia Board and Sharia Banking Committee and its relations to the legislation of economic banking fiqh. In the development of Sharia Banking, synchronization between National Sharia Board and Sharia Banking Committee have been done by involving the National Sharia Board in the Committee Meeting to make Committee Recommendation to further be implemented as a Bank Indonesia Regulation. This research finds that the National Sharia Board has conducted its duties and functions in the field of sharia economy in compliance with the DSN-MUI Decision 1/2000 on the Basic Guideline of National Sharia Board Indonesian Council of Ulema and DSN-MUI Decision 2/2000 Bylaws of the National Sharia Board Indonesian Council of Ulema. Tujuan penelitian ini adalah untuk melihat implementasi tugas and fungsi Dewan Syariah Nasional dan Komite Perbankan Syariah yang berkaitan erat dengan legislasi dari fiqh perbankan. Dalam perkembangan perbankan syariah, sinkronisasi antara Dewan Syariah Nasional dalam Rapat Kerja untuk membuat suatu Rekomendasi Komite agar dapat diberlakukannya sebagai Peraturan Bank Indonesia. Berdasarkan penelitian ini dapat disimpulkan bahwa pelaksanaan tugas dan fungsi DSN di bidang ekonomi syariah telah dilaksanakan dengan mendasarkan Keputusan DSN-MUI No. 1 Tahun 2000 tentang Pedoman Dasar Dewan Syari’ah Nasional Majelis Ulama Indonesia dan Keputusan DSN-MUI No: 02 Tahun 2000 tentang Pedoman Rumah Tangga Dewan Syari’ah Nasional Majelis Ulama Indonesia.

Abstract

It is clear that environmental rights are among The most important basic rights in human’s life. Although embedded in more than several international treaties, there is yet an independent treary which focusing solely an environmental rights. This is very unfortunate to developing countries such as Indonesia, whose most environmental problems are caused by human and/or development activities and with victim improtected of their environmemal rights. This research unfolds two case studies in Indonesia regarding to be protection of three basic rights: the right to be free from hunger; the right to security and the right to health. In principle these case studies pictures enviromnental rights protection in Indonesia, which is already protected on the legal basis, but lack of implementation in the field.

Abstract

AbstractThis article argues that health sector corruption is a direct threat towards universal health care in Indonesia. Three Indonesian legal cases of health sector corruption are selected to exemplify the reality of health sector corruption and it’s detrimental effect to the realization of the right to health. This article emphasizes that corruption causes misallocation and embezzlement of the fund that hampers the State party to optimally provide universal health care for the people. This article suggests that in order to establish quality and sustainable universal health care as an instrument for the realization of the right to health, the State party has to prioritize on the elimination of health sector corruption.Keywords: corruption, Indonesia, right to health, health care.IntisariArtikel ini membahas perihal korupsi di sektor kesehatan yang merupakan ancaman bagi perlindungan kesehatan universal di Indonesia. Tiga kasus hukum mengenai korupsi di sektor kesehatan dipilih untuk memberikan gambaran mengenai korupsi di sektor kesehatan dan dampak negatifnya terhadap realisasi hak atas kesehatan. Artikel ini menekankan bahwa korupsi menyebabkan misalokasi dan penggelapan dana yang menghambat Negara pihak dalam penyediaan pelayanan kesehatan yang optimal bagi semua orang. Artikel ini menyarankan bahwa dalam rangka untuk menyelenggarakan perlindungan kesehatan universal yang berkualitas dan berkelanjutan sebagai instrumen untuk merealisasikan hak atas kesehatan, Negara pihak harus memprioritaskan pemberantasan korupsi di sektor kesehatan.Kata kunci: korupsi, Indonesia, hak atas kesehatan, perlindungan kesehatan.

Abstract

Indonesian quality of legislation is far from perfect which indicated by the high number of judicial review. Using juridical normativemethods, this study examines the causesof poor quality of legislation and the adequacy of theLaw on the Establishment of Legislation to produce high quality legislation. The study found that, first, the poor quality of the legislation occurred due to the lack of elements of transparency and accountability in the formation of legislation. Second, the Lawon the Establishment of Legislationisincompetence for the creation of good quality legislationdue to unstructured of public participationmechanism andinscrutable process of decision-making. Kualitas peraturan perundang-undangan Indonesia masih jauh dari sempurna yang diindikasikan dengan tingginya angka pengujian undang-undang. Dengan menggunakan metode yuridis normatif, studi ini mencari penyebab rendahnya kualitas peraturan perundang-undangan dan kemampuan Undang-Undang tentang Pembentukan Peraturan Perundang-undangan untuk menghasilkan peraturan perundang-undangan yang berkualitas. Studi ini menemukan bahwa, pertama, rendahnya kualitas peraturan perundang-undangan disebabkan belum dipenuhinya unsur transparansi dan akuntabilitas dalam pembentukan peraturan perundang-undangan. Kedua, Undang-Undang tentang Pembentukan Peraturan Perundang-undangan masih belum mampu menghasilkan peraturan perundang-undangan yang berkualitas karena tidak terstrukturnya pengaturan mengenai partisipasi publik dan tidak dapat ditelusurinya proses pengambilan keputusan.

Abstract

Transparency principle in the TBT and SPS Agreement is implemented by notification. Its application is prepared by related agencies through the making of regulations, establishment of enquiry points, building capacity and infrastructure. It guarantees certainty, predictability and credibility of Indonesia in international trade, and its application should not undermine national trade policy. Prinsip transparansi dalam Perjanjian TBT dan SPS diterapkan melalui notifikasi. Penerapan prinsip ini dilakukan oleh instansi-instansi terkait melalui pembuatan peraturan, upaya terkait kelembagaan, SDM dan infrastruktur. Prinsip yang bertujuan menciptakan kepastian, konsistensi bagi perdagangan dan kredibilitas Indonesia dalam perdagangan internasional, harus dilakukan tanpa mengorbankan kepentingan untuk mengamankan kebijakan impor nasional.

Abstract

The implementation of good-governance principles such as accountability, transparency, and law enforcement may limit the opportunity to commit corruption therefore ease the corruption eradication efforts. Corruption eradication should also be conducted holistically by involving relevant parties – including government officials, private sectors, and society – and by empowering preventive and repressive approaches. Penerapan asas-asas pemerintahan yang baik seperti akuntabilitas, transparansi, dan penegakan hukum dapat membatasi kesempatan untuk melakukan korupsi sehingga upaya pemberantasan korupsi menjadi lebih efektif. Pemberantasan korupsi mesti dilaksanakan secara holistik dengan mengikutsertakan pihak-pihak yang relevan – termasuk pegawai pemerintah, sektor swasta, dan masyarakat – dan dengan memberdayakan pendekatan preventif dan represif.

AbstractTrademark Rights in the practices of sharia banks is accepted as an object collateral for financing and burdened with pledge. Therefore, Trademark Rights is very risky because its value is not guaranteed then it is only accepted as an additional guarantee to the sharia bank. In minimizing risk, the Sharia bank shall assess that the Mark must have been registered as evidenced by the issuance of the certificate of Trademark, taking into account the period of protection of trademark and the inclusion of negative covenants and positive covenants in the pledge agreement as legal protection for sharia banks IntisariHak Atas Merek pada praktik bank syariah diterima sebagai objek jaminan pembiayaan dan dibebani dengan lembaga jaminan gadai. Oleh karena, Hak Atas Merek sangat berisiko karena nilainya tidak terjamin maka hanya diterima sebagai jaminan tambahan pada bank syariah. Dalam meminimalkan risiko, bank syariah melakukan penilaian bahwa Merek tersebut harus sudah terdaftar yang dibuktikan dengan diterbitkannya Sertifikat Merek, memperhatikan jangka waktu perlindungan merek tersebut dan pencantuman negative covenants dan positive covenants  dalam perjanjian gadai sebagai perlindungan hukum bagi bank syariah.
